RESERVATIONS AND RESTRICTIONS
BEL -MAR
KNOW ALL MEN BY THESE PRESENTS, that the undersigned hereby make
the following restrictions which shall apply to any and all portions
of the land described herein, which reservations shall run with the land
described as follows:
Beqinning at a point in center of Mohawk Highway which point is West
1663.6 feet from the S.E. corner of the William Spencer D.L.C. 4
50 in T 17 S., R 3 W., of the Willamette Meridian; thence along center
line of Mohawk Highway West 2100.0 feet; thence North 1137.0 feet;
thence S. 890 45' E. 1251.7 feet; thence N. D° 25' W. 200.0 feet;
thence S. 890 40' E. 1150.0 feet; thence S. 00 50' E. 431.0 feet;
thence West 3.5 feet; thence South 891.2 feet to point of beginning,
all in Lane County, Oregon, and containing 66.45 acres more or less.
1. Each building constructed or placed on said land shall within
ninety (90) days of erection be painted with two coats of good
quality paint.
Before anyone occupys a residence of any sort on any part of
these premises, said residence shall be connected with a stan-
dard septic tank which shall be properly maintained at all times and
the absorption field of said septic tank must pass approved require-
ments.
Notice is hereby given that the Union Central Life Insurance
Company has previously reserved one-half of the oil rights on
the above described land.
If the parties hereto, or any of them, or their heirs or assigns
shall violate any of the covenants herein, any other person or persons
owning any real property situated in said development or subdivision
is hereby given the right to prosecute any proceedings at law or in
equity against the person or persons violating or attempting to violate
any such covenant and either to prevent him or them from so doing or to
recover damages for such violation.
Invalidation of any one of these covenants by judgment or court
order shall in no wise affect any of the other provisisions which shall

and replacing therein underground and above ground electric distribution fiber optic, and
telecommunication lines, including pales, guy wires, vaults, transformers, and other necessary facilities, to
remove and replace fences and lawns to the extent necessary to construct, maintain, and protect said
lines, to cut and trim trees and shrubbery, and to trim and remove all dead, weak, leaning, or dangerous
branches or entire trees that are high enough to all wires. No pert of any building or permanent
structure will be placed upon tlris easement by Grantor, other than pavement, curbs, sidewalks, and
driveway aprons made with such materials as Grantor deems appropriate, without the express consent of
Grantee. This easement does not restrict the installation of public utilities provided such installations meet
Grantee's approval.
TO HAVE AND TO HOLD said easement unto Grantee and Grantee's heirs, successors and assigns
forever.
Grantor further covenant and warrant that hither are the owners of the real property more particularly
described and set forth in Exhibit B and that the property is free and clear of encumbrances and liens of
whatsoever kind and character except all covenants, conditions, restrictions, encumbrances, easements,
and liens, if any, affecting title which appear in the public records and any of those visible from a physical

removeand replace fences and lawns to the extent necessary to constrod, maintain, and protect said
Imes, to Cut and Nm trees and shrubbery, end to him and remove all dead weak, leaning, or dangerous
branches or entire lreea that are high enough to strike wires. No ped of any cull or permanent
structure will be placed upon this aamement by Gil other than pavement, curbs, aidewalks, and
driveway aprons made with such materials as Grantor deems appropriate, without the express Cement of
Grantee. This easement does not restrict the installation of public utilities provided such installations meet
Grantee's approval.

Notice of Operations and Maintenance Agreement
Private Stormwater Management and Treatment System
The undersigned owner(s), is hereby given notice that stormwater runoff from the "Property" described below
requires stonnwater management facilities to be located, designed, and constructed in compliance with the City
of Springfield's Engineering Design and Procedures Manual. Said facilities shall be operated and maintained
in accordance with the Operations and Maintenance Agreement (O&M Agreement) on file with the City of
Springfield, Development and Public Works Department Habitat for Humanity of Central Lane (Property
Owner/Developer) acknowledges and agrees to maintain private stormwater treatment facilities listed in this
document. The maintenance of the stormwater facilities listed in this document is required as part of the
Development Agreement with the City of Springfield. This facility will be operated and maintained in
accordance with the requirements stated in this document and in the latest edition of the City of Springfield
Engineering Design Standards and Procedures Manual, Chapter 3. The City reserves the right to enter and
inspect any stormwater facility located on the "Property" to ensure the facilities are operating as designed.
Failure of the responsible party to inspect and maintain the facilities can result in an adverse impact to the
public stornwater system and the quality of receiving waters.
The requirement to operate and maintain the stormwater treatment facilities in accordance with the approved
site development agreement and the site O&M Agreement is binding on all current and future owners of the
property. The Agreement and its O&M Plan may be modified under written consent of new owners with
written approval by and ro-filing with the City. The O&M Agreement and O&M Plan For facilities constructed
pursuant to this notice are available at the Development and Public Works Department, 225 Fifth St,
Springfield Oregon, or call (541)-736-3753, between the hours of 8 a.m. and 5 p. in., Monday through Friday.
The Subjeet premises, is legally described as follows: (Tac lot numbar cannot be used to describe the property.
Legal descriptions may be obtained from the county assessor's office).
