The summary of conditions of approval: 1. The applicant must revise the Minor Modification Site Plan to reflect the existing sidewalk on the north side of building "D" and show at a minimum, 24 parking spaces approved in the Final Site Plan, including one space between building "B" and "C" and one ADA/van accessible parking space at stall 9. 2. In accordance with SDC 4.6-120(C), the applicant must move the wheel bumpers of each parking stall back 2 feet from any abutting sidewalk, driveway, landscaped area or structure. 3. To be in compliance with the Final Site Plan approval and retain good neighbor relations, the applicant must remove the wheel bumpers on the eastern side of building "A" and install bollards to discourage parking at this location. 4. In accordance with SDC 3.3-240, Springfield standard wellhead protection signs that include the operator emergency contact number will be posed in visible locations at each building, adjacent to the stormwater swale, and at the trash enclosure. The applicant is also advised to contact Amy Chinitz Drinking Water Source Protection Coordinator with the Springfield Utility Board at (541) 744-3475 if there are any further questions regarding the Drinking Water Protection Permit for the site or other related matters. Actions taken: 1. The applicant is submitting a site plan showing the location of the sidewalk on the northside of building "D", 24 parking spaces including the removal of one space between building "B" and "C", creating one ADA/van accessible parking space. The ADA/van accessible parking space has been painted and signs installed as per code 2. The applicant has relocated the wheel bumpers at each stall in accordance with code 3. The applicant has removed the wheel bumpers from the east side of building "A" and installed bollards. Although we have met this requirement, we would note our disagreement with the comment in the conditions stating this is part of retaining "good neighbor relations". We are being asked to abandon parking in an area that has no impact on our neighbor's use of their property. We acknowledge that this neighbor has an easement for ingress and egress over our property, limited to an area of 72'x45' but the parking stalls you are requiring us to remove in no way encumber their access. In the pictures provided by this neighbor in response to our application, (Crowbar Properties) you can see that their own vehicle is parked in a space adjacent to our property and that vehicle sticks out at least ten feet further than any car that may be parked at our building, and they park their car there almost daily (we have numerous pictures to support this). Clearly these spots are not encumbering them or their easement in anyway, We have continually strived to be good neighbors with that neighbor, even while they have filed numerous complaints against us with the city. Those complaints commenced as soon as we started our construction process, and they continue to this day. Building officials, planning officials and engineering officials have all made numerous visits to our property in response to those complaints and none of them have been found to have any merit (a search of city records will validate this). At the same time that they have complained, they have acted in ways that are incongruent with a "good neighbor policy" including: *Confronting and harassing several of our tenants *Forcing at least two vehicles with equipment trailers, to back out onto 42"d Street because they had entered onto their property, (the drivers did not know they would be refused access from the neighboring property to ours). Just two weeks ago a fatality occurred on highway 126 when a construction vehicle attempted the same thing, which points out how dangerous their actions are to the public safety. *Coming on to our property to take pictures of perceived violations. *Harassing our tenants and their customers A good neighbor policy should go both ways, and this has not been the case. 4.
