("Hexion"), formerly known as Borden, Inc., is the owner of the industrial property at 470 South 2nd Street in Springfield, Oregon ("City"). Hexion is seeking approval to vacate that portion of South `B" Street lying West of the West Right of Way line of South 2nd Street, described in attached Exhibit A and shown on attached Exhibit B. A. Reason for Vacation. Hexion is seeking to vacate the portion of South `B" Street lying West of the West Right of Way line of South 2nd Street because it separates two parcels owned by Hexion where Hexion's operations occur. As shown below in Figure 1 below, the portion of South `B" Street proposed for vacation is not improved and terminates within Hexion's site. The portion of South `B" Street to the west was previously vacated, so the portion of South "B" Street proposed for vacation does not provide access to any non-Hexion properties and does not connect with any other roadways. Hexion is pursuing this vacation so that it may more safely move trucks and other vehicles between the two portions of its site. Figure 1. B. Proposed Use of the Area to be Vacated. Flexion intends to use the area to be vacated to safely store and operate trucks between the two portions of its site, and for other activities associated with its operations. As explained above, the area to be vacated is unimproved and only provides access to Hexion's site. C. Compliance with Applicable Criteria. Per Springfield Development Code ("SCD") Section 5.20-130.B., an application for a right-of- way vacation will be approved if found to be consistent with the following approval criteria. Each criterion is addresses in tum below: The Vacation shall be in conformance with the Metro Plan, Springfield Transportation System Plan (including the Conceptual Street Map) and adopted Functional Plans, and applicable Refinement Plan diagram, the Plan District map, or Conceptual Development Plan; Response: The proposed vacation is in conformance with the applicable plans. Although the portion of South `B" Street proposed for vacation is shown on the City's Conceptual Street Map as an existing local street, it is not designated for improvement as an arterial or collector and does not appear on any of the 2035 Transportation System Plan Maps for planned roadway, transit, or pedestrian/bicycle networks. Further, as shown above, there would be no benefit to improving that section of South `B" Street because it terminates within Hexion's site. The Vacation shall not conflict with the provisions of Springfield Municipal Code, 1997; and this Code, including but not limited to street connectivity standards and block lengths; and Response: The proposed vacation will not conflict with the provisions of the Springfield Municipal Code ("SMC") and SDC. As discussed above, the area proposed for vacation is located within Flexion's industrial site. The portion of South `B" Street proposed for vacation only provides access to Hexion's property, so the proposed vacation will not create any street connectivity issues. Because Hexion's property fronts on South 2nd Street, the property will continue to meet the SDC frontage requirements. Likewise, given the nature of the existing industrial use and Flexion's ownership of the adjacent parcels, the proposed vacation will not create any issues of compliance with the standards of the SMC or SDC. There shall be no negative effects on access, traffic circulation, emergency service protection or any other benefit derived from the public right-of-way, publicly owned land or Partition of Subdivision Plat. Response: As outlined above, there will be no negative effect on access, traffic circulation, or emergency service protection from the proposed vacation. Rather, Hexion will be able to more safely move trucks and other vehicles between the two portions of its site.
