Floodplain Overlay District Development Application Process
1. Applicant Submits a Floodplain Overlay District Development Application to the
Development & Public Works Department
The application must conform to the Floodplain Overlay District Development
Submittal Requirements Checklist on page 4 of this application packet.
Planning Division staff screen the submittal at the front counter to determine
whether all required items listed in the Floodplain Overlay District Development
Submittal Requirements Checklist have been submitted.
Applications missing required items will not be accepted for submittal
2. City Staff Conduct Detailed Completeness Check
• Planning staff conduct a detailed completeness check within 30 days of submittal.
• The assigned Planner notifies the applicant in writing regarding the completeness of
the application.
• An application is not deemed complete until all information as required by SDC
3.3.435(B), including all information necessary to evaluate the proposed
development, its impacts, and its compliance with the provisions of the Springfield
Development Code and other applicable codes and statutes have been provided.
• Incomplete applications, as well as insufficient or unclear data, will delay the
application review process and may result in denial.
3. City Staff Review the Application and Issue a Decision
• Floodplain development approval is a Type I decision and thus is made without
public notice and without a public hearing since there are clear and objective
approval criteria and/or development standards that do not require the use of
discretion.
• Decisions address all the applicable approval criteria and/or development
standards.
• Applications may be approved, approved with conditions, or denied based on the
findings of fact showing compliance/non-compliance with the floodplain
development standards in SDC 3.3.430.
• The City mails the applicant and any party of standing a copy of the decision, which
is effective on the day it is mailed.
• The decision issued is the final decision of the City and may not be appealed.
4. Next Steps
• Approval of a floodplain development permit is required before construction or
development begins within any area of special flood hazard established in SDC
3.3.420(B).
Upon placement of the lowest floor of a structure (including basement) but prior to
further vertical construction, applicant must obtain documentation, prepared and
sealed by a professional licensed surveyor or engineer, certifying the elevation (in
relation to mean sea level) of the lowest floor (including basement).
• Where base flood elevation data are utilized, the applicant must obtain As -built
certification of the elevation (in relation to mean sea level) of the lowest floor
(including basement) prepared and sealed by a professional licensed surveyor or
engineer, prior to the final inspection.

Floodplain Development Permit Narrative
This memorandum (memo) serves as the Eugene Water & Electric Board's (EWEB) narrative
for a Floodplain Development Permit for a new Water Quality Monitoring Enclosure located
near 42"^ and Highway 126 in Springfield, OR.
NARRATVIE
The Eugene Water & Electric Board is proposing the installation of a water quality monitoring
station/enclosure on the Keizer Slough within the Obxow Natural Area. EWEB's only raw water
intake is indirectly connected to Keizer Slough and as such the water quality in the slough has
the potential to impact operation of the intake and the treatment plant which is the sole source of
water for the entire community of Eugene. The water quality monitoring station will provide
valuable water quality data that will alert EWEB operators to any spills or degradation of quality
prior to reaching the raw water intake. In addition, the historical data will be available to
generate long term trends in water quality. The installation is part of EWEB's source water
protection program which has installed these same monitoring stations at multiple locations on
the McKenzie River.
The water quality monitoring equipment will be mounted inside a 3'8" x 3'8"x 4'4" tall
fiberglass enclosure (see Attachment 1). There will be a 4 -inch diameter stainless steel pipe that
will be exposed and be used to protect the cable and water quality monitoring probe. The
enclosure will be installed near the bridge over Keizer Slough and will be located within the
Willamette River Floodway. The slab will be installed at an elevation of 478 above rust based on
NAVD 88. The water quality monitoring station is in Zone AE and has a determined 100 -year
flood elevation between 475 and 476 NAVD 29 (which per the surveyor is approximately 2.6 ft
lower than NAVD 88) see attached FEMA map included as Attachment 2.
The fiberglass enclosure will be surrounded by a black chain link fence which will allow flood
water to pass through. The enclosure is floodproof because it is constructed from fiberglass, the
equipment inside will be mounted to the enclosure. The enclosure will be secured to the concrete
slab with four ''A" diameter 4 ''A" long wedge anchors which will secure the structure during a
flood. The enclosure also has a vent opening that will allow any water that enters the enclosure
during a flood to drain out. It is not required that the equipment survive a flooding event.
The following sections of this memo will address specific development code requirements for
Appurtenant (Accessory) Structures.
SC 3.3.430 DEVELOPMENT STANDARDS
3.3.430(A)(1) Alteration of Watercourse
This install will not affect the watercourse because of its small size. The City of Springfield staff
has confirmed a No Rise Analysis is not required for this installation.
3.3430(A)(2) Anchoring
The enclosure, piping, and equipment will be anchored to prevent floatation. The enclosure will
be mounted to a concrete slab using ''A" diameter 4 ''A" long wedge anchors. The equipment will
be mounted to a back panel in the enclosure. The pipe will be anchored to the bridge abutment
with wedge anchors.
3.3.430(A)(3) Construction Materials and Methods
The enclosure is fiberglass and is therefore a flood resistant material. It is not anticipated or
required that the equipment survive a flooding event. The cable and water quality probe will be
housed in a stainless-steel pipe which is floodproof.
3.3.430(A)(4) — (7) Utilities and Equipment
All equipment in the enclosure will be mounted above the base flood elevation. There are no
requirements for water, sanitary, waste disposal systems, streets or subdivisions.
3.3.430(A)(8) Base Flood Data
Base Flood Elevation has been determined for this area per the attached FEMA map.
3.3430(A)(9) Structures Located in Multiple or Partial Flood Zones
Not applicable, the enclosure is in one flood zone.
3.430(B)(1) Flood Openings
The enclosure has a louvered opening although the enclosure is located above base flood
elevation.
3.430(B)(2) Garages
Not applicable the installation does not include any garages.
3.430(B)(3) Special Flood Hazard Areas with Base Flood Elevation
A no rise analysis is not required for this installation. Installation is considered an Appurtenant
Structure.
OWNERSHIP
The land where this monitoring station will be constructed is owned by the City of Springfield
and leased by Willamalane Park and Recreation Office. The work is being done in accordance
with an intergovernmental agreement (IGA) signed on May 9m, 2022. The IGA is attached as
Attachment 3.

INTERGOVERNMENTAL AGREEMENT
FOR WATER QUALITY MONITORING
AT MCKENZIE RIVER OXBOW NATURAL AREA
SPRINGFIELD CONTRACT MC3035
BETWEEN: CITY OF SPRINGFIELD, a municipal corporation of the State of
Oregon ("City")
AND: WILLAMALANE PARK AND RECREATION DISTRICT, a
political subdivision of the State of Oregon (""RD")
AND: EUGENE WATER AND ELECTRIC BOARD, a municipal utility
in the State of Oregon ("EWEB")
EFFECTIVE
DATE: May 9" 2022
RECITALS
A. ORS 190.010 provides that units of local government may enter into agreements for the
performance of any and all functions and activities that any party to the agreement, its officers, or
agents have authority to perform.
B. City is the owner and lessor of certain real property commonly known as McKenzie River
Oxbow Natural Area Site, Tax Assessor Map and Tax Lot 17-02-30-00401 and 17-02-29-02901
(the "Property'), located in Lane County, Oregon, more generally shown on Exhibit A.
C. WPRD is the lessee of the Property under an Intergovernmental Agreement and 99 -year
Lease Agreement with the City dated April 29, 2015, City Contract number 1535 ("Oxbow Lease
Agreement").
D. The Property is within the 100 -year floodplain and a portion of the site is within the
floodway. The property is zoned and designated Public Land and Open Space.
E. EWEB's water intake for the Hayden Bridge Water Filtration Plant is located downstream of
the Property on the McKenzie River.
F. EWEB desires to locate a water quality monitoring station on the Property at Keizer Slough,
in the location depicted on Exhibit B, attached hereto and incorporated by this reference. Elements
of the water quality monitoring station are depicted in Exhibit A and include, without limitation, a
solar panel, concrete pad, barbed wire fencing, monitoring equipment structure, and a pipe from the
monitoring equipment to the low water line in Keizer Slough.
NOW, THEREFORE, in consideration of the foregoing recitals, which are expressly made a part
of this Agreement, the parties agree as follows:
1. Water Quality Monitoring Station. The water quality monitoring station will be located
within the Property at the location depicted on Exhibit B, subject to any development
approval required by the City. WPRD and City authorize EWEB, its employees,
contractors, and agents to access said locations identified in Exhibits B for purposes of
initial construction, maintenance, reconstruction, and ongoing operation of the water quality
monitoring station.
2. Partv Responsibilities Each party agrees as follows:
a. EWEB Responsibilities.
EWEB will obtain all necessary development permits from the City at
EWEB's cost, specifically including Floodplain Overlay Permit.
ii. EWEB will arrange and pay for construction, delivery and installation of the
water quality monitoring station. This includes authority to trim and properly
dispose of trees and vegetation as reasonably needed to construct, access, and
maintain the water quality monitoring station.
iii. Following construction of the water quality monitoring station, EWEB will
return the access road used for construction to the condition that existed
before EWEB's work.
iv. EWEB will arrange and pay for repairs to water quality monitoring station
after installation. Repairs may include but are not limited to removal of
graffiti and repairing or replacing signage or fencing.
V. EWEB will arrange and pay for removal of the water quality monitoring
station at end of life, and/or upon termination of this agreement, including
removal of the concrete pad if requested by City or WPRD.
vi. EWEB may arrange and pay for removal of the water quality monitoring
station at any time prior to the termination of this agreement at EWEB's
discretion.
vii. EWEB will participate in the maintenance of the existing access road,
including the trailhead access point, proportional to their share of use with the
other parties and users of the access road, as determined by the City.
viii. EWEB will retain ownership of the water quality monitoring station.
b. City Responsibilities.
City will process EWEB's development permit application(s) for the water
quality monitoring station, provided however that nothing in this agreement
waives any applicable requirements of the Springfield Development Code.
Nothing in this agreement is to be construed as the City providing or agreeing
to provide any land use, building, or other development application approval
nor any defense on any subsequent appeal.

ii. Should the existing maintenance access road need to be relocated during the
term of this agreement to accommodate construction or reconstruction of the
42°d StreeUMarcola Road intersection or to the 42°d Street Levee (or both),
City will notify EWEB and WPRD in a timely manner. The parties agree to
cooperate in determining an alternative access route.
C. City & WRPD Responsibilities.
City and WPRD will permit EWEB access to the Property for the purpose of
constructing, reconstructing, maintaining, operating, and accessing the water
quality monitoring station.
ii. City and WRPD will continue to maintain the property, including the existing
maintenance access road, as provided in the Oxbow Lease Agreement
between the City and WRPD, as to their proportional share of use.
3. Modifications. Any modifications to this Agreement must be mutually agreed upon in
writing and signed by all parties.
4. Administration. Each party designates the following person as its representative for
purposes of administering this Agreement. Any party may change its designated
representative by giving notice to the other as provided in Paragraph 9.

5. Term of Agreement. This Agreement is perpetual unless terminated by any party on 90 -
days written notice to the other parties. This Agreement will automatically terminate upon
EWEB's removal of the water quality monitoring station and restoration of the Property to
its original condition.
6. Assignment. No party shall assign this Agreement, in whole or in part, or any right or
obligation hereunder, without the other parties' written approval.

7. Compliance with Laws and Regulations. Each party shall comply with all applicable
federal, state, and local laws, rules, ordinances, and regulations at all times.
8. Americans with Disabilities Act Compliance. In performance of the responsibilities under
this agreement, each party will comply with all applicable provisions of the Americans with
Disabilities Act of 1990, 42 USC Section 12101 et seq. and Section 504 of the
Rehabilitation Act of 1973.
9. Notices. Any notices permitted or required by this Agreement shall be deemed given when
personally delivered or upon deposit in the United States mail, postage fully prepaid,
certified, return receipt requested, addressed to the representative designated in paragraph 4.
Any party may change its address by notice given to the other in accordance with this
paragraph.
10. Integration. This Agreement embodies the entire agreement of the parties. There are no
promises, terms, conditions or obligations other than those contained herein. This
Agreement shall supersede all prior communications, representations, agreements, either
oral or written, between the parties.
11. Waiver. Failure of any party to enforce any provision of this Agreement shall not constitute
a waiver or relinquishment by any party of the right to such performance in the future nor of
the right to enforce any other provision of this Agreement.
12. Interpretation. This Agreement shall be governed by and interpreted in accordance with
the laws of the State of Oregon.
13. Indemnification. To the extent legally possible and subject to the limits of the Oregon Tort
Claims Act, the parties shall indemnify and hold the other parties, their officers, agents, and
employees, harmless from and against any and all claims, actions, liabilities, costs, including
attorney fees and other costs of defense, arising out of or in any way related to any act or
failure to act by the indemnifying party's officers, agents, and employees.
14. Status. In providing the services specified in this Agreement (and any associated services)
the parties are public bodies and maintain their public body status as specified in ORS
30.260. The parties understand and acknowledge that each party retains all immunities and
privileges granted them by the Oregon Tort Claims Act (ORS 30.260 through 30.300) and
any and all other statutory rights granted as a result of their status as local public bodies.

15. Construction of Agreement. This Agreement shall not be construed more favorably to any
party due to the preparation of this Agreement or a portion of the agreement by that
party. The headings and subheadings in this Agreement are for convenience, do not form a
part of this Agreement, and shall not be used in construing this Agreement.
