Does the existing drainage ditch have enough capacity for our new impervious surfaces? 2. Does our site qualify for a setback reduction to the ditch to 35'? (2) Along all watercourses shown on the WQLW Map with average annual stream flow less than 1,000 CFS the riparian area boundary is 50 feet landward from the top of the bank. Existing native vegetative ground cover and trees must be preserved, conserved, and maintained both between the ordinary low waterline and the top of bank and 50 feet landward from the top of bank. (a) For all watercourses subject to SDC 4.3.115(A)(2), other than the Mill Race or Cedar Creek, the 50 -foot riparian area standard may be reduced to 35 feet, provided an equivalent amount and function of pervious land is established elsewhere on the propertythat utilizes water quality measures including, but not limited to: wetlands; bioswales; and additional trees, especially in parking areas, exclusive of otherwise required water quality measures and landscape areas. The applicant has the burden of proof to demonstrate, to the satisfaction of the Director, equivalency in relation to both the amount of pervious land (as specified above) and riparian area function (as specified in SDC 4.3.110(6)). The area around the tributary is also listed as a wetland: Here is the section on driveways or bridges over Water Quality Limited Watercourses: ❑ SeAa -® WgqdmfmMdwrgnn TMwrymwm.QW;p1:• W.
