Dear Ned:
I have reviewecl your letter of May 29, i987 nequesttng a modification of theDevelopment Agreement between wiliamaiane ano ine city. The background informationyou provided in this letter^ lndicates that there will oe only a dozen occasions eachyear when busses and cars wtll compete for parking spaces 'in the expanded parking lot.If th'is is accurate, and alternative bus park'rng can be provided during these periodsat one of the two church parking lots, a modificat'ion of the Developmeit Agreement maybe possible.
This request must be processed as a mlnor modification of an approved site planbecause; a) A condrtion of site plan approval proh'ibits bus pa"'fing in the expandedparking lot. The deaoline to appea'l this conditron was lvlay 21, 1957, and; b)-DeveloDment Agreements must include all conditions of site plan approval. Moctify.ing aprovision of a Development Agreement that'is in fact a condition of site plan approvalcannot be accomplished without a corresponding mod'ificatlon of the site plan.
There is no app]icat'ion form (though there is a pnocedure) fon minor modifications ofapproved site plans. A letter request'ing the mod'ificat'ion, a plot plan of the parkinglot snowing where busses will park and now many can spaces they wili occupy, und a$50.00 dol'lar f ee- i s necessary to process th'is request. The bickground .intormati onpt'ovidecl in your'letter will De inconporated into, and made a pari of, your request.
l.le will need to schedu'le another public meeting because everyone who attended thef irst meeting received a copy of the Final Decision for your- s'ite p1an. The f.ina'ldecis'ion included findings that showed bus parking (an iOentified neighborhood impact)would not occur on slte. The c'ity cannot amend these finctings or mooiry the s.iteplan without the same notice and opportunity foc public commeit that was provided atthe first meeting.
