Springfield, OP.97477 Subject: Land Use Compatibility Statement for an industrial use located at 195 39'h St., Map and Tax Lot number 17-02-31-41-01300 Dear Mr. Moore, This letter is sent in response to your request regarding whether existing development on the above-referenced property complies with current zoning and use regulations. The Mid-Springfield Refinement Plan designates the site as Medium Density Residential (MDR), but the zoning classification is Light Medium Industrial (LMI). The Mid-Springfield Refinement Plan Implementation Policies include provisions for the continued use of Industrial zoning on properties designated Residential. 3. Allow for the continued industrial uses of developed industrial properties in areas designated. . . Residential on the Plan Diagram, by maintaining the Light Medium Industrial zoning classification where: a) existing zoning is Industrial; and b) there has been a substantial investment made in industrial improvements to the property (i.e., the true cash value of industrial buildings on the site must exceed the true cash value of the Iand itself). 4. Application of the Light Medium Industrial zoning, in accordance with policy #3 of this section, shall not be considered aplan/zone conflict. Based on the information you have provided, the transfer of ownership of the above referenced property would not result in a change of the applicable zoning classification or the termination of any applicable zoning classification for the property. All subsequent uses under the new owner must comply rvith the provisions of tlie LMI Zoning District. Further, if the improvements on the property are damaged or destroyed the repair or replacement of the improvements will not violate applicable zoning classification, assuming there has been no change in such zoning subsequent to the date of this letter. In summary, the industrial use on this property is in conformance with the applicable zoning classification. I hope this information will meet your needs.
