ACTION MOTION: ADOPT/NOT ADOPT A RESOLUTION AMENDING MASTER FEES REQUESTED: AND CHARGES SCHEDULE CHAPTERS 6 WITH AN EFFECTIVE DATE OF OCTOBER 19, 2021 ISSUE Each year, Council and staff review existing fees and charges for appropriateness of STATEMENT: rates for meeting cost recovery targets. Staff has prepared the update to the fees and charges schedule for 2021 with a 1.6% CPI applied to most fees. ATTACHMENTS: 1. Chapter 6: Building and Safety Fees Red Lined 2. Resolution Amending Master Fees and Charges Schedule 3. Chapter 6: Building and Safety Fees Final Staff completed the FY21 update of the Master Fees and Charges (MF&C) schedule DISCUSSION/ in April 2021 and brought a redlined version for review and feedback in work FINANCIAL session on May 3, 2021 and final adoption on May 17th. IMPACT: At that time, Chapter 6: Building and Safety Fees was not ready for adoption. The State of Oregon Building Department requires posting of the proposed fees 45 days before the adoptive date of the fee changes and staff were not within that time frame in May. Chapter 6 of the 2021 MF&C schedule with redlines is included as Attachment 1 and a final draft without redlines as Attachment 3. The final version of Chapter 6 of the MF&C schedule (Attachments 3) includes the following additions beyond the 1.6% CPT: The City moved to the Oregon Standard Model in 2015 and revenue from mechanical fees fell dramatically. These changes increase individual fee items while keeping the Minimal Fee amount the same so that fees would fall closer to their 2015 levels. For example, a single-family dwelling would increase from $180 to $250. Two complete sets of plans, engineering calculations, diagrams and other data shall be submitted with each application for a permit. The building official may require plans, computations and specifications to be prepared and designed by an engineer or architect. Attachment 1, Page 6 of 8 Section 6: Building and Safety Fees (a) A scaled plot plan with building dimensions, setback and location of proposed signs shall be submitted with the sign permit application. A photograph of each facade of the building shall be submitted. (b) A scaled elevation drawing shall be submitted in addition to the above requirements if a wall mounted sign will be erected. (c) A description of materials, anchors, footings and attachment systems shall be provided. (d) For all freestanding, pole or projecting signs over 20 feet in height, plans shall be submitted, drawn by a registered engineer. (e) Each application shall include photographs of existing signage on the property associated with the business. (f) If the application is for a billboard, the application must include an approved permit from the state of Oregon under the Oregon Motorists Information Act of 1971 (ORS 377.700 et seq.) prior to the erection of the billboard. Temporary Sign Permit Fee (SMC 8.218 (3)) Temporary Sign Permit Fees. Four permits for each approved development area shall be permitted per calendar year. The fee for each permit shall be set by resolution by the Council. No temporary sign(s) shall be larger than 60 square feet and be erected for a maximum of 30 consecutive days per each permit. The temporary sign(s) shall be located completely on private property and shall be in compliance with the required setbacks as identified in Springfield Municipal Code. A security deposit is required when this permit is issued. If the applicant fails to remove the temporary sign(s) by the date specified on the permit, the deposit shall be forfeited and the City may remove the temporary sign(s). If any temporary signs are erected without first obtaining a permit, the permit fee shall be doubled. Temporary signs erected by or for the City for City -sponsored events, authorized by the City, or for the park district, utility company, or hospital for community events are exempt. Sign Code Modification Fee (SMC 8.238(2)) A modification is defined as a request for a sign that complies with the provisions of this sign code in all respects except size or height and the proposed request is not more than 15 percent greater than Attachment 1, Page 7 of 8 -Sec -tion -6:- Building and Safety Fees otherwise allowed. If the applicant chooses to apply for a modification to the sign code, they may apply through the development services department for a cost set by resolution of the council. This modification request will be reviewed, and a decision reached by the Development and Public Works Director within 30 days of the application, providing the application is complete. The following criteria must be met in order for a modification to be approved: (a) Locational and/or dimensional problems have been identified; and (b) The proposed adjustment will not cause any of the following adverse effects on neighboring properties: (i) Creates a vision clearance hazard for pedestrians, motor vehicles or bicyclists; or (ii) Creates a hazard for fire prevention or fire suppression; or (iii)Public safety is compromised; and (c) The hardship is not self-imposed. Sign Code Appeal Fee (Building Board of Appeals) (SMC 8.238(5)) An applicant who is denied a modification request may appeal the decision of the Development and Public Works Department to the Building Board of Appeals for a cost set by resolution of the Council. The request will be reviewed by the Board and a decision reached within 30 days of the application date. A RESOLUTION AMENDING THE SPRINGFIELD MASTER FEES AND CHARGES SCHEDULE TO ADJUST BUILDING AND SAFETY FEES WHEREAS, the City is authorized pursuant to Section 4 of the 2001 Springfield Charter and Oregon Revised Statutes to establish fees and charges based on costs for specific services rendered; WHEREAS, on May 17, 2021, the City Council adopted Resolutions 2021-17 and 2021-18 adopting the Springfield Master Fees and Charges Schedule to include cost -of -living adjustments, changes in fee descriptions, news fees and omitted fees, but did not include any changes to the Section 6 Building and Safety fees; WHEREAS, the proposed Section 6 Building and Safety fees include a 1.6% Cost -of -Living Adjustment (COLA) and changes to the mechanical fees section above the 1.6% COLA.; and WHEREAS, the opportunity for public comment at a public hearing has been provided prior to the adoption of this Resolution, NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The Springfield Master Fees and Charges Schedule, Section 6 Building and Safety Fees, is hereby amended as provided in Exhibit A, attached hereto. Except as specifically provided herein, all other fees and charges adopted by Resolution 2021-17 and 2021-18 will remain in full force and effect. Section 2: Future Resolutions of the Common Council may be adopted to amend, add, or delete any rate, permit fee, license fee, or other fee or charge. Section 3: If any particular rate, permit fee, license fee, and other fee or charge is held invalid by operation of law or any court of competent jurisdiction or the enforcement of any fee restrained by such court pending the final determination as to its validity, the remainder of the rates, permit fees, license fees, fees, and charges specified in the Springfield Master Fees and Charges Schedule shall not be affected thereby and shall remain in full force and effect. Two complete sets of plans, engineering calculations, diagrams and other data shall be submitted with each application for a permit. The building official may require plans, computations and specifications to be prepared and designed by an engineer or architect. Attachment 3, Page 6 of 8 Section 6: Building and Safety Fees (a) A scaled plot plan with building dimensions, setback and location of proposed signs shall be submitted with the sign permit application. A photograph of each facade of the building shall be submitted. (b) A scaled elevation drawing shall be submitted in addition to the above requirements if a wall mounted sign will be erected. (c) A description of materials, anchors, footings and attachment systems shall be provided. (d) For all freestanding, pole or projecting signs over 20 feet in height, plans shall be submitted, drawn by a registered engineer. (e) Each application shall include photographs of existing signage on the property associated with the business. (f) If the application is for a billboard, the application must include an approved permit from the state of Oregon under the Oregon Motorists Information Act of 1971 (ORS 377.700 et seq.) prior to the erection of the billboard. Temporary Sign Permit Fee (SMC 8.218 (3)) Temporary Sign Permit Fees. Four permits for each approved development area shall be permitted per calendar year. The fee for each permit shall be set by resolution by the Council. No temporary sign(s) shall be larger than 60 square feet and be erected for a maximum of 30 consecutive days per each permit. The temporary sign(s) shall be located completely on private property and shall be in compliance with the required setbacks as identified in Springfield Municipal Code. A security deposit is required when this permit is issued. If the applicant fails to remove the temporary sign(s) by the date specified on the permit, the deposit shall be forfeited and the City may remove the temporary sign(s). If any temporary signs are erected without first obtaining a permit, the permit fee shall be doubled. Temporary signs erected by or for the City for City -sponsored events, authorized by the City, or for the park district, utility company, or hospital for community events are exempt. Sign Code Modification Fee (SMC 8.238(2)) A modification is defined as a request for a sign that complies with the provisions of this sign code in all respects except size or height and the proposed request is not more than 15 percent greater than Attachment 3, Page 7 of 8 Section 6: Building and Safety Fees otherwise allowed. If the applicant chooses to apply for a modification to the sign code, they may apply through the development services department for a cost set by resolution of the council. This modification request will be reviewed, and a decision reached by the Development and Public Works Director within 30 days of the application, providing the application is complete. The following criteria must be met in order for a modification to be approved: (a) Locational and/or dimensional problems have been identified; and (b) The proposed adjustment will not cause any of the following adverse effects on neighboring properties: (i) Creates a vision clearance hazard for pedestrians, motor vehicles or bicyclists; or (ii) Creates a hazard for fire prevention or fire suppression; or (iii) Public safety is compromised; and (c) The hardship is not self-imposed. Sign Code Appeal Fee (Building Board of Appeals) (SMC 8.238(5)) An applicant who is denied a modification request may appeal the decision of the Development and Public Works Department to the Building Board of Appeals for a cost set by resolution of the Council. The request will be reviewed by the Board and a decision reached within 30 days of the application date.
