Applicant Submits a Land Division Plat Application for Pre -Submittal • The application must conform to the Land Division Plat Pre -Submittal Requirements Checklist on pages 4-6 of this application packet. • A pre -submittal meeting to discuss completeness is mandatory, and pre -submittal meetings are conducted every Tuesday and Friday, from 10:00 am - noon. • Planning Division staff strives to conduct pre -submittal meetings within five to seven working days of receiving an application. 2. Applicant and the City Conduct the Pre -Submittal Meeting • The applicant, owner, and design team are strongly encouraged to attend the pre - submittal meeting. • The meeting is held with representatives from Public Works Engineering and Transportation, Community Services (Building), Fire Marshall's office, and the Planning Division and is scheduled for 30 to 60 minutes. • The Planner provides the applicant with a Pre -Submittal Checklist specifying the items required to make the application complete if it is not already complete, and the applicant has 180 days submit a complete application to the City. pplicant Submits a Complete Land Division Plat Application When the applicant has addressed all items on the Pre -Submittal Checklist and the City Surveying Section has notified the applicant's surveyor that the plat and other documents are sufficiently refined, the applicant can submit a complete application to the City Survey Section located in the NW Quad of City Hall. • The application must conform to the Land Division Plat Submittal Requirements ' Checklist on page 6 of this application packet. • If the submittal is deemed complete, the City Survey Section will sign -off on the City Survey approval sheet and send the applicant to the Development & Public Works Department for application submittal and fee collection. Planning staff checks and signs the mylars. 4. Applicant Records Plat at Lane County & Submits Plat and Documents to City • After Planning staff checks and signs the mylars, the plat may then be recorded by the applicant's surveyor at Lane County. • After plat has been recorded at Lane County, applicant submits five (5) recorded, rolled paper copies of the plat and three (3) copies of required documents to the Development & Public Works Department prior to the issuance of building permits. Revised 10.14.13 kl 3 of 6 LAND DIVISION PLAT APPLICATION PROCESS Applicant submits land division plat application for pre -submittal (See [and Division Plat Pre -Submittal Requirements Checklist) City departments review application for completeness and hold pre -submittal meeting to discuss completeness issues with applicant and applicant's representatives. Applicant addresses incomplete items. City Surveyor checks application and returns comments to applicant's surveyor. Applicant's surveyor corrects plat City Surveyor conducts field check and and returns to City Surveyor. returns comments to applicant's surveyor Applicant's surveyor sets new monuments and flags existing ones. Once no errors appear on the plat and a current title report is submitted, applicant's surveyor is given ok to submit complete land division plat application. After ok given from City Surveyor and applicant has addressed all incomplete items from pre -submittal, applicant submits complete application to the City Survey Section (See Land Division Plat Submittal Reoulrements Checklist) City Survey Section signs -off on City Survey approval sheet and sends the applicant to the Development & Public Works Department for application submittal and fee collection. Planning staff checks and signs mylars and notifies applicant's surveyor of approval. Applicant takes plat and accompanying documents to Lane County for recording. C) For purposes of this Easement, the term "Hazardous Materials" means any substance which is (i) designated, defined, classified or regulated as a bazurdous substance, hazardous material, hazardous waste, pollutant or contaminant under any Environmental Law, as currently in effect or as hereafter amended or enacted, (ii) a petroleum hydrocarbon, including crude oil or any finetion thereof and all petroleum products, (iii) PCBs, (iv) lead, (v) asbestos, (vi) flammable explosives, (vii) infectious materials, or (viii) radioactive materials. "Environmental Law(s)" means the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, 42 U.S.C. Sections 9601, at seq., the Resource Conservation and Recovery Act of 1976, 42 U.S.C. Sections 6901, at seq., the Toxic Substances Control Act, 15 U.S.C. Sections 2601, el seq., the Hazardous Materials Transportation Act, 49 U.S.C. 5101, et seq., and the Clean Water Act, 33 U.S.C. Sections 1251, et seq., as said laws have been supplemented or amended to date, the regulations promulgated pursuant to said laws and any other federal, state or local law, statute, rule, regulation or ordinance which regulates or proscribes the use, storage, disposal, presence, clean-up, transportation or release or threatened release into the environment of Hazardous Materials. 7. Insurance. At all times, GSA IV, at its sole expense, shall obtain and keep in force insurance which may be required by any federal, state or local statute or ordinance of any governmental body having jurisdiction in connection with the operation of GSA IV's business upon the Easement Area. 8. Security of GSA IV's Communications Facilities. GSA IV may construct a chain link or comparable fence around the perimeter of GSA IV's communications facilities. 9. Removal of Obstructions. GSA IV has the right to remove obstructions, including but not limited to vegetation, which may encroach upon, interfere with or present a hazard to GSA IV's use of the Easement Area. GSA IV shall be responsible for disposing of any materials related to the removal of obstructions. 10. Assignment of Lease Agreement. The parties hereby acknowledge that certain PCS Site Agreement dated June 3, -1997 by and between STC Five LLC, as successor lessee to Sprint Spectrum L.P., a Delaware limited partnership, and Grantor, as successor lessor to ECI Cemetery Services Oregon ("Original Agreement'), a memorandum of which was recorded on January 22, 1998.at Instrument No. 9804070 in the Official Records, as amended bythe following: (i) that certain Amendment to PCS Site Agreement dated July 23, 2001, a memorandum of which was recorded on November 2, 2001 at Instrument No. 2001-073452 in the Official Records; and (ii) that certain Second Amendment to PCS Site Agreement dated November 11, 2009, a memorandum of which was recorded on May 28, 2010 at Instrument No. 2010-025286 in the Official Records (hereinafter the Original Lease and subsequent amendments are collectively referred to as the `Lease Agreement"). Grantor hereby assigns to GSA IV all of Grantor's right, Site Name: East Springfield 4 HUN: 979566 title and interest in the Lease Agreement, including but not Iunited to, the right to amend the Lease Agreement (i) to extend the term length; (ii) to increase the size of the leased premises within the Easement Area; and/or (iii) in any other manner deemed necessary by GSA IV. 11. Real Estate Taxes. Grantor shall pay all real estate taxes on Grantor's Property; provided GSA IV agrees to reimburse Grantor for any documented increase in real estate taxes levied against Grantors Property that are directly attributableto the presence of wireless communications facilities within the Easement Area. Grantor agrees to provide GSA IV any documentation evidencing the increase and how such increase is attributable to GSA IV's use. GSA IV reserves the right to challenge any such assessment, and Grantor agrees to cooperate with GSA IV in connection with any such challenge. In the event that Grantor fails to pay all real estate taxes on Grantor's Property prior to such taxes becoming delinquent, GSA IV may, at its option, pay such real estate taxes (the "Delinquent Taxes'') and GSA IV shall have the right to collect the Delinquent Taxes from Grantor together with interest on the Delinquent Taxes at the rale of 12% per annum (calculated from the date GSA IV pays the Delinquent Taxes until Grantor repays such sums due to GSA IV) and shall have a lien against Grantor's Property with respect thereto. 12. Waiver of Subroeation. The parties hereby waive any and all rights of action for negligence against the other which may hereafter arise on account of damage to the Easement Area or any other portion of Grantor's Property, including improvements and personal property located thereon, resulting from any fire or other casualty of the kind covered by property insurance policies with extended coverage regardless of whether or not, or in what amount, such insurance is now or hereafter carried by the parties. 13. Enforcement. In the event Grantor fails to cure any violation of the terms of this Easement within ten (10) days after written notice from GSA IV, GSA IV shall have the right to injunctive relief, to require specific performance of this Easement, to collect damages from Grantor, and to take such actions as may be necessary in GSA IV's discretion to cure such violation and charge Grantor with all reasonable costs and expenses incurred by GSA IV as a result of such violation (including, without limitation, GSA IV's reasonable attorneys' fees). All rights and remedies provided under this Easement are cumulative and may be pursued singularly, in any combination, and in any order. The failure to enforce any of the terms and provisions contained herein shall in no event be deemed to be a waiver of the rightto thereafter strictly enforce the terms and provisions hereof. IJ. Limitation on Damaves. In no event shall GSA IV be liable to Grantor for consequential, indirect, speculative or punitive damages in connection with or arising from this Easement, the Permitted Use or the Easement Area. 15. Recording. Grantor acknowledges that GSA IV intends to record this Easement with the appropriate recording officer upon execution of this Easement. 16. Hold Harmless. Grantor hereby indemnifies, holds harmless, and agrees to defend GSA 1V against all damages asserted against or incurred by GSA 1V by reason of, or resulting from: (i) the breach by Grantor of, any representation, warranty, or covenant of Grantor contained Sire Name: East Springfield 5 BUN: 879566 herein or (ii) any negligent act or omission of Grantor, excepting however such damages as may be due to or caused by the acts of GSA IV or its agents. GSA IV hereby indemnifies, holds harmless, and agrees to defend Grantor against all damages asserted against or incurred by Grantor by reason of, or resulting from: (i) the breach by GSA IV of any representation, warranty, or covenant of GSA IV contained herein or (ii) any negligent act or omission of GSA IV, excepting however such damages as may be due to or caused by the acts of Grantor or its agents. 17. Grantor's Covenant of Title. Grantor covenants: (a) Grantor is seized of fee simple title to the Grantor's Property of which the Easement Area is a pan and has the right and authority to grant this Easement; (b) that this Easement is and shall be free and clear of all liens, claims, encumbrances and rights of third parties of any kind whatsoever; (c) subject to the terms and conditions of this Easement, GSA IV shall have quiet possession, use and enjoyment of the Easement Area; (d) there are no aspects of title that might interfere with or be adverse to GSA IV's interests in and intended use of the Easement Area; and (e) that Grantor shall execute such further assurances thereof as may be required. 18. Non -Interference. From and after the date hereof and continuing until this Easement is terminated (if ever), GSA IV and its lessees, licensees and/or sub -easement holders shall have the exclusive right to construct, install and operate communications facilities that emit radio frequencies on Grantor's Property. Grantor shall not permit (i) the construction, installation or operation of any communications facilities that emit radio frequencies on Grantor's Property other than communications facilities constructed, installed and/or operated on the Easement Area pursuant to this Easement or the Lease Agreement or (ii) any condition on Grantor's Property which interferes with GSA IV's Permitted Use. Each of the covenants made by Grantor in this Section is a covenant running with the land for the benefit of the Easement Area and shall be binding upon Grantor and each successive owner of any portion of Grantor's Property and upon each person having any interest therein derived through any owner thereof. 19. Eminent Domain. If the whole or any part of the Easement Area shall betaken by right of eminent domain or any similar authority of law, the entire award for the value of the Easement Area and improvements so taken shall belong to GSA IV. 20. Grantor's Property. Grantor shall not do or permit anything that will interfere with or negate any special use permit or approval pertaining to the Easement Area or cause any communications facilities on the Easement Area to be in nonconformance with applicable local, state, or federal laws. Grantor covenants and agrees that it shall not subdivide the Grantor s Property if any such subdivision will adversely affect the Easement Area's compliance (including any improvements located thereon) with applicable laws, rules, ordinances and/or zoning, or otherwise adversely affects GSA IV's ability to utilize Grantor's Property for its intended purposes. Grantor shall not initiate or consent to any change in the zoning of Grantor's Property or any property of Grantor contiguous to, surrounding, or in the vicinity of Grantor's Property, or impose or consent to any other restriction that would prevent or limit GSA IV from using the Easement Area for the uses intended by GSA IV. Upon the filing of the map or plat and of the declaration for record, the dedication is complete for all purposes, and thereafter the Property shall be held, occupied and used exc usively for cemetery purposes. 97.340 Effect of dedication. After prop- erty is dedicated to cemetery purposes pur- suant to ORS 97.310 to 97.330 and 97.360 (1), neither the dedication nor the title of a plot owner shall be affected by the dissolution of the cemetery authority by nonuser on its part, by alienation of the property, by any encumbrances, by sale under execution or to 97.350, 97.360 (2), 97.440, 97.510 to 97.650, 97.710, 97.720 and 97.810 to 97.865. 97.330 Dedication to cemetery pur. poses not invalid. Dedication to cemetery MoMoes pursuant to ORS 97.010 to 97.040, purp o to 97.450, 97.510 to 97.730, 97.810 to 97.920 and 97.990 is not invalid as violating any laws against perpetuities or the suspen- sion of the power of alienation of title to or use of property, and is deemed to be in re- spect for the dead, and is a provision for the interment of human remains and is a duty to, and for the benefit of, the general public. 97.360 Resurvey and alteration in shape or size; vacation of streets, walks, driveways and parka and replotting into lots. (1) Any part or subdivision of the prop- erty so mapped and an may, by order of the directors and consent of the lot owners, be resurveyed and altered in shape and size and an amended map or plat filed, eo long as each change does not disturb any interred remains. (2) Whenever a majority of the lots as Flatted or laid out in any cemetery estab- lished before March 3, 1927, or any part thereof, has been sold without the owners or persons in control of the cemetery having made provision far the establishment of an adequate endowment fund for the perpetual inteaance, upkeep and beautification of the cemetery and of the lots therein, the av- enues, streets, alleys, walls, driveways and parks therein may be vacated or altered and replotted into Iota which may be sold for burial purposes in the manner provided in this subsection and in ORS 97.370 to 97.430. Application for the vacation or alteration of any avenues, streets, alleys, walks, driveways or parks, and for the replotting of the same, or any portion thereof, for cemetery lots in any such cemetery shall be made to the county court or bawd of county commission- ers in the county where the cemetery is sit- uated. The application may be by the owners or persons in control of the cemetery or by a group of 20 or more persons owning lots or having relatives buried therein. The ap- plication shall be verified and shall sped fy the lots owned by each petitioner in which are buried bodies of relatives in which the petitioner is interested and shall state the reason for the proposed change and what provisions have theretofore been made for the perpetual upkeep, maintenance and beautification of the cemetery, and there shall be presented therewith a plat of the cemetery, together with the proposed replat, which shall have clearly indicated thereon the proposed changes. 97.370 Fixing date of hearing, notice. When any application mentioned in ORS 97.360 (2) is Sled, the court or board shall fix the time for the hearing of it and notice of the time thereof shall be given by publication in a paper of general circulation published in the town in which the cemetery is situated or in the town to which it is nearest once a weak for a period of six successive weeks prior to the date of the heating and a copy of such notice shall be posted for a like pe- riod at three public and mnspicuous places in the cemetery. Such notice shall be ad- dressed to all persons owning lots or having an interest in the cemetery, but need not name them, and shall set forth in a general way the proposed changes, the reason stated in the application for making it, the time when the hearing of the application will be had, and shall state that a plat showing the proposed changes is on file with the county clerk o£ the county in which the cemetery is situated. 97.390 Hearing order allowing replotting. At the rearing mentioned m ORS 97.370 the court or board shall consider and heaz any evidence introduced in favor of the proposed change and all objections thereto and, after a full hearing thereon, may allow the proposed change and replat in whole or in part, If the proposed change is allowed, either in whole or in part, an order allowing it ahall be made provldmg that title to any new lot created by the alteration or vacation of any avenues, streets, alleys, driveways, walka or parks, or any part thereof, shall be vested in the owner of the fee of the part of the cemetery sought to be vacated in trust for burial purposes, or vested in any association which may be firmed for the purpose of taking over the cemetery and operating and maintaining it in accordance with the provisions of ORS 97.400. [[l—uded by 1985 c582 §4; 1999 c.381 §21 97.390 Assessment of benefits and damages. If any damages are claimed by the owner of any lot in any such cemetery as is mentioned in ORS 97.360 (2), which lot is Title 10 Page 13 (2017 Edition) 97.400 PROPERTY RIGHTS AND TRANSACTIONS adjacent to the avenues, streets, alleys, driveways or parks vacated as provided in ORS 97.380, they shall be ascertained by the county court or board of county commission- ers and offset against the benefits accruing to the lot owner on account of the upkeep and beautification of the cemetery in the manner provided in ORS 97.400. Any person feeling aggrieved at the amount of damages so assessed by the board may appeal from such order of allowance to the circuit court of the county in which the cemetery is Situ- ated in the same manner as is provided by statute for appeal from the assessment of damages by the exercise of eminent domain in locating a county road and on such appeal the jury, in assessing the amount of damages to be allowed to the appellant, shall offset against such damages the benefits accruing to the appellant as in this section above pro- vided. 97.400 Disposal of newly created lots; di tion and use of proceeds from sale; failure of owner to perform duties. Any owner or association accepting the trust of handling and disposing of lots newly created pursuant to ORS 97.380 shall by the accept- ance thereof agree to dispose of the lots only for burial purposes and at a price not leas than that fixed by the county court or board of county commissioners. The net funds de- rived from the sale of the lots remaining af- ter the payment of the reasonable expenses incident to the vacation and of the sale shall be placed in an irreducible and perpetual fund and the interest therefrom shall be used for the perpetual upkeep and beautification of the cemetery and the lots therein situated. The fund shall be placed in some reliable trust company specified by the court or board, which trust company shall invest the same and pay the income therefrom to the owner or association charged with the dis- posal of such lots. Any owner or association taking over the sale of the lots shall comply with such provisions as the court or board may require of it in the upkeep, beautifi- cation and care of the cemetery with the in- come thereof, and if such owner or association for any reason fails to perform such duties, the court or board may, on its own motion, from time to time, appoint some other association or individual to perform them. The restrictions of this section shall not apply to the sale of lots obtained by replatting cemeteries owned and maintained by any county. 97.410 Right of adjacent lot owner upon vacation of way. The vacation of an avenue, street, alley, driveway, walk or park adjacent to a cemetery lot shall vest in the owner of such lot no interest in the vacated portion thereof; but the adjacent owner shall, for 30 days after the date of such an order of vacation, have the right to purchase any new lot adjacent to the lot of the owner at tfixed he price by the court or board at which the lots are to be sold, and if there is more than one adjacent lot owner, the new lot shall be sold to the one offering the highest price therefor. 97.420 Effect of failure to object. Any owner of such cemetery as is mentioned in ORS 97.360 (2), or of any lot therein, or any relative or heir of any deceased person buried in such cemetery who fails to appear and file written objection to any proposed replat, alteration or vacation, authorized by ORS 97.360 (2), shall be deemed to have con- sented to the proposed change and shall be forever barred from claiming any right to use Said have open for traffic or passageway any streets, alleys, driveways or parks vacated, or any right, title or interest therein, except as provided in ORS 97.360 (2) and 97.370 to 97.410. 97.430 Declaration of exercise of police power and right of eminent domain. The enactment of ORS 97.360 (2) and 97.370 to 97.430 is hereby declared to be a necessary exercise of the police powers of the state in order to preserve and keep existing ceme- teries as resting places, for the dead and to preserve old and historic cemeteries from becoming unkempt and places of reproach and desolation in the communities in which they are located. The taking of avenues, streets, alleys, walks, driveways and parks for the purpose and by the method specified in ORS 97.360 (2) and 97.370 to 97.420 is hereby declared an exercise of the right of eminent domain in behalf of the Public health, safety, comfort, pleasure and historic instruction. 97A40 Removal of dedication. (1) Pro arty dedicated to cemetery purposes shall be held and used exclusively for cemetery Pur- r, until the dedication is removed from r any, part of it by an order and decree of the county court or board of county com- missioners of the county in which the prop- erty is situated in a proceeding brought by the cemetery authority for that purpose and upon notice of hearing and proof satisfactory to the court that: (a) The portion of the property from which dedication is sought to be removed is not being used for interment of human re- mains; or (b) The Oregon Commission on Historic Cemeteries has received notice of and had the opportunity to comment on the removal from the dedicated property of all human re- mains and markers dated prior to February 14, 1909. Title 10 Page 14 (2017 Edition) CEMETERIES, HUMAN BODIES AND ANATOMICAL GIFTS 97.510 (2) The notice of hearing required by this section must: (a) Be given by publication once a week for at least four consecutive weeks in a newspaper of general circulation in the county where the cemetery is located and by publication twice in a newspaper with state- wide circulation; (b) Be posted in three conspicuous places on that portion of the property from which the dedication is to be removed; (c) Describe the portion of the cemetery property sought to be removed from dedi- cation; (d) State that all remains and markers have been removed or that no interments have been made in the portion of the ceme- tery property sought to be removed from dedication; and (e) Specify the time and place of the hearing. Leaded by zoos c.237 §11 97.445 Vacating county interest in cemetery real property. Consistent with the provisions of OR 368.326 to 368.366, a county may vacate any real preperty inter- ests the county may own in a cemetery. Consistent with ORS 368.366 (2), the county may vacate its real property interests in fa- vor of a private nonprofit organization pro- vided the organization states its intent to provide for the continuing maintenance and care of the cemetery and associated facilities. [1991 e747 §21 97.450 Discontinuance of cemetery and removal of remains and markers. (1)(a) Whenever any cemetery that is within the limits of any county, city or town has been abandoned, or it is desirable to abandon such cemetery, the governing body of any county, if the cemetery is owned by the county, or the corporate authorities of the city or town, if the cemetery is awned by the city or town, or the trustees or directors, if the cemetery is owned by an association or car it may order that such burial ground be dis- continued, have the remains of all persons interred in the cemetery moved to some other suitable place and provide for the re- moval and merectien of all stones and mon- =tuments marking said graves. Each removal he made in an appropriate manner and in accordance with the directions of the Di- rector of the Oregon Health Authority. Prior to any removal authorized under this section, written notice must be given to the family, or next of kin of the deceased, if known, and if unknown, notice of the removal shall be published for at least four successive weeks in a newspaper of general circulation in the county in which the cemetery is located and twice m a newspaper with statewide circu- lation. (b) Any removal and the costs of the proceedings under this section shall be at the ejense of the county, city or town, individ- ual, corporation or association owning the cemetery to be moved. (2) Notwithstanding subsection (1)(a) of this section, a cemetery or burial ground containing human remains that were inter- red before February 14, 1909, may not be discontinued or declared abandoned or have remains removed from the burial ground or cemetery without prior notice to and com- ment by the Oregon Commission on Historic Cemeteries. When commenting on a request to discontinue or declare abandoned a ceme- tery or burial ground, the commission shall consider: (a) The listing of the cemetery or burial ground under ORS 97.782; (b) The historic significance of the ceme- tery or graves included in the request; and (c) The findings of any archaeological =7 of the cemeteryry or burial ground. (1) A person may not lay out, open up or use any property for cemetery or burial park purposes unless the person: (a) Is the owner of the property; (b) Has the written consent of the plan- ning commission of the county or city having jurisdiction under ORS 92.042 or, if there is no such commission in such county or city, the governing body of such county or city; (c) Agrees to maintain records of the disposition of human remains on the property as required by the planning commission or governing body of the county or city having jurisdiction under ORS 92.042; and (d) Agrees to disclose the disposition of human remains upon sale of the property. Failure to disclose the disposition of human remains does not invalidate the sale of the property. (2) A planning commission of a county or city or, if there is no planning commission in a county or city, the governing body of the county or city, shall provide to the State Mortuary and Cemetery Board a list of the requirements for laying out, opening up or using property in the county or city for cemetery or burial park purposes.
