Applicant Submits a Land Division Plat Application for Pre -Submittal • The application must conform to the Land Division Plat Pre -Submittal Requirements Checklist on pages 4-6 of this application packet. • A pre -submittal meeting to discuss completeness is mandatory, and pre -submittal meetings are conducted every Tuesday and Friday, from 10:00 am - noon. • Planning Division staff strives to conduct pre -submittal meetings within five to seven working days of receiving an application. 2. Applicant and the City Conduct the Pre -Submittal Meeting • The applicant, owner, and design team are strongly encouraged to attend the pre - submittal meeting. • The meeting is held with representatives from Public Works Engineering and Transportation, Community Services (Building), Fire Marshall's office, and the Planning Division and is scheduled for 30 to 60 minutes. • The Planner provides the applicant with a Pre -Submittal Checklist specifying the items required to make the application complete if it is not already complete, and the applicant has 180 days submit a complete application to the City. 3. Applicant Submits a Complete Land Division Plat Application • When the applicant has addressed all items on the Pre -Submittal Checklist and the City Surveying Section has notified the applicant's surveyor that the plat and other documents are sufficiently refined, the applicant can submit a complete application to the City Survey Section located in the NW Quad of City Hall. • The application must conform to the Land Division Plat Submittal Requirements Checklist on page 6 of this application packet. • If the submittal is deemed complete, the City Survey Section will sign -off on the City Survey approval sheet and send the applicant to the Development & Public Works Department for application submittal and fee collection. . Planning staff checks and signs the mylars. 4. Applicant Records Plat at Lane County & Submits Plat and Documents to City • After Planning staff checks and signs the mylars, the plat may then be recorded by the applicant's surveyor at Lane County. • After plat has been recorded at Lane County, applicant submits five (5) recorded, rolled paper copies of the plat and three (3) copies of required documents to the Development & Public Works Department prior to the issuance of building permits. (& Minor Variance Case No. 811-21 -000079-TYP2) www The purpose of this letter is to address how Tentative Subdivision and associated Minor Variance conditions of approval have been satisfied with respect to the final plat of ROSIE SPRINGS subdivision. Said conditions of approval were set forth in the "TYPE II TENTATIVE SUBDIVISION REVIEW, STAFF REPORT & DECISION' for Planning Case Number 811-21-000078-TYP2 and the "TYPE II MINOR VARIANCE STAFF REPORT & DECISION' for Planning Case Number 811-21-000079-TYP2. The conditions of approval are cited in bold italic text, with responses 1 findings shown in regular text. CONDITIONS OF APPROVAL FOR TENTATIVE SUBDIVISION 811-21-000078-TYP2: 1. Prior to Final Plat approval, the applicant must either adjust the proposed subdivision to meet minimum requirements or obtain City approval (including any conditions of approval) for a minor variance application for Lot 1's street frontage as per SDC 3.2-215. The applicant obtained City approval of a Type II Minor Variance application for reduction of the Lot 1 street frontage (see Planning Case Number 811-21-000079-TYP2). Refer to the statement below addressing Tentative Subdivision Condition of Approval #14 for information regarding compliance with the sole condition of approval for said Minor Variance. 2. Prior to Final Plat approval, the applicant must obtain the proper permits and install the shared panhandle driveway for Lots 2-5. The applicant has obtained the proper permits, and installation of the shared panhandle driveway for Lots 2-5 and associated improvements is nearly complete. Paving and associated stormwater management facilities have been completed, and the concrete driveway apron and "No Parking — Fire Lane" signs are anticipated to be completed in late November, prior to final plat approval. 3. Prior to Final Plat approval, the applicant must provide a note for each new sewer connection to the existing sewer mains that an encroachment permit is required for this connection as per SDC 4.3-105 and SDC 5.12-125 on both the revised Tentative Subdivision Plan and for the building permit process. The required notes regarding encroachment permits for each new connection to the existing sewer mains have been provided on a revised copy of the Tentative Subdivision Plan as required, copies of which are included with this submittal. Said notes were also placed on the approved construction plans that were submitted as part of the building permit process for the required subdivision improvements. Page 1 of 3 4. In accordance with SDC 5.12-125.C, the applicant must construct the sanitary sewer connections and laterals prior to Final Plat approval and recording. The applicant has obtained the necessary permits, and construction of the required sanitary sewer connections and laterals has been completed in accordance with SDC 5.12-125.C. 5. Prior to Final Plat approval, the applicant shall provide an Operations and Maintenance plan to the City for review to ensure the long-term maintenance and operation of the proposed stormwater planters, consistent with maintenance criteria required by EDSPM 3.03.1. The plan should designate maintenance responsibility for operating and maintaining the system and should be distributed to all property owners and tenants of the site. An Operations and Maintenance plan regarding the long-term maintenance and operation of the stormwater planters is included with this submittal, as well as a draft copy of the associated Notice of Operations and Maintenance Agreement to be recorded concurrently with the final plat. 6. Prior to Final Plat approval, the applicant shall submit a suitable vegetation plan for the proposed stormwater planters and any overflow system. The City of Eugene stormwater management manual and Chapter 6 of the EDSPM may be referenced for design. The required vegetation plan for the stormwater planters is contained in the Stormwater Analysis Report that was submitted to the City as part of the building permit process for construction of the subdivision improvements. The same vegetation plan is appended to the associated Operations and Maintenance Plan (see Condition of Approval #5 above), copies of which are included with this submittal. 7. To ensure a fully functioning water quality system and meet objectives of Springfield's MS4 permit, the Springfield Development Code and the EDSPM, the proposed stormwater planters shall be fully vegetated with all vegetation species established prior to approval of the Final Plat. Alternatively, if this condition cannot be met, the applicant shall provide and maintain additional interim erosion control/water quality measures acceptable to the Public Works Department that will suffice until such time as the vegetation becomes fully established. The stormwater planters have been constructed, and associated vegetation is planned to be planted in mid-November. 6. Prior to Final Plat approval, the applicant must provide a note on the subdivision plan for each new connection to the existing stormwater main that an encroachment permit is required for this connection in accordance with SDC 5.12-125.0 on both the revised Tentative Subdivision Plan and for the building permit process. The required notes regarding encroachment permits for each new connection to the existing sewer mains have been provided on a revised copy of the Tentative Subdivision Plan as required, copies of which are included with this submittal. Said notes were also placed on the approved construction plans that were submitted as part of the building permit process for the required subdivision improvements. 9. Prior to Final Plat approval, the applicant shall verify with SUB Water that the proposed new sire hydrant will provide the minimum required fire flow of 1,000 gallons per minute at a residual pressure of 20 psi. The applicant's consultant has verified with SUB Water that the newly constructed fire hydrant was flow tested at 1,900 gallons per minute, with a static pressure of 79.5 psi and residual pressure of 59.1 psi. The shared access driveway, which also serves as fire apparatus road access, must be fully paved and able to support an 80,000 lb. load to meet Fire Code requirements prior to Final Plat approval. The paving structure for the shared access driveway / fire apparatus access road was constructed to support a minimum 80,000 Ib. load as required (4" asphalt over 4" of minus crushed rock over 8" of 1- 1/2" crushed rock base). 11. Planted setbacks and vegetation required by this code shall be in place prior to Final Occupancy of individual residences in accordance with SDC 3.2-215 and 4.4-105. The applicant acknowledges that the above requirements will need to be met prior to Final Occupancy of each future dwelling constructed within the subdivision. 12. Prior to issuance of any Building Permits for lots within the subdivision area, the applicant shall demonstrate compliance with the height limit of SDC 3.2-215 and the solar setback requirements of SDC 3.2.225. The applicant acknowledges that compliance with the above requirements will need to be demonstrated during the building permit process for each future dwelling constructed within the subdivision. 13. The applicant has already removed 5 qualifying trees from the subject site, which did not require a Tree Felling Permit. However, if the applicant plans to remove more trees within 12 months of the other tree removal, the applicant must submit an application for a Tree Felling Permit in accordance with SDC 5.19.110.A. A Tree Felling Permit and Land Drainage & Alteration Permit (LDAP) application can be submitted concurrently. In addition to the original 5 qualifying trees that were removed from the site, only 1 additional tree was proposed to be removed within the same 12 -month period, more specifically an 8" dbh deciduous tree near the west end of the shared panhandle driveway. This tree was subsequently removed by SUB Electric pursuant to the provisions at SDC 5.19-110. B.2, therefore a tree felling permit was not required. 14. Requests for second or overwidth driveways on Lots 2-5 within the subdivision area shall demonstrate to the satisfaction of the City that there are no conflicts with streetlights, street trees, and utility infrastructure in accordance with SDC 4.2-120 and 4.2-130. Driveway width on Lot 1 shall be limited to 18 feet maximum in accordance with concurrent Minor Variance #811- 21-000079 TYP2. No overwidth driveways for Lots 2-5 are proposed. The sole condition of approval for Minor Variance #811-21-000079-TYP2 reads as follows: 1. Prior to final plat approval, the applicant must limit the driveway access to the width shown on the Tentative Subdivision Plan for Lot 1 and any overwidth driveway designs are prohibited. This limitation should be noted on the Final Plat and/or in a separate deed restriction. This Operation and Maintenance Plan can serve as a checklist for what should be included in the log (e.g. the facility elements that need to be inspected, frequency of inspection, conditions that indicate maintenance is needed, etc.) This plan includes the information on the following facilities for: • Filtration Vegetated Planter STORMWATER MANAGEMENT FACILITY INSPECTION & MAINTENANCE LOG Vegetated Planter Operation and Maintenance Plan Vegetated Planters are vegetated surface reservoirs used to collect and treat stormwater runoff from impervious surfaces by allowing the pollutants to settle and filter out as the water percolates through vegetation and soil mediums before filtrating into the ground below or being piped to its downstream destination. Vegetated Planters can be used to help fulfill a site's required landscaping area requirement and should be integrated into the overall site design. Numerous design variations of shape and planting scheme can be used to fit the character of a site. The reservoir basin shall filtrate stormwater within 24 hours. All facility components and vegetation shall be inspected for proper operations and structural stability, at a minimum, quarterly for the first 2 years from the date of installation, 2 times per year thereafter, and within 48 hours after each major storm event. Training and/or Written Guidance information for operating and maintaining vegetated filtration basins shall be provided to all property owners and tenants. A copy of the O & M Plan shall be provided to all property owners and tenants. Inspection Logs shall be kept by the facility owner demonstrating the following items have been inspected and are being maintained properly: • Access to Rain Gardens shall be safe and efficient. Obstacles preventing maintenance personnel and/or equipment access to the components of the facility shall be removed. • Debris and Litter shall be removed to prevent channelization, clogging, and interference with plant growth. Fallen leaves and debris from deciduous plant foliage shall be raked and removed. • Erosion Damage shall be identified and controlled when native soil is exposed or erosion channels are forming. • Grassed Vegetated Planters shall be mowed to 4°-9" high and grass clippings shall be removed no less than 2 times per year. • Filtrating Vegetated Planters shall be excavated and cleaned, and gravel or soil shall be replaced to correct low filtration rates. • Inlets shall be cleared when conveyance capacity is plugged to ensure unrestricted stormwater flow to the Vegetated Planter. • Mulch shall be replenished as needed to ensure healthy plant growth. • Nuisance and Prohibited Vegetation from the Springfield Plant List (such as blackberries and English Ivy) shall be removed STORMWATER MANAGEMENT FACILITY INSPECTION & MAINTENANCE LOG when discovered. Invasive vegetation contributing up to 25% of vegetation of all species shall be removed and replaced. • Outlets shall be cleared when 50% of the conveyance capacity is plugged. • Overflows shall be cleared when 25% of the conveyance capacity is plugged. • Rocks or Other Armoring shall be replaced when only one layer of rock exists above native soil. • Sedimentation build-up near or exceeding 2" in depth shall be hand - removed with minimum damage to vegetation using proper erosion control measures. Sediment shall be removed if it is more than 4 inches thick or so thick as to damage or kill vegetation. • Slopes shall be stabilized using appropriate measures when native soil is exposed. • Vegetation shall be healthy and dense enough to provide filtering while protecting underlying soils from erosion.
