HomeMy WebLinkAboutOccupancy Correspondence 2015-05-11ta D\I I T D OREGONINGFIctwoFS SPRINGFIETD DEVELOPMENT AND PUBLIC WORKS OREGON May 1.1, 201,5 Prosper Park, LLC Attn: Mr. Leonard Tarantola 34801 Matthews Road Eugene, Oregon 974O5 Re: Prosper Park Phase I & ll Occupancy Dear Mr. Tarantola, The purpose of this letter is to follow up on occupancy issues with your Prosper Park development, Phase I & ll, located at 945 28th Street, being tax parcels L7O231OOO-1101, 1000 and 1702312202300, which were identified in the July 1, 2014 letter, a copy of which is attached. At this point only shell approval has been granted for the buildings. As stated in the July t,2Ot4letter no Certificate of Occupancy has been issued for any of the shell structures and no permits/occupancy has been issued for individual units/tenants, therefore the units should not be occupied. In the interest of not displacing the existing tenants the City at that time had not required the immediate closure of these units in order to give you a reasonable amount of time to have the appropriate applications submitted to the city. However given the amount of time that has elapsed, almost one year, the City of Springfield is asserting its authority to require at a minimum the submittal of the required information for each of the units prior to May 26, 2015. Any units failing to comply within this submittal deadline will be posted "DO NOT OCCUPY". Once posted the units can no longer be occupied or used in any way until such time as the appropriate permits are obtained, issued and approved for occupancy. ln order to avoid this disruption to your tenants' use of the property please comply with the following requirements. ln order for these units to be occupied, each individual unit/lessee is to make application to the city for an individual tenant infill permit (structural to start), identifying the type of occupancy and compliance with current building and zoning codes, as they relate to proposed improvements and uses. Accompanying this infill permit should be a completed Drinl<ing Water Protection Overlay District (DWP) form along with a site and/or unit layout diagram, reflecting the proposed or current improvements that were constructed since the completion of Phase I of the project in 201,4. This site/unit diagram should show any and all improvements, including but not limited to changes to the mechanical, structural, electrical or plumbing systems. This information will be utilized along with site inspections to determine all the required permits that need to be applied for and ii the uses are permitted for the zone.
