VAI{IANCE REQUEST: The applicant requested a variance tiom Section 9-1-14 (l) of the Springfield
Sign Code relative to the allowable number of wall signs in a Community Commercial district.
At the Board of Appeals Meeting held on April 22, I 996 The Board of Appeals rendered the following
decision regarding the above referenced variance request:

FINDINGS OF FACT:
r)*All additional signage which was placed on the properly after the date of the variance application
shall be removed with the exception of the pump toppers.
T[e Board determincd that although the nurnber of wall signs far exceed the allowable number,
the total square footage is less than the allowable square footage allowed in a Community
Commercial district.

3) The additional wall signage will have no significant adverse aff'ects otr the community
4)The signs which are approved under this variance request are those constructed to the national
sign standard used nationwide for SHELL stations.

Recommendation
Staff recommends denial of all additional wall signage as proposed based on the following:
l. Staff could find no unusual conditions with the property that differ from other commercially zoned
properties on corner lots.
2. This request is based on a self imposed hardship, i.e., the signs were installed without contacting the
City for Sign Code regulations for that districts, and, the signs were installed without obtaining
appropriate permits and inspections.
3. The comer lot provides good visibility for vehicle traffrc and the multitude of requested signs provides
no additional benefit to vehicle or pedestrian safety.

Dear Mr. Larsen:
This letter is to serve as your notice of the appealhearing you applied for in regards to additional wall
signage. The proposed signs are to be located at 1795 North 5th Street, Springfield, Oregon.
You are hereby notified that a hearing will be held before the Building Board of Appeals at Springfield
City tJall, Development Services Department, 225 Fifth Street, Meeting Room 615 on the 22nd day of
April, 1996, at the hour of I l:00 a.m., upon the notice and order served upon you. You may be present at
the hearing. You may be, but need not be, represented by counsel. You may present any relevant evidence
and will be given full opportunity to cross examine all witnesses testifying against you. You may request
the issuance of subpoenas to compel the attendance of witnesses and the production of books, documents
or other things by filing an affidavit therefor with the Board.
