The purpose of this letter is to notify you of occupancy issues with your Prosper Park development,
phase I & ll, located at 945 28s Street, being tax parcels 170231000-1101, 1000 and L7O23122O23AO'
The land use approvals issued for these projects were for storage facilities and individual industrial
business spaces. The building permits issued after tentative site plan approval followed suit, allowing an
initial shell building to be constructed. ln order for these spaces to be occupied each individual
developer or lessee was to make application for an individual tenant infill permit, identifying the type
of occupancy and complying with current building codes as they relate to proposed improvements. ln a
recent site visit to investigate the location of one of the new shells, it was observed that there are
currently tenants occupying several of the spaces in the shell buildings. At this time no Certificate of
Occupancy has been issued for any of the shell structures and no permits have been requested for
individual tenants therefore the spaces should not be occupied. However in the interest of not
displacing the existing tenants, at this time the city is not requiring the closure of these spaces' we are
cuirently conducting inspections of all the spaces for Fire, Life, and Safety issues that may need to be
addressed as staff works with you to bring the development into compliance. During this compliance
process, no spaces which are currentlyvacant can be occupied in any form' We will be arranging a time
