PowerPoint Presentation DISCUSSION/ The City last conducted a comprehensive planning and development fee analysis in FINANCIAL 2010. With the adoption of significant updates to the Springfield Development IMPACT: Code (SDC) in June of 2022, as well as process changes that have taken place in response to the COVID-19 pandemic, it is an important time to re -assess the planning fees. In the fall of 2022 City staff started evaluating options for conducting a comprehensive planning fee study. Through this evaluation staff identified Portland State University (PSU) as an entity that could provide the needed work at a reasonable cost. In January 2023 staff began discussion with PSU and finalized a contract in early March 2023 to perform the planning fee study. Assessing the land use application fees and determining the cost recovery of providing the service will have potential impacts to the General Fund. The higher the cost recovery, the less additional financial support would be needed from other General fund sources (e.g., property tax). Determining how much of the cost for processing a planning application is covered by the applicant verses how much is covered by taxpayer dollars from the General fund will be a critical component to the ultimate decisions around setting the planning fees. COUNCIL GOALS/MANDATE: Provide Financially Responsible and Innovative Government Services BACKGROUND: The City of Springfield last conducted a comprehensive planning and development fee study in 2010. With the adoption of significant updates to the Springfield Development Code (SDC) in June of 2022, as well as process changes that have taken place in response to the COVID-19 pandemic, it is an important time to re -assess the planning fees. State law allows collection of fees for processing permits in two different ways, either the actual or average cost of providing the service. The model the City of Springfield (and most other jurisdictions in the state) use is the average cost of service. (ORS 227.175). The fee study will analyze the average cost of providing the service to processing land use applications. Springfield Development Code changes that Council adopted in June of 2022 included new ways of allowing middle housing and middle housing land divisions. Since these types of applications are new, the City established an estimated fee to recover the costs for processing these new applications. Specifically for middle housing land divisions, state law requires that within one year of establishing a fee for middle housing land divisions, the city must review and revise, if necessary, the fee to reflect the actual experience in processing costs. (ORS 197.380). Since the Springfield Development Code updates and approval of new fees for middle housing land divisions in 2022, the city has not received or processed any applications for a middle housing land division. However, staff is aware of and have been working with prospective applicants on the development of projects that will utilize this process. DISCUSSION In January 2023 staff began discussions with PSU and finalized a contract in early March 2023 to assess the City's planning and development fees and develop a comprehensive study to determine Attachment 1 Page 1 of 3 the rate of cost recovery that the city is collecting though the current planning fees. This study will include comparison of three cities in Oregon: Eugene, Albany, and Medford. Eugene was chosen due to the proximity and being in the same development market as Springfield. Albany and Medford were selected as being close in size to Springfield and having a similar fee structure. The results of this study are anticipated to assist city staff and City Council in contemplating future cost recovery goals and setting future fees. This fee study does not include comparison or analysis of Building Permit fees, Land and Drainage Alteration (LDAP) Permit fees, or System Development Charges (SDC's). It will only be looking at planning application fees. QUESTION FOR COUNCIL: Is Council comfortable with the three comparison cities as discussed above? Comparison of fees to other jurisdictions can be difficult to ensure there is an "apples to apples" comparison. Different cities structure the land use application review processes differently and charge fees differently. As an example, the City of Springfield process for a land use application is more of a front -loaded process. An optional Development Initiation Meeting (DIM) is available to provide prospective applicants detailed information in response to an anticipated project. For most applications an Application Completeness Review meeting is required. This ensures that the application provides all necessary information and addresses all applicable approval criteria as part of the application. This step helps alleviate delays after a formal application is submitted and typically prevents the application being deemed incomplete due to insufficient information. This process has also helped minimize appeals of land use applications. Other jurisdictions do not always have the front -loaded process and many jurisdictions experience significant delays due to incomplete applications and numerous appeals of land use decisions. The "planning" fee charged for submittal and processing of a land use/development application at the City if Springfield isn't just a fee to cover the time of planning staff. Built into this fee is the time dedicated by multiple different work groups involved in reviewing submitted applications. As an example, an application for a Site Plan or Subdivision includes significant time of the Engineering and Transportation Engineering staff to review an application. In some cases, other jurisdictions charge separate fees, one actual planning fee, and then an engineering review fee, or transportation analysis fee. Springfield charges one lump sum fee and calls it a planning fee. Another example is for a final subdivision plat application. The fee collected for this application type is called a planning fee, when over 50% of the fee is for the city survey staff to review the technical aspects of the final plat document. Very little time by planning staff is associated with these types of applications, however planning staff acts as the project manager and facilitates the application process. Most land use applications at the City of Springfield are Type 2 discretionary Director level decisions, with notice to surrounding property owners, opportunity to comment, and appeal. Other jurisdictions may process a larger number of land use application through a Planning Commission public hearing process. Processing applications through a Planning Commission public hearing process adds, time, expense, and complexity to a land use application process. With the Springfield Development Code Update, a larger number of applications can now be processed as Type 1 Attachment 1 Page 2 of 3 applications. These ministerial applications include no notice to surrounding property owners, and have no appeal process, saving application costs and processing time. This efficiency met Council's Development Code Update Project objective of streamlining the application process for a wider range of applications. PSU in consultation with city staff will be working to assess and address the dynamics discussed above in the fee study. TECHNOLOGY USE FOR TRACKING TIME To get an accurate number to determine the average time, and therefore cost for processing land use applications, it is important to consistently gather the amount of time spent on different types of land use applications by staff involved. The city does not currently have a dedicated or efficient way for tracking time spent on processing land use applications. In preparation for the fee study an existing computer software program, that was not designed for efficient time tracking, has been utilized on a limited basis since fall of 2022 helping to gather some data on the amount of time spent by certain staff on individual projects. To gather this data more efficiently and completely, staff have been evaluating different options for use of technology. This will allow for more precise time tracking providing better data use for future fee discussions and the basis for fee adjustments and updates going forward. Part of the difficulty with accurately keeping track of time for each individual application is the number of different staff members that work on an application and tracking all the time spent by those staff. It is not uncommon for 4 to 8 different staff members to spend time reviewing one land use application. This includes review by staff from Planning, Engineering, Transportation, Fire, Building, Operations, and Environmental Services, etc. NEXT STEPS: Staff is seeking input from Council at this work session on the introduction of this process. Specifically, staff is asking if Council is comfortable with the general approach as outlined, including the three comparison cities. Staff is scheduled to return on June 20, 2023, with a draft of the PSU report for consideration and discussion. RECOMMENDED ACTION: Give staff direction on the following questions: 1. Is Council comfortable with the three comparison cities as discussed above? 2. Does Council have input or feedback on the topic at this point? Any approved request will be charged a non-refundable fee $12,812 or 3 times the application fee, whichever is greater; where the development area is greater than 10 acres an additional fee of $641 per acre will be charged.
