scaper (A & G Landscaping) removed the coniferous trees in the
front of our property and replaced them with three 'Acer Rubrum'
Red Map'les. It is our hope that these trees (found on the City's
"Recommended Species for Street Trees" list) will be acceptable

4. MODIFICATI0NS. The applicant agrees not to modify the approved Final Site

reviewed in accordance with Section 31.i00 of the Springfield Deve'lopment Code.
5. MAINTAINING THE USE. The applicant agrees to the following:
(a) The building and site shall be maintained in accordance with the
provisions of the Springfield Deve'lopment Code'in order to continue the use.
(O) It sha'l'l be the continuing obligation of t,he property owner t0
maintain the planting required by Section 31.140 of the.springfie]d Deve'lopment Code
in an attraciive minnei free oi weeds and other invading veletation. In addition,
p'lantings in the vision clearance area shal'l be trimmed to meet the 2 L/2 foot he'ight
standard in accordance with Section 32.070 of the Springfield Deve'lopment Code.
(c) Parking lots sna'll be maintained by the property olrner or tenant in a
condition free of 'l-itter or dust, and deteriorated pavernent conditions sha'l'l be
improved to maintain conformance with theSe standards.
(d) Undeveloped 'land within the development area shall be maintained free
of trash and itoreO materials in a mowed and attractive manner. Undeveloped land
shal'l not be used for Parking.
6. In addition to all other remedies which may be provided by law or eqlity

O"Oini^c.i), Applicant agrees that City may enforce Applicantrs resDonsibilities by

7. Any Final Site Plan approved becomes null and void if construction does not
commence within one year of the date of this Agreement.
