SITE:
Purpose: Minimum Development Standards (KIDS) are intended to support economic development by
minimizing City review for minor additions, expansions or changes in use. MDS shall ensure compliance
with specific appearance; transportation safety and efficiency; and storm water management standards
specified in the Springfield Development Code (SDC) and otherwise protect public health, safety and
welfare.
Criteria of Approval: In order to good NMS approval, the Director shall determine compliance with all
applicable standards specified below:
A) A five-foot wide landscaped planter ship, including street trees, with approved
irrigation or approved drought resistant plants as specified in SDC Sections 4.4-100
and 4.2-140 shall be installed between the sidewalk and parking areas or buildings.*
EXCEPTIONS:
1. Where there is an unimproved street, a four foot wide landscaped planter
strip shall be required to be set back one foot from the property line.
2. Where there is insufficient space for the landscaped strip required in
Subsection A., above due to existing buildings, street width, paved parking,

a. Decorative fencing located immediately behind the property line.
The fencing may be wrought iron or masonry and shall be subject to
the fence height standards of the applicable zoning district and the
vision clearance setbacks of Section 4.2-130; and/or
b. Landscaping equivalent to the amount required in Subsection A.,
above may be placed at the property comers or other areas of the property that me
visible from the street.
`Property fines, setbacks and dimensioned landscape areas shall be shown on all applications;
however street trees, fencing and planting information may be noted and details deferred to
Final MDS Plan Approval or Building Permit Submittal.

X Proposal Complies when the following Condition(s) is/are met:
Finding. The plan shows landscaped areas although does not show detail or types of
plants and trees. These items can be deferred until Final MDS.
Condition 1: On the Final MD5 Plan, show tree and plant type, placement and
irrigation plans for the landscaped areas shown on the tentative plan submittal.
Trees along the frontages of the property shall be a minimum 2" caliper and placed at
required 30' intervals. Trees shall be chosen from the approved Street Tree List and
trees along Main Street shall be chosen from the category "Any Planter Strip with
Overhead power Lines".

B) Trash receptacles shall be screened, covered and connected to the sanitary system in
accordance with the Engineering Design Standards Manual as applicable. All outdoor storage
areas shall be screened by a structure or enclosure permanently affixed to the ground as
specified in Section 4.4-110.*
• Property lines, setbacks, and the location of covers and screens shall be shown on all
applications; however materials and construction types may be noted and details
deferred to Final MDS Plan Approval or Building Permit Submittal.

C) Bicycle parking spaces shall be added to meet the numerical standards for the appropriate
use or upgraded to meet the standards set in SDC Sections 4.6-140,4.6145 and 4.6-155.
. Long-term and short-term bicycle parking areas may be noted on all applications; however,
details may be deferred to Final MDS Plan Approval or Building Permit Submittal.
EXCEPTION: In cases where the number of bicycle parking spaces cannot be met due to
lot/parcel size or physical constraint, the Director, in consultation with the Public Works
Director, may reduce the standard without a Variance if a finding is made that the reduction
will not have an adverse impact on public safety..

D) Parking and circulation areas shall be paved and striped and wheel stops installed as
specified in SDC Sections 4.6-100 and 4.6-120. Required paving and other impervious surfaces
on the site shall comply with on-site stormwater management standards as specified in SDC
Section 4.3-110.
EXCEPTION: In cases where the number of vehicular puking spaces cannot be met due to lot
size or physical constraint, the Director, in consultation with the Transportation Planning
Engineer, may reduce the standard without a Minor Variance ff a finding is made that the
reduction will not have an adverse impact on public safety.

X Proposal Complies when the following Condition(s) is/are met:
Finding: The applicant's plan shows 4 parking spaces backing out onto the southern
drive -up aisle.
Advisory Note: The proposed angled parking affronting the southern drive -up lane
is not ideal in that backing vehicles may be in conflict with vehicles queued in line
for coffee. Applicant is advised to utilize these spaces for employee parkingor
eliminate them to avoid conflicts. The development has surplus parking. Removal
of these spaces would not constitute a violation of the development code.
Finding: Minimum Control Measure 5 requires the City of Springfield use an ordinance
or other regulatory mechanism to address post construction runoff from new and re-
development projects to the extent allowable under State law. Regulatory mechanisms
used by the City include the Springfield Development Code (SDC), the City's
Engineering Design Standards and Procedures Manual (EDSPM) and the Stormwater
Facilities Master Plan (SFMP).
Finding: Section 3.02 of the City's EDSPM states the Public Works Department will
accept, as interim design standards for stormwater quality, water quality facilities
designed pursuant to the policies and procedures of the City of Springfield's EDSPM
and the City of Eugene Stormwater Management Manual.
Finding: Section 3.02.5 &.6 of the City's EDSPM states all public and private
development and redevelopment projects shall employ a system of one or more post -
developed BMPs that in combination are designed to achieve at least a 70 percent
reduction in the total suspended solids in the runoff generated by that development.
Section 3.03.4.E of the manual requires a minimum of 50 percent of the non -building
rooftop impervious area on a site shall be treated for storenwater quality improvement
using vegetative methods and 100% of the area shall be pre-treated.
Finding: To meet the requirements of the City's M54 permit, the Springfield
Development Code, and the City's EDSPM, the applicant will be required to install a
catch basin filter insert in the existing catch basin north of the proposed coffee kiosk.
Condition 2: Prior to approval of the final site plan, the applicant show installation
of a catch basin filter insert for the existing catch basin north of the proposed coffee
kiosk building.
Condition 3: Prior to approval of the final site plan, the applicant shall provide an
operations and maintenance plan to the City for review to ensure the long-term
maintenance and operation of the required catch basin filter insert. The plan should
designate maintenance responsibility for operating and maintaining the system, and
should be distributed to all property owners and tenants of the site, and include a
notice of Operations and Maintenance Plan recorded against the property.

E) Access onto the public right-of-way shall comply with SDC Section 42-120.
1. Where the proposed development area abuts an improved street, any nonconforming or
unsafe driveways, as determined by the Public Works Director, shall be removed and replaced
with curb, gutter and sidewalk.
2. Where the proposed development area abuts an unimproved street, any nonconforming or
unsafe access points, as determined by the Public Works Director, shall be:
a. Removed by the use of fencing, extruded curbs or other method of approved
barricade, and
b. The property owner shall sign an Improvement Agreement guaranteeing future
participation in a Local Improvement District.
3. If an existing driveway or access point is closed, the Director may approve a joint use access
agreement with a neighboring property as specified in Section 4.2-120.

Proposal Complies when the following Condition(s) is/are met:
Finding: The applicant is proposing to remove a driveway onto Main Street as part of
this development. Main Street is an ODOT facility and will require concurrence and
permitting for this application.
Condition 4: The applicant shall obtain the required Miscellaneous Permit from
ODOT to remove the driveway, restore the sidewalk and landscaping ship and
memorialize the removal of the access. In addition, please check with the City of
Springfield Engineering Division for required Encroacbment/Sidewalk Permit work
(Kyle Greene at 541-7265750).
Finding: Oregon Department of Transportation has stated that the drive -up coffee
stand will cause additional trips to the site triggering a change in use. ODOT will
require new access permits for all remaining approaches to Main Street and South A
Street.
Condition 5: Per ODOT requirements obtain access permits for remaining
approaches to Main Street and South A Street for this parcel.
E) Concrete sidewalks shall be installed where the site abuts a curb and gutter sheet as
specified in SDC Section 4.2-135.

and 4.3-120 of the SDC and comply with the Springfield Building Safety Codes, where
applicable. Easements may be required as specified in Subsection 4.3-140 of this Code.

Timelines and Conditions of Approval:
The property owner and/or applicant shall comply with the standards specified in Section 5.15-
120 within 3 years of the Director's approval as follows:
A. Submittal of a Final MDS Plan within 90 days of the Director's approval, including the
following Conditions of Approval:
Condition 1: On the Final MDS Plan, show tree and plant type, placement and
irrigation plans for the landscaped areas shown on the tentative plan submittal. Trees
along the frontages of the property shall be a minimum 2" caliper and placed at
required 30' intervals. Trees shall be chosen from the approved Street Tree List and

to Main Street and South A Street for this parcel.
B. The signing of a Development Agreement by the property owner within 90 days of the
Director's Final MDS Plan approval and issuance of the Development Agreement. A
Building Permit may be issued by the Building Official only after the Development
Agreement has been signed by the applicant. No structure or site shall be occupied until
all improvements are made as specified in this Section, unless otherwise permitted
below.
C. The construction of the required improvements shall begin within 2 years of the signing
of the Development Agreement. B this time line cannot be met, the applicant may submit
a written request for a single 1 -year extension of the 2 -year start of construction timeline
specified above.
D. If the timeline established for the start of construction in Subsection C. above is not met
and the applicant has not requested an extension, then the Director shall declare the
application mill and void.
E. Upon satisfactory completion of site development, as determined by a Final Site
Inspection (prior to the final building inspection), the City shall authorize the provision
of public facilities and services and issue a Certificate of Occupancy or otherwise
authorize use of the site.
F. All required improvements shall be installed prior to the issuance of a Certificate of
Occupancy or Final Building Inspection for the development, unless improvements have
been deferred for good cause by the Director as noted below:
Permits That May Be Required:
• Building permits
• An LDAP permit may be required for all grading, filling and excavating being done.
• Sign Permit -NOTE: Signs are regulated by the Springfield Municipal Code Article 9, Chapter7.
The number and placement of signs must be coordinated with the Community Services Division.
The location of signs on a Site Plan does not constitute approval from the Community Services
Division. Moving of back lit signs will require an electrical permit.
• Backflow prevention devices may be required for this service. Contact Scott Higley at 541-726-
2396 for technical assistance.
• ODOT Construction Permit for work in an ODOT right-of-way/Access
• City of Springfield Sidewalk Permit

Appeals: This Type 1 decision is exempt from the provisions of ORS 197.195, 197.763 and 227.173 and
therefore cannot be subject to the appeal provisions of SDC Section 5.3-100, Appeals.
