( a ) The bui'l di ng and si te sha'l I be mai ntai ned i n accordance wi th the
provisions of the Springfield Deve'lopment Code in order to continue the use.
(b) It shall be the continuing obligation of the property owner to
maintain the planting required by Section 31.140 of the Springfield Development
Code in an attractive manner free of weeds and other invading vegetation. In
addition, plantings in the vision c'learance area sha'l'l be trirmed to meet the 2
L/2 foot height standard in accordance with Section 32.070 of the Springfield
Development Code.
(c) Parking lots shall be maintained by the property oyrner or tenantin a condition free of litter or dust, and deteriorated pavement conditions
shall be improved to maintain conformance with these standards.
(d) Undeveloped land within the development area shall be maintainedfree of trash and stored materi al s i n a mowed and attracti ve manner.
Undeveloped land shall not be used for parking.
6. In addition to all other remedies which may be provided by law or
equity (including but not limited to penalties provided by applicable state'lawor city ordinances) Applicant agrees that City may enforce Applicant's
responsibilities by withholding or terminating Applicant's Occupancy Permit.
7. Any Final Site Plan approved becomes null and void if construction
does not commence within one year of the date of this Agreement.

Dear Mr. Pfaff:
Having received your application for a building permit to preforrn certain renodeling
work to the building located on the east portion of g42 North 28th Street, Assessorsr
Map t7-03-36-L1, Tax Lot 9700, an inspection of the building was conducted by the City'sBuilding Division and the Fire Department. I
Our inspection revealed existing items in violation with the State of 0regon, Structural
Specialty Code and Fire and Life Safety Code. Here after referred to as S.S.C.
You are hereby notified that the buiLding sha1l not be occupied by nore than ten (10)
persons at any one time until the following items have be installed, repaired or re-
placed:
1. The enclosed usable space under the interior stairway, wa1ls and soffits,shall be
protected on the enclosed side as required for one-hour fire resistive construction.

2. Remove the louvered bi-fold doors giving access to the space under the interior
stairway and install a door that is self closing or automatic cl.osing, tight
fitting snoke barrier, and fire assembly having a fire-protection rating of not
less than 20 ninutes. S.S.C. 802(c)
3, Remove and relocate the ducts and grills located in stair risers. S.S.C. 3305 (m)
4, A11 ducts penetrating the one-hour fire-resistive wa1ls and soffit of usable space
under the interior siairway sha1I be equipped with an approved automatic closing smoke
damper. S.S.C. 802 (c)
S. Install a door that is self closing or automotic closing, tight fitting smoke barrier,
and fire assembly having a fire protection rating or not less than 20 minutes on the
