Approval. Not applicable as this request is included in Section A above, and meets criteria in
Section D, below.
D. The Director shall approve the Mirror Variance if the applicant demonstrates
compliance with all of die applicable approval criteda.
1. Locational or dimensional problems have been identified that can be
resolved by a Minor Variance,
Proposed Parcel 2 meets SDC 3.2-215 requirement for minimum parcel size on lots/parcels in
the Hillside Overlay District with slopes up to 35% (20,000 sq ft) at 30,646 sq it, but does not
meet the requirement for street frontage (150 ft). The proposed tentative partition plan depicts
110 feet of street frontage where 150 feet is required, which is a deficiency of 40 feet or 27%.
To meet the parcel frontage requirements for proposed Parcel 2 the applicant is requesting
approval of a Minor Variance (27%) for street frontage for Proposed Parcel 2.
2. The request is the minimum necessary to alleviate the identified
dimensional or locational problem,
This Minor Variance allows Proposed Parcel 1 to meet SCD 3.2-215 compliance standards
regarding both Area and Street Frontage and allows for Proposed Parcel 2 to maintain
compliance with Area standards. Approval of a Minor Variance of 27% for Street Frontage
requirements is the minimum necessary solution for successfully alleviating the dimensional
constraints regarding this proposed tentative partition.
3, where applicable, the request shall result in the preservation of on-site

No trees will be impacted by approval of this variance.
4- The request shall not impede adequate emergency access to the site.

Variances—Criteria
A. Minor Variances are limited to certain specific numeric standards in Mis Code. The
Director may adjust the following numeric standards by up to 30 percent as a Minor
Variance.
1. Building setbacks,'
No buildings are proposed at this time and therefore no adjustments are requested to building
setbacks.
2. LoVparcel dimensions that do not reduce the required loVparcel size
below the minimum required in the appfrcable zoning district,
The subject property is in the Hillside Overlay District with therefore the minimum lot/parcel
sizes required are 10,000 sq ft Both Parcels on the subject property meet the minimum
requirements with Parcel 1 at 10,002 sq ft, and Parcel 2 at 30,646 sq ft. This requirement has
been met.
3. Building height,'
No buildings are proposed at this time and therefore no adjustments are requested for building
height.
4. LoVparcel coverage outside of Hie HD Overlay District as described in
Section 3.3-510; and
Not applicable.
5. Parking standards on certain infill lots/parcels.
Not applicable.
B. If the Minor Variance involves a setback, Pre plot plan shall be prepared by an
Oregon registered surveyor.
The Minor Variance does not involve a setback.
6. The request shall not unreasonably linittsolar access standards for
abutting properties In order to meet this criterion, the Director may require that
the building or structure be placed as dose to the south property line as
possible,•
The parcel is sufficiently large; no solar access will be impacted by this Minor Variance request.
City staff can review proposed homes for compliance at time of building development.
7. In addition to the applicable approval criteria specified in Subsections 1.
through 6, above, the following approval criteria shall also apply to a request
involving parking reductions on infi/l lots/parcels in the Commercial and Industrial
Districts when there is a change of use, addition or expansion that requires Site
Plan Review Modification The Minor Variance for parking reductions shall not
apply to MDS applications as specified in Section 515-100:
This Minor Variance request is just a dimensional change to the street frontage of a 2 -lot
partition. No development/parking is proposed at this time.
a. The individual characteristics of the proposed use require more
parking than is generally required for a use of this type,
b. The Minor Variance for a parking reduction shall run with the use
or uses to which it pertains and not run with the land itself,
C, The need for additional parking cannot reasonably be met
through provision of on -street parking or shared parking with adjacent or
nearby uses because:
L The owners of abutting properties cannot agree to
execute a jointaccess/parking agreement; and/or
R. The Public Works Director has determined the proposed
shared parking area is a safety hazard because it is located too far
from the proposed use,
d The request shall not result in the parking or loading of vehicles
on public streets in a manner that may interfere with the free Now of
traffic on the streets,
e. The property otherwise complies with the provisions of this Code.
