charges, connectiott fees, plumbing permits or other such costs to be assumed by the property owner.
lT IS UNDERSTOOD that Applicant this agreement is enforceable by the State of Oregon, Lane
County or the City. It is further underitood that the ipplicant agrees to sign any andail waivers,"petitions,
consents and all other documents necessary to obtain the above said sanitary sewer improvement-under any
improvement act-or proceeding of the State of Oregon, Lane County orih" City aimay be proposed o-r
adopted. The applicant agrees.to waive all right to remonstrate againsian improveinerrt project'foisanitary
sewer to be duly ilritiated b^ythe City Council, but not the right to protest the arnount or manner of spreading
the assessntent thereof, if the same shall appear to Applicant to bear inequitabty or unfairly upon saii
property of Applicant. Applicant's acceptance of the non-remonstrance condition is in corrsideration for theCity's waiver of the requirernent for the imrnediate construction of the public improvements that the
development necessitates. The improvement agreement waives the properiy owner'i right to file written
retnonstratrce. It does.not waive a property owners right to speak on the pioposed distr-ict or any related
matters orally or in writing
NOW THEREFORE, th.e Cjty 1g-regs that if Applicant complies with the terms of this agreement,
Cha,pter 2, Article l0 of th^e Springfield Code and Ordinance 5584 along with all other applicabie laws oi
the.State of Oregon, Lane County, and the City, the said Applicant shall6e entitled to connect the existing
residence to the public sewer systems.
Tlte covenatrts herein contained shall run with the land herein described, and shall be binding upon
the heirs, executors, assigns, administrators, and successors of the parties hereto, and shall be constiued to
be a benefit and a burden upon the property herein described. This igreement shall be recorded in the Lane
County Deed Records.
