HomeMy WebLinkAboutResolution 2022-12 04/04/2022 CITY OF SPRINGFIELD, OREGON RESOLUTION NO. 2022-12 A RESOLUTION TERMINATING THE DECLARATION OF A STATE OF EMERGENCY DUE TO THE COVID-19 PANDEMIC WHEREAS, ORS 401.305 provides authority for the City of Springfield to act as an emergency management agency, including authority to establish policies and protocols for defining and directing responsibilities during the time of emergency; WHEREAS, the City of Springfield has enacted a local Ordinance (SMC 2.800 et seq.) pursuant to the authority granted by ORS Chapter 401 that provides for executive responsibility in times of emergency; WHEREAS, the novel coronavirus causes an illness known as COVID-19 and has created a threat to public health and safety, that created a citywide emergency under ORS 401.025(1) and SMC 2.808(1); WHEREAS, on March 8, 2020, the Governor declared a State of Emergency for the entire State of Oregon; on March 11, 2020, the World Health Organization declared COVID-19 to be a global pandemic; and on March 13, 2020, the President declared a national state of emergency; WHEREAS, on March 16, 2020, the Springfield City Council passed Resolution 2020-05 declaring an emergency for the City of Springfield due to the COVID-19 pandemic; WHEREAS, The COVID-19 pandemic required a prolonged response and City Council further amended Resolution 2020-05 by adopting Resolutions 2020-13 (May 4, 2020), 2020-20 (June 15, 2021) and 2021-29 (June 28, 2021); WHEREAS, on April 1, 2022, Governor Brown rescinded the State of Oregon Emergency Declaration due to the decrease in hospitalizations and case numbers; and WHEREAS, under Resolution 2020-13, the City of Springfield's emergency declaration remains until terminated by the City Council and SMC 2.808 provides that the Council may terminate the declaration of the state of emergency by majority vote, NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The state of emergency declared for the entire City of Springfield, effective on March 16, 2020 is hereby terminated. Section 2: The special regulations adopted as part of Resolutions 2020-05, 2020-13, 2020- 20 will end 90 days after the effective date of this Resolution. Section 3: If any section, subsection, sentence, clause, phrase or portion of this Resolution is, for any reason, held invalid or constitutional by a court or competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereof. Section 4: This Resolution will take effect upon adoption by the Council. ADOPTED by the Common Council of the City of Springfield this 4th day of April , 2022, by a vote of 6 for and 0 against.
