Fee Waiver Process
1. Applicant Submits a Fee Waiver Application to the Development & Public Works
Department
The application must conform to the Fee Waiver Submittal Requirements Checklist
on page 3 of this application packet.
Planning Division staff screen the submittal at the front counter to determine
whether all required items listed in the Fee Waiver Submittal Requirements
Checklist have been submitted.
Applications missing required items will not be accepted for submittal
2. City Staff Conduct Detailed Completeness Check
• Planning Division staff conducts a detailed completeness check of the submittal.
• The assigned Planner notifies the applicant in the event that submittal requirements
are missing or unclear.
• An application is not deemed technically complete until all information necessary to
evaluate the request and its compliance with the provisions of the Springfield
Development Code and other applicable codes and statutes.
• Incomplete applications, as well as insufficient or unclear data, will delay the review
process and may result in denial.
3. City Staff Review the Application & Signs Agreement
The assigned Planner notifies the applicant in writing regarding the decision to
grant the waiver or not; If the waiver is granted, the City and the applicant sign a
contractual agreement to ensure compliance with the stated intent of the project.

household income, rent levels, sales price, location, and number of units;
❑ For rental housing, that the units shall remain exclusively available to low-
income households at affordable rents during the required period of
affordability;
❑ For home ownership housing, that the units shall be sold exclusively to low-
income households at an affordable sales price. Also, that if a unit is resold
within the required period of affordability, such housing shall only be sold to
another low-income household at an affordable sales price;
❑ That if, within the required period of affordability, the use of the property is no
longer for low-income housing, the owner shall pay the waived development
fees from which the owner or any prior owner was exempt; and
We are providing a copy of our land acquisition funding commitment letter from Oregon Housing
and Community Services. This program requires 30 years of affordability (minimum) for households
with income less than or equal to 60% of Area Median Income. However, we intend to apply for
other sources of funding for this project that will restrict household income to 60% of Area Median
Income.

The "Recipient Entity" (Recipient), for the purposes of this Funding Reservation, is the entity to which, upon satisfaction of all
associated conditions of this reservation, the funds identified in this letter will be issued and is further, the entity responsible
for assuring that all conditions of this funding reservation will be satisfied,

This letter does not constitute a commitment of funds. Any such commitment is conditioned on satisfactory
completion (as determined by OHCS) of all of the Conditions of Funding Reservation identified in this letter.
a) The Recipient acknowledges that OHCS may re-evaluate and may rescind this funding reservation for failing to reach
closing within 90 days of the date of this letter or the occurrence of a material change las material change is defined
or otherwise determined by OHCS) that may cause the project to fall out of conformance with funding eligibility
guidelines.
b) The Recipient acknowledges that this funding reservation is conditioned upon satisfactory completion (as
determined by OHCS) of all the requirements stipulated within the attached addendum.
c) The Recipient (and their consultant if applicable) acknowledge that prompt, timely, and accurate attention to, and
completion of, the tasks associated with the Reservation and Conditions Letter is itself a condition of this agreement.

To accept this funding reservation, the Reservation and Conditions Letter must be signed on page 3 and most be returned
to OHCS within 15 calendar days of the date of this letter. Not meeting this task within the stated timeframe will be
regarded by OHCS as formal declination of this offer of funding reservation. The signed letter can be electronically
transmitted and uploaded into an assigned Procorem WorkCeMer.

Acceptance of the Funding Reservation and Assodated Conditions:
Note: For projects required to undergo an Environmental Review per the U.S. Department of Housing and Urban Development,
the Recipient acknowledges the following:
Notwithstanding any provision of this letter, the parties hereto agree and acknowledge that
this letter does not constitute a commitment of funds or allocation of tax credits or site
approval and that such commitment of funds or allocation of tax credits or site approval may
occur only upon satisfactory completion of an environmental review, if required, and receipt
of a release of funds from the U.S. Department of Housing and Urban Development under 24
CFR Part 58. The parties further agree that the provision of any funds or tax credits to the
project is conditioned on the determination to proceed with, modify or cancel the project
based on the results of the subsequent environmental review.
On behalf of the Recipient Entity and having legal authority to bind said entity to the terms and conditions associated with

by the 10th oflanuary until the loan is repaid in full.

affecting the Project schedule. OHCS requires the opportunity to approve or reject proposed

The report must have an effective date of no more than 60 days prior to the IAP loan closing.
The report must include escrow company contact information, access to or copies of exceptions
and the vesting deed, legal description, and a plat map of the subject site(s). If an ALTA survey
has been completed, submit a copy to the Department.
An ALTA extended lenders policy will be required for the loan amount.
