Regarding annexation of 5413 Mt. Vernon Road, Springfield, Oregon.
We are requesting a determination and continuance of Non -Conforming use.
This property contains a single family residence which was built in 1958 according to county
records. It has been continuously rented to same tenant since we purchased the property in
2007.
I have provided a copy of the schedule E from the income tax record as well as copies of the
tenant (Linda Jones) utility bills.
The tenant and her daughter Melissa are currently relying upon a Buck portable toilet since the
septic system failed this winter during the heavy rain.

sufficient.
The title report should come this week and hopefully I will get some information from the surveyor and the contractor.
Also I sent you an email with a contact for Springfield utility board because they have to have City permission in order to
connect water.

That's great. Yes we will do whatever we need to do so the annexation agreement is fine.
I am happy to say I did hear from Harvey and he will get started on it. I also ordered the preliminary title
report because he needs a copy of that as well.
I need to read back over the minutes from the meeting yesterday. It sounds like this will be an
emergency annexation and it sounds like we're going to get the physical connection completed pretty
quickly. Thank you so much!

I got clarification from my colleagues that the Surveyor's work is not required
until we go to City Council. So I recommend focusing on submitting a full
annexation application ASAP, executing the Annexation Agreement, and the fees
we shared with you yesterday. I believe this is all we need to move forward with
obtaining permits to connect to the sanitary sewer.

Ok Thank you. I will review and see if I can attach all of the forms in one email
I was considering also the concern you mentioned about the property possibly being determined as uninhabitable. We
absolutely do not want to disrupt the tenant and if the City feels that a buck toilet is not adequate, our next step has to be
getting the septic and sewer maintenance company out to work on the current system. Then we can proceed at a more "non-
emergency` pace and make sure all the details are in place.
Also I must have misunderstood because I thought you indicated the water could be connected without the annexation. We
have already had the well shocked by Casey Jones well drilling so that aspect should be fine until we get the annexation
complete.
I spoke with Nick at Best Septic and plumbing this morning. I had contacted them to get a bid on the sewer connection so he
has already been out to the property again recently. I shared your concern about habitability and he said that the water table
is much lower now. He did evaluate the tank when he was there and says the water level in the tank is normal and not
overflowing. I asked him to start with doing the evaluation and repair or maintenance of the current system before moving
ahead with anything else. He agrees and he also suggests that we could allow the tenant to start using the sewer system
again now. He did not see any signs that the drain fields had been overflowing and the tank was not overflowing either. He
can't guarantee it but says he is confident that the system will work and he will get the evaluation and maintenance or repair
done as soon as possible. Now that the rain has let up the surface water has dried up. He has other suggestions for diverting
some of the ground water way from the drain fields as well.
So for now I am going to ask Linda Jones to go ahead and use the sewer system and until Best goes out and does the full
evaluation and repair or maintenance and will just hold off on this application. We absolutely do not want to disrupt the
tenant.
We had agreed to the annexation agreement. I know there are a lot of emails back and forth. It is a draft so we didn't sign it
but if you will send a copy that is not a draft we can sign and send back to you with the rest of the application.
Still waiting on the title report and the red line maps too.
Thanks for the alert about the tenants. That would have been a real hardship for them to have to leave home. They have
been there since we purchased the property in 2007 and many years before with previous owner. Really good tenants.

Thank you for letting me know about the annexation on April 18th and the documentation that will follow.
SUB Water needs to wait until the annexation has been completed before we can install the new water
service.
The new water connection needs to be at least 10' away from the new sewer line and 5' from the driveway.
Other than those two restrictions, the meter can be placed anywhere along the property frontage. I will work
with the owners on placement of the new water service. Thank you for your help and information.

When the City receives a complete annexation application, we will bring the request to City Council. We are
aiming for the City Council to approve the annexation on April 18th. I can provide you with documentation of
the Council's decision ASAP after that meeting.
One thing to note is that we will be expediting the sanitary sewer connection, which will most likely be
physically connected before April. I'm not sure if SUB Water needs to coordinate with the sanitary sewer
connection so please let me know what else you may need from your end.
