THEREFORE IN CONSIDERATiON OF THE FOREGOiNG RECiTALS I,IHICH ARE EXPRESSLY MADE A PART
OF THIS AGREEMENT, CITY AND APPLICANT AGREE AS FOLLOWS:
AGREEMENT
1. FINAL SITE PLAN. The applicant has submitted a Final Site Plan in
accordance with Section 31.080 of the Springfielo Development Co0e.
2. STANDARDS. The applicant agrees to ful fil I al I applicable standardsspecifieo in the Springfielo Development Code and the specific stanoaros listeo in
RECITALS prior to occupancy, un'less certain standards have been oeferred to a later
date in accordance with Section 31.110 of the Springfielo Development Code.
3. CONDITI0NS. The Applicant agrees to fulfil l all specific conoitions of
approval requireo by the City listeo in RECITALS prior to occupancy, unless certain
conditions have been deferred to a later clate in accordance with Section 31.110 of
the Springfielo Development Cooe.
4. M0DIFICATI0NS. The applicant agrees not to mo0ify the approved Final Site
Plan without first notifying the City. Mooifications to the Final Site Plan shall be
reviewed in accordance with Section 31.100 of the Springfiel0 Development Code.
5. I'IAINTAINING THE USE. The applicant agrees to the following:
(a) The bui loing and site shal I be maintained in accordance with the
provisions of the Springfiel0 Development Co0e in order to continue the use.
(b) It shal I be the continuing obligation of the property owner tomaintain the planting required by Section 31,140 of the Springfiel0 Development Codein an attractive manner free of weeds and other invacting vegetation. In addition,
plantings in the vision clearance area shall be trimmed to meet the 2 l/2 foot height
standard in accordance with Section 32.070 of the Springfielcl Development Co<te.
(c) Parking lots shall be maintained by the property ov{ner or tenant in a
condition free of 'litter or dust, and deteriorateo pavement conditions shall be
improve<t t,o maintain conformance with these standards.
(0) Undevelopect lano within the oevelopment area shall be maintaineo freeof trash and stored materials in a mowed and attractive manner. Undevelopect lan<l
shall not be used for parking.
6. In addition to all other remedies which may be provided by law or equity(tncluding but not limiteo to penalties provicteo by applicable State Law or City
0roinances), Applicant agrees that City may enforce Applicantrs responsibilities by
withholoing Applicant's Final Occupancy Permit, and terminating any Temporary
Occupancy Permit which may have been granted.
