Subject: Building and Zoning Code Violations
Dear Mr. Herring:
gver the past four months various members of the Public Works Department and City
Attorney'i Office have been working with you regarding certain Building Code and
Zoning Code violations existing on your property. Early in this process, various
alternatives for dealing with the violations were explained to you, including your
right to appeal some or all of the requirements to the Building Board of Appeals.
Thursday, June 24th, marked the application cut-off date of the third Building
Board of Appeals meeting since you were notified of the violations.
You made no attempt to correct the violations or file an appeal in April because,
you explained, as a tax consultant April is your busy month. In May you approached
ny office with a proposal to resolve at least the zoning violation by purchasing
property from your neighbor. It is now June, another appeal date has passed, and
the violations continue.
In my judgement, yotr haye been given more than adequate opportunity to either cor-
rect the violations or take some other concrete action leading to a resolution of
the natter. Therefore, by a copy of this letter, I am hereby referring the matter
to the City Attorneyrs Office with a recommendation to proceed with appropriate
legal action.

Mr. Herring officially submitted a set of construction drawings on April 21, 1982.
However, since the building is located less than five feet from the side property
line, a permit could not be issued until the sideyard setback issue was resolved.
Initially, Mr. Herring intended to seek a variance from the Board of Appeals. In
mid-May irowever, he stopped by the office and explained that he was trying to pur-
chase property from his neighbor instead.
At this point Mr. Herring has until the next Board of Appeal cut-off date, June
24th, to either produce a deed to the additional property or submit an application
to the Board of Appeals. Failing this, the natter will be referred to the City
Attorney for legal action.

Dear l,lr. Herring:
0n February 25, 1982, a progressive inspection was conducted at 255 North 36th
Street, Springfield, Oregon for a residential addition, permit number 792820
taken out July 25, 1979. As a result of that inspection, it was found that an
accessory building has been constructed and is currently being used as an office
for a home occupation. This separate building was not included in the applica-
tion for the residential addition permit.
Section 301 (e) of the Oregon Structural Specialty Code and Fire and Life Safety
Code [S.S.C.) clearly designates items exenpt fron permits and inspections. Please
refer to the attached copy of exemptions. The structure in question exceeds in
size and area any work exempted from the required permits and inspections of the
S.S.C. During our meeting at the site, I noticed several code infractions with
regard to structural base supports, inadequate ground clearance for protection
of wood from decay and the potential electrical hazard relative to the location
of the baseboard heating units.
The building is also in violation of Section 6.04 of the Springfield Conprehensive
Zoning Code relative to sideyard setbacks (copy attached). Each lot must have a
nininum of 5 feet between any building and the sideyard property line.
This letter will confirm our agreement that within one week from our meeting, you
will provide drawings of the structure, take action to acquire the necessary per-
nits and decide on one of the two alternatives available to resoLve the setback
problem. These alternatives are: 1) The building nust be altered to conform to
the required setback or 2) You must request a variance before the Building Board
of Appeals. The deadline for submittal for the April 1, 1982 neeting is March J.8,
1982.
