ITEM TITLE: CITY COUNCIL ADOPTION OF A RESOLUTION INITIATING
ANNEXATION OF TAX LOTS 18-02-04-00-01511 AND 18-02-04-42-01300 IN
ADDITION TO LINDA LANE AND MT. VERNON ROAD RIGHTS OF WAY
ACTION The Council is requested to consider and adopt/not adopt the following resolution:
REQUESTED: A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO
THE CITY OF SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE
SPRINGFIELD DEVELOPMENT CODE.
ISSUE
In December 2021 the City purchased tax lot 18-02-04-00-01511, a roughly 34 -acre

parcel of land along Linda Lane. This property was purchased to preserve certain
wetlands located on the property to offset necessary wetlands impacts as part of the
Jasper Trunk Sewer Extension Project. This parcel is within the City's Urban
Growth Boundary (UGB) but is currently unannexed.

DISCUSSION/
Planned construction of the Jasper Trunk Sewer will impact a little less than one

acre of high-value wetlands. Staff originally sought to purchase the required

wetlands credits to offset the impact. However, the exact type of required credits
were unavailable. Staff moved to the next option which was to identify local
wetlands that might be available for purchase and for which the Department of
State Lands (DSL) would approve a conservation easement and issue necessary
permits to allow construction of the trunk sewer to begin. The Linda Lane parcel
has the necessary wetlands on the property and was for sale in the fall of 2021.
Council gave approval negotiate in October 2021, approved the purchase agreement
in November 2021 with the purchase executed in December 2021.
The necessary conservation easement protecting the wetlands has been determined
and approved by DSL with a final area around 11.5 acres. Council approved draft
language and gave the City Manager authorization to execute the documents on
March 6, 2023. This leaves approximately 22.5 acres of land zoned R-1 Residential
District that the City Council will be asked to give direction on managing and
potentially selling portions in the future.
Upon adopting the resolution, the formal annexation application will be submitted
starting the review and comment process by City departments, external referral
agencies, and adjacent property owners. Staff anticipates that the first reading and
public hearing will be scheduled in June at the earliest. The cost of the annexation
application (approximately $100k) is budgeted in storm and wastewater capital
funds, the same funds that were used to purchase the property.

BACKGROUND: Planned construction of the Jasper Trunk Sewer will impact a little less than
one acre of high-value wetlands. Staff originally sought to purchase the required wetlands
credits to offset the impact. However, the exact type of required credits were unavailable. Staff
moved to the next option which was to identify local wetlands that might be available for
purchase and for which the Department of State Lands (DSL) would approve a conservation
easement and issue necessary permits to allow construction of the trunk sewer to begin.
Following is a timeline of actions that have occurred with the regards to the Linda Lane Property
and a rough schedule of potential future actions:
• December 2021 — Purchase of tax lot 18-02-04-00-01511 - "the Linda Lane Property"
was completed.
• Summer 2022 — A consultant surveyor was contracted to survey and create an existing
conditions map. Mapping of the Linda Lane right of way (a Lane County Local Access
Road) and the intersection with Mt. Vernon Road was also included in their scope of
work.
• Fall 2022 — Direction from Council leadership was received to begin preparing for
annexation of the Linda Lane property. The consultant surveyor's scope was amended
to include preparation of necessary documents for annexation and the annexation
application. While conducting research, it was discovered that what appeared to be
future Linda Lane right of way was tax lot 18-02-04-42-01300 owned by Lane County.
Lane County has agreed to include the tax lot in the annexation application.
• January 31, 2023 — A Development Initiation Meeting (DIM) was conducted regarding
annexation. Transportation connectivity and providing secondary access to the Jasper
Meadows neighborhood to the east was identified as a potential issue. However, nothing
that would impede annexation was identified as the property can be served by the
minimum level of urban service required.
• March 6, 2023 — Council approved the wetlands conservation easement and draft deed
restriction language.
• April 3, 2023 — Council considers the resolution to initiate annexation.
• June 5, 2023 — Council conducts the first reading and public hearing to consider

annexation.
June 19, 2023 — Council conducts the second reading and votes on annexation.
Fall 2023 — Should the Council approve annexation; the council will consider options
and be asked to give direction for partitioning/subdividing the Linda Lane property at a
minimum placing the 11.5 -acre wetlands conservation easement on its own lot. Other
future questions:
o Should the City hold for future preservation the remaining wetlands on the
property?
o Should the remaining property be declared surplus and sold?
There are several benefits and reasons for the City to annex the Linda Lane Property:
• Emergency and public safety response will be under the jurisdiction of the Springfield
Police Department and Eugene -Springfield Fire.
• The property must be annexed to allow future land division.
• Removes a barrier for potential future buyers and developers.
• Ensures urban level development of the property in the future.
RECOMMENDED ACTION: It is recommended that the City Council approve the resolution
to initiate annexation as described in the resolution. Annexation has several benefits including
public safety, logical extension of streets and public utilities, and promoting future urban
development and use of the property. In addition, establishing the wetlands conservation
easement on a parcel separate from the remaining Linda Lane property is desirable.

RESOLUTION NO.
A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF
SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE SPRINGFIELD DEVELOPMENT CODE
WHEREAS, the City Council is authorized by Section 5.7.125 of the Springfield Development Code to
initiate annexation of contiguous property to the City Limits of Springfield;
WHEREAS, the property proposed to be annexed includes a segment of Mt. Vernon Road right of way,
a segment of Linda Lane right of way, and approximately 34 acres of publicly owned property lying
between Linda Lane and South 57th Street;
WHEREAS, the territory to be annexed is within the Springfield Urban Growth Boundary, and is
contiguous to the -Springfield city limits along the eastern boundary;
WHEREAS, annexation procedures shall be initiated and followed in accordance with the public notice
and hearing process, criteria of approval and ordinance adoption procedures contained in Springfield
Development Code Section 5.7 — Annexations,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD:
Section 1: The Common Council of the City of Springfield does hereby announce its
intention to conduct a public hearing to consider annexation of territory generally described as follows:
publicly owned tax lots 18-02-04-00-01511 and 18-02-04-42-01300, publicly owned rights of way
comprising an approximately 569 -foot segment of Linda Lane and 737 -foot segment of Mt. Vernon
Road. Said territory is generally depicted on Exhibit A attached hereto.
Section 2: As part of the consideration of the annexation action, City Council directs staff to
review the affected territory for any potential survey gaps and, if any exist, to close such gaps to
create contiguous annexation territory as depicted in Exhibit B attached hereto.
Section 3: This Resolution will take effect upon adoption by the Council.
ADOPTED by the Common Council of the City of Springfield this day of ,
by a vote of for and against.
