Applicant Submits a Tree Felling Permit Application to the Development Services Department The application must conform to the Tree Felling Permit Submittal Requirements Checklist on page 4 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Tree Felling Permit Submittal Requirements Checklist have been submitted. Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check • Planning Division staff conducts a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. • An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. • Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision • This is a Type II decision and thus is made after public notice, but without a public hearing, unless appealed. • Mailed notice is provided to property owners and occupants within 300 feet of the property being reviewed and to any applicable neighborhood association. In addition, the applicant must post one sign, provided by the City, on the subject property. • There is a 14 -day public comment period, staring on the date notice is mailed. • Applications are distributed to the Development Review Committee, and their comments are incorporated into a decision that addresses all applicable approval criteria and/or development standards, as well as any written comments from those given notice. • Applications may be approved, approved with conditions, or denied. • The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. • The decision issued is the final decision of the City but may be appealed within 15 calendar days to the Planning Commission or Hearings Official. NOTE: Before the Director can issue a Tree Felling Permit, information submitted by the applicant must adequately support the request. All of the Tree Felling Permit Criteria must be addressed by the applicant. Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. In certain circumstances, it is advisable to hire a professional planner or land use attorney to prepare the required findings. Revised 1/1/08 Molly Markarian 4 of 5 5.19-125 Criteria The Director, in consultation with the Public Works Director and the Fire Chief shall approve, approvewith conditions or deny the request based on the following criteria: A Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger of falling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability, volume of surface runoff and water quality of streams; scenic quality; and geological sites. C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. D. In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria. 1. Wooded areas associated with natural drainageways and water areas shall be retained to preserve riparian habitat and to minimize erosion; 2. Wooded areas that will likely provide attractive on-site views to occupants of future developments shall be retained; 3. Wooded areas along ridge lines and hilltops shall be retained for their scenic and wildlife value; 4. Wooded areas along property lines shall be retained to serve as buffers from adjacent properties; 5. Trees shall be retained in sufficiently large areas and dense stands so as to ensure against windthrow; 6. Large-scale clear -cuts of developable areas shall be avoided to retain the wooded character of future building sites, and so preserve housing and design options for future City residents. E. Whether the applicant's proposed replanting of new trees orvegetation is an adequate substitute for the trees to be felled. F. Whether slash left on the property poses significant fire hazard or liability to the City. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. H. Whether transportation of equipment to and equipment and trees from the site can be accomplished without a major disturbance to nearby residents. Project No. 21-287 This Tree Felling Permit application is associated with a concurrent Tentative Subdivision Application To build out the subdivision, it will be necessary to remove 37 trees (see included Tree Felling Plan for details). It is anticipated that the trees will be chipped on-site and used as an erosion control measure. If this creates too much material, the excess trees will be hauled out along S 701h Street. The tree removal criteria are met as follows: SDC 5.19-125 Criteria The Director, in consultation with the Public Works Director and the Fire Chief shall approve, approve with conditions or deny the request based on the following criteria: A Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger of falling, proximity to existing structures or proposed construction or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. Seven (7) trees to be removed are within the dedicated right-of-way and/or slope easements, twenty-three (23) trees are in close enough proximity to building envelopes and/or driveways, seven (7) trees are in close proximity to neighboring properties. Those trees that are not within the dedicated right -or -way and/or slope easements were reviewed for the potential of factors such as: significant root impact, ability to protect during nearby tree removal, and windthrow. Those felt to have a high level of impact are proposed for removal. The intent is to minimize impact to neighbors by performing all tree removal at one time rather than piecemeal during the buildout process. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks. wildlife. erosion soil retention and stability. volume of surface runoff and water quality of streams. scenic quality. and geological sites. The subject property is in the Hillside Development Overlay Zone, however, this is only due to its elevation. The average slope on site is less than 10%. The geotechnical report submitted with the Tentative Subdivision Application details soil stability and what mitigation factors need to be included with construction on site. The removal of trees will not have any long-term deleterious effects on the surrounding physical and visual environment, because: (1) the site is within a residential district and surrounded by fully developed lands. The surrounding lands are at a residential and tree density equivalent to that proposed for full buildout of the subdivision, (2) the trees are not uncommon or specimen varieties that warrant special protection measures, and (3) none of the trees are especially large, indicating they are likely recent regrowth that occurred after an historic use of the land, and are not part of a larger intact woodland or mature tree stand. The applicant is not aware of any State standards, Metro Plan policies or City Ordinances that would prohibit the proposed removals. C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. As shown on the plan included in this application and discussed above, trees are either in the same location as improvements to be constructed, in areas directly adjacent to improvements (which will be detrimental to the tree's long-term health), or near adjacent properties and fence lines. D. In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria: This tree felling permit accompanies a Tentative Subdivision Application which includes a public right-of-way dedication and its associated improvements. Many of the smaller trees that abut neighboring properties are included in this application to prevent windthrow, as the larger trees nearby will need to be removed to allow for the development of the subdivision. E. Whether the applicant's proposed replanting of new trees or vegetation is an adequate substitute for the trees to be felled. The Tentative Subdivision Application indicates that 32 street trees will be planted by the project's end. The street trees will replace a large portion of the 37 trees that are proposed for removal. F. Whether slash left on the property poses significant fire hazard or liability to the City. Slash will not be left on the property at the end of construction. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. The Forest Practice Administrative Rules and Forest Practices Act apply to forestlands. As demonstrated, this site does not qualify as a forestland per the definition in OAR 629-600-0100. The site is within the City of Springfield UGB and City Limits, and considered a vacant and developable portion of the city's Bunch Engineering, Inc. Page 2 43 824 S 70th Sheet - Tentefiee Subdivision September 28, 2022 residential land inventory. Since the trees on site appear to be regrowth, based on size, the proposed tree removal does not qualify as timber harvest or a commercial logging operation. It is intended that the tree removal will follow state forestry guidelines for safe operations and fire prevention during the removal of trees, slash and debris. H. Whether transportation of equipment to and equipment and trees from the site can be accomplished without a major disturbance to nearby residents. A small number of truckloads, if any, will be produced by the tree removal. As most, if not all, of the trees on site will be chipped on-site for use as an erosion control measure. Any truck loads from tree removal, should there be any, will be negligible to the overall amount of haul trucks associated with full buildout of the street, utilities and homes. Truck traffic will be able to access the site through S 701, Street which connects directly to Main Street, a main corridor for trucks. This will allow quick access to haul routes and disposal sites for any potential tree debris. Bunch Engineering, Inc.
