RECITAL:
A. Declarant is the owner of the real property described on the aftached Exhibit A
(North Parcel) and is the owner of the real property described on the attached Exhibit B (South
Parcel). Each parcel is a legal lot of record and may be conveyed separately from the other.
B. Declarant has submined plans for the construction of certain improvements on the
North Parcel to the City of Springfield for review and approval. The City of Springfield has
approved the plans subject to certain conditions (Springf,reld Journal No. 2001-03-0068). Among
the conditions are the imposition of covenants on the North Parcel and the South Parcel in
accordance with the terms of this declaration.
C. The rights and obligations set forth in this declaration shall burden and benefit each
of the parcels, shall run with each parcel, and shall benefit and burden the successors and assigns
of Declarant with respect to each parcel.
DECLARATIONS:
At any time when the North Parcel and the South Parcel are not owned by the same person
or entity:
1. The building to be constructed on the North Parcel and the improvements currently
located on the South Parcel shall each be closed in with approved one-hour flre rated wall

2. The south buitding wall of the building to be constructed on the North Parcel shall
be converted to a full one-hour fire separation wall.
3. If at any time storm drainage from the North Parcel or any improvement on the
North Parcel is provided by drain lines on or across the South Parcel, there shall be appurtenant
to the North parcel a utility easement not less than five feet in width along the centerline of such
drain line, together with the right of reasonable access for the purpose of maintaining such drain
line.
