Approval criteria are listed below in bold italics followed by the Applicant's findings. 5.19-125 Criteria The Director, in consultation with the Public Works Director and the Fire Chief shall approve, approve with conditions or deny the request based on the following criteria. A. Whether the conditions ofthe trees with respect to disease, hazardous or unsafe conditions, danger offalling, proximity to existing structures or proposed construction, or Interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. A.1 The proposed construction of the approved Cherry Springs Site Plan Review warrants the proposed tree felling (City file 811-21-000015-TYP2). A.2 The proposed extension of utility services, 48'h Street improvements, and the extension of "B" Street warrants the proposed tree felling (City file P31070 Cherry Springs 48" St PIP). A.3 Several of the trees on the site are in poor condition showing overall stress, damaged trunks, topped main trunks, and broken branches. B. Whether the proposedfelling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability- volume ofsurface runoff and water quality of streams; scenic quality; andgeologicalsites. B.1 During the Site Plan Review process, the proposed development was extensively Tree Felling Permit Narrative Page 2 of 5 Pp7' BISHOW Cherry Springs September 27, 2022 6d CONSULTING reviewed for consistency with State standards, Metro Plan policies, and City Ordinances affecting environmental quality. The City findings approving the Site Plan Review are incorporated herein. C. Whether itis necessary to remove trees in order to constructproposed improvements asspecifred in an approved development plan, grading permits and construction drawings. C.1 It is necessary to remove the trees on the site in order to construct improvements specified in the approved Site Plan Review (City file 811-21-000015-TYP2) and the Public Improvement Plans (City file P31070 Cherry Springs 48t^ St PIP). D. In the event that no Development Plan has been approved by the City, felling of trees will he permitted on a limited basis.... Whether the applicants proposed replanting of new trees or vegetation is an adequate substitute far the trees to be felled. E.1 The Site Plan Review approval included detailed landscape plans to provide a variety of trees, shrubs, and ground cover throughout the site. The landscape plans include planting 102 new trees on the residential portion of the site. These trees include a variety of species suitable for different locations throughout the residential development. E.2 The Site Plan Review approval included a total of 58 new street trees - 32 along 48th Street and 22 along "B" Street. The specific location and quantity of trees were further reviewed during the City's PIP process. The street tree species were selected from the City's approved list of street trees. F. Whetherslash left on the propertyposes significantfrre hazard or liability to the GYry. F.1 Following the tree felling, the general contractor will clear the site and commence construction of the new development. Vegetative debris resulting from tree felling will be removed in a timely manner to prevent causing a significant fire hazard or liability to the City. G. Whether thefelling is consistentwith theguidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. G.1 The State of Oregon website states, "The Oregon Forest Practices Act (FPA) sets standards for all commercial activity involving the establishment, management, or harvesting of trees on Oregon's forestlands." The Cherry Springs site is not one of Oregon's forestlands. H. Whether transportation ofequipment to and equipment and treesfrom the site can be accomplished without a major disturbance to nearby residents. H.1 A general contractor, licensed in the State of Oregon, will supervise the transportation of equipment to and equipment and trees from the site in compliance with the approved traffic control plan. The general contractor will comply with city noise regulations and other requirements to minimize disturbance to nearby neighbors. H.2 Trees and debris hauled from the site will use 481h Street to minimize impacts on local streets to the east of the site. Tree Felling Permit Narrative Page 4 of 5 VOq BISHOW Cherry Springs September 27, 2022 6MCONSULTING In summary, this Tree Felling Permit is requested to allow all of the existing trees on the residential portion of the development site to be removed and one tree at the existing terminus of "B" Street in the future public right-of-way. Removal of the trees will allow construction to commence on the City approved Cherry Springs development. The Tree Felling Permit complies with the approval criteria.
