Applicant Submits a Minor Variance Application to the Development Services Department The application must conform to the Minor Variance Submittal Requirements Checklist on page 4 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Minor Variance Submittal Requirements Checklist have been submitted. Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check • Planning Division staff conducts a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. • Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision A Type II decision, made after public notice, but without a public hearing, unless appealed, is issued within 120 days of submittal of a complete application. • Mailed notice is provided to property owners and occupants within 300 feet of the property being reviewed and to any applicable neighborhood association. In addition, the applicant must post one sign, provided by the City, on the subject property. • There is a 14 -day public comment period, starting on the date notice is mailed. • Applications are distributed to the Development Review Committee, and their comments are incorporated into a decision that addresses all applicable approval criteria and/or development standards, as well as any written comments from those given notice. • Applications may be approved, approved with conditions, or denied. • The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. • The decision issued is the final decision of the City but may be appealed within 15 calendar days to the Planning Commission or Hearings Official. This written statement addresses the criteria ofthe Springfield code section 5.21-125. Text from the code is Italics and the responses are in plain text SDC 5.21-125 Permit Criteria A Minor variances are limited to certain specific numeric standards In this Code. The director may adjust the following numeric standards by up to 30 percent as a Minor Variance. L Building Setbacks; 2. LotlParcel dimensions that do not reduce the required lot/parcel size below the minimum required in the applicable zoning district; 3. Building height 4. Lotporcel coverage outside ofthe HD Overlay District as described in Section 3.3-510: and 5. Parking standards on certain infill lots/parcels The applicant is proposing a lot/parcel coverage variance. no tentative subdivision decision outlines maximum lot coverage on these lots to be 45%. The proposed site is outside of the 711) Overlay District as described in 3.3-510. The requested minor variance is to increase the allowable lot coverage to 58%, which would result in a 29% increase. This request is the below the 30% threshold for a minor variance application, therefore this criterion is met. B. ff the Minor Variance involves a setback the abstinent shall be prepared by an Oregon registered surveyor Proposed variance does not involve any setbacks, therefore a registered Oregon surveyor is not required. C. The Director may consider additional categories ofMnor Variance, on a case by case basis, without a need for an interpretation, as specified in Section 5.11-100. This requested minor variance is a numeric change and is specifically allowed. D the Director shall approve the Minor Variance ifthe applicant demonstrates compliance with all ofthe applicable approval criteria: 1. Locational or dimensional problems have been identified that can be resolved by a minor variance; 2. The request is the minimum necessary to alleviate the identified dimensional or locational problem 3. Where applicable, the request shall result in the preservation of on-site trees 5 -inch dba and above; 4. The request shall not impede adequate emergency access to the site; 5. %'he request shall not unreasonably adversely impact public or private easements; and 6. The request shall not unreasonably limit solar access standards for abuHdng properties. In order to meet this criterion, the Director may require that the building or structure be placed as close to the south property line as passible. 1. Bruce Wiechert Custom Homes purchased the subdivision after approval and the lot dimensions/configuration were already set. While laying out house footprints on the lots, it has been determined that the 45% lot coverage standard in the decision is too restrictive. The house plans that are proposed on the smaller lots are generally requiring 50%- 58% coverage. This can be resolved by the requested minor variance. 2. Although this requested change is not applicable for all lots in the subdivision, the Owner has requested inclusion of all subdivision lots to allow flexibility in design options while working with prospective home buyers. This requested change will not affect the public improvements already constructed or cause public safety issues. 3. Stormvatcr - The storm report submitted and approved with the tentative subdivision included storm run-off from each lot at 65 % impervious coverage. The storm conveyance, treatment, and detention facilities were designed and constructed with this criteria. Therefore, allowing the lot coverage to increase to 58% maximum will cause no detriment to the constructed stone system. 4. The requested minor variance will have no impact on wastewater, water or other public improvements already constructed. This includes no modification to the street system which will maintain adequate emergency access to all parcels within the approved subdivision. 5. The requested minor variance will have no impact on public or private easements within the platted subdivision. a. The houses will belayed out on the lots to meet City of Springfield setback and solar design requirements. This minor variance request will not have an adverse effect on either design standard. In addition to the applicable approval criteria specified in Subsection 1. Through 6., above, the following approval criteria shall also apply to a request involving parking reductions an infill lots/parcels in the Commercial and Industrial Districts when there is a change ofuse, addition or expansion that requires Site Plan Review Modification. The hiinmVariance for parking reductions shall not apply to MDS applications as specified in Section 5.15-100; a. The individual characteristics ofthe proposed use require more parking than is generally required for a use of this type, b. The Minor Variance for a parking reduction shall run with the use or uses to which it pertains and not run with the land itself e. The needfor additional parking cannot reasonably be met through provision ofou-street parking or shared parking with adjacent or nearby uses because: i. The owners ofabutfing properties cannot agree to execute a joint occwcc/ urking agreement, and/or ii The Public Works Director has determined the proposed shared parking area is a safety hasard because it is located loo far from the proposed use, d. The request shall not result in the parking or loading ofvehicles on public streets in a manner that may interfere with the free flow of trq(f r on the streets, e. The property otherwise complies with the provisions of this Code. This minor variance request is not related to parking reduction, therefore this section is not applicable. This request for this minor variance is in compliance with the approval criterion for Springfield 5.21-125; thus the applicant respectfully requests that the City approve this application.
