Letter Addressing Conditions of Approval
1. The apphicantmust retain a private professional civil engineer to design the site
improvements m d a//public improvements in conformance with City codes, this decision,
and the current Engineering Design Standards and Procedures Manual (EDSPM) pursuant
ts SDC5.17-125.8 and SDC 4.1-110.B. The private civil engineer also is required to
provide construcdon inspection services.
Enc Favreau was contracted as the professional civil engineer who has provided all design of the
site improvements which conform to EDSPM and pursuant to SDC 5.17-125.8 and SDC 4.1-110.8.
2 The appficantmust place new utility//nes underground and provide screening from utility
vaults/transformers/connections along the B Streetfrontage in accordance with SDC 4.4-
110.8 and Springfield Utility Board's spacing requirements.
New utility lines have been installed per requirements of SDC 4.4-110.8, .
3. To ensure each parcefhas adequate stormwaterfacifities, the app/icantmust constructaff
stormwater management facilities, to be reviewed and approved through a plumbing permit
and inspected by the Plumbing inspector and Public Works.
Stormwater facilities are installed and have been reviewed and inspected.
4. To ensure residendaf development on Parcell meets the setbacks from the infiltration
rain garden, as outlined in the Eugene Stormwater ManagementManuaf, page 2-25
Appendix B, the appficantmust amend the shared ud/ityeasement or provide a 'No Build'
easementinto Parcel Z adjacent to the fn6/tradw rain garden.
There is 10.00'x 36.00' No Build Area on Parcel 1 to ensure setback from the infiltration garden.
5. The app/icantmust construct the drivewayin compliance of the standards listed in SDC
4.2-120.C, Tab/es 4.2-2 and 424, for Sing/e-Fant//y and Duplexes.
The driveway is constructed in accordance with SDC code and compliance for"Single Family and
Duplexes'.
6. Alf fire apparatus access routes are to be paved ail -weather surfaces able to supportan
80,000-fb, imposed load in accordance with the 2019 Springfield Fire Code (SFC) 503.2.3
and SFCAppendfx D102.1. The applicantmustmeetfire access road standards to obtain
occupancy cert6icates pursuant to SDC 4.2-120.
All fire access has been paved to support the necessary load requirement in accordance with SFC
503.2.3 and SFC Appendix D102. 1.

7. Prior to Final Plat approval, the applicant must include "NO PAR/aNG-FIRE LANE" signage
posted on both sides of the portion of tihe access drive which does not have parking on either
side according to SFC D103.6. The location and detail of these signs mustbe shown on the
plans to meet the requirements of SDC 4.2-120.
"No Parking -Fire Lane" signs have been installed on both portions of the access drive where no
parking is located on either side. The signs meet the requirements of SDC 4.2-120.
8. Prior to Fina Plat approval, the applicant must provide an operations and maintenance
plan to the City forreview to ensure the long-term maintenance and operation of the
proposed soakage trenches and for the rain garden located on Parcel 2, consistent wfM
maintenance criteria required by EDSPM 3.03.1. The plan should designate maintenance
responsibility for operating and maintaining ffie system and should be distributed to of
property owners and tenants of the site.
An operations and maintenance plan for the soakage trenches and rain garden on Parcel 2 is
provided and provides designated maintenance responsibilities for operation and maintenance
among tenants and property owners.
9. Prior to Fina Plat approval, the applicant must install the new sanitary sewer service lines
to serve Parcels 2 6 3 to be reviewed and approved through an encroachmentpermit and a
plumbing permit
A new sanitary sewer service line has been constructed to serve Parcels 2 & 3 and have also
been approved through an encroachment permit and plumbing permit.
10. Prior to frnaf Plat approval, the appficantmust work with SUB for the design of their
water access and to ensure that the water supply from nearby fie hydrants meets the
standardsrequired by the 2019 Springfield Fire Code in accordance with SDC A3-120.
Applicant has worked with SUB to ensure water supply from the nearby fire hydrants meet the
standards form SDC 4.3-120.
11, In accordance with SFC 9124, immediate access to fie department connections must
always be maintained and without obstruction by fences, bees, shrubs, wafs, or my other
objects.
Access connections have been cleared of any obstructions and will continue to be maintained.

NOW THEREFORE, said Owners, Heirs, and Assigns have agreed to share a Private 26.00 foot wide
Joint Access and Ubhty Easement as shown on said partition plat over and across Parcels 2 and 3 for the
benefit of said Parcels 1, 2 and 3 and enter into a Maintenance Agreement.
NOW THEREFORE, it is hereby agreed and declared that:
The Owners, Heirs and Assigns of the above named Parcels shall share equally in the costs of
maintenance and operation of the aforementioned Easement.
The Owners, Heirs and Assigns of aforementioned Parcels shall cause said Easement to remain
available for access to the public road at all times.
Maintenance shall be undertaken at such time when the Owners of said Parcels deem it desirable.
Emergency vehicles shall have the right to enter upon said Easement for the purpose of
emergency vehicle access.
Said Easement shall be used for the purposes of ingress, egress, utilities, and maintenance and
repair of the shared driveway.

(d) 'Public Records": Those records which by the laws of the state of Oregon impart constructive notice of matters

Liability of Company.
(a) This is not a commitment to issue title insurance and does not constitute a policy of title insurance.
(b) The liability of the Company for errors or omissions in this public record report is limited to the amount of the charge
