The Conditions of Approval are listed below in italics and the response is listed below. • Condition 1: Priorto approval of the Final Site Plan, the applicant must enter into a maintenance agreement with the City of Springfield, whereby the applicant will provide routine maintenance for functionality of the two rein gardens serving the development site. Condition 1 Response: The applicant has executed the Stormwater Operations & Maintenance Agreement, attached as Exhibit A. • Condition 2: Priorto approval of the Final Site Plan, the applicant must provide an operations and maintenance plan satisfactory to the City to ensure viable, long-term maintenance and operation of the stormwater rein gardens. The operations and maintenance plan must designate the responsible party fw operating and maintaining the system and must be distributed to all property owners and tenants of the site. A notice of this plan must be recorded against the property with Lane County Deeds and Records and evidence thereof provided to the City. Condition 2 Response: A Facility -Specific Stormwater Operations and Maintenance Plan for the project has been prepared and is included with the City's standard O&M agreement attached here as Exhibit A. A Notice of Operations & Maintenance for Private Stormwater Management and Treatment Systems (Notice) has already been recorded forthe property. The existing Notice was recorded with Lane County Deeds and Records on 02126/2014, Lane County File No. 2014-006757, and is attached here as Exhibit B. Per coordination with City Planning staff, the existing Notice is sufficient and recording an additional Notice is not required. • Condition 3: To ensure a fully functioning water quality system and meet objectives of Springfeld's MS4 permit, the Springfield Development Code and the EDSPM, the water quality rein gardens must be fully vegetated with all vegetation species established prior to completion of all final inspections and commencement of operations. Alternatively, if this condition cannot be met, the applicant must provide and maintain additional interim erosion controlrwater quality measures as detailed in Chapter 8 of the EDSPM that will suffice until such time as the rein garden vegetation becomes fully established. Record resolution activities: For assistance please call Public Works Maintenance at 541-682-4800. 4.5.7 Rain Garden O & M Plan Rain Gardens are vegetated surface reservoirs used to collect and treat stormwater runoff from impervious surfaces by allowing the pollutants to settle and filter out as the water percolates through vegetation and soil mediums before infiltrating into the ground below or being piped to its downstream destination. Rain Gardens can be used to help fulfill a site's required landscaping area requirement and should be integrated into the overall site design. Numerous design variations of shape and planting scheme can be used to fit the character of a site. The reservoir basin shall infiltrate stormwater within 24 hours. All facility components and vegetation shall be inspected for proper operations and structural stability, at a minimum, quarterly for the first 2 years from the date of installation, 2 times per year thereafter, and within 46 hours after each major storm event. Training and/or Written Guidance information for operating and maintaining vegetated infiltration basins shall be provided to all property owners and tenants. A copy of the 0 & M Plan shall be provided to all property owners and tenants. Inspection Logs shall be kept by the facility owner demonstrating the following items have been inspected and are being maintained properly: • Access to Rain Gardens shall be safe and efficient. Obstacles preventing maintenance personnel and/or equipment access to the components of the facility shall be removed. • Debris and Litter shall be removed to prevent channelization, clogging, and interference with plant growth. Fallen leaves and debris from deciduous plant foliage shall be raked and removed. • Erosion Damage shall be identified and controlled when native soilisexposed or erosion channels are forming. • Grassed Rain Gardens shall be mowed to 4"-9" high and grass clippings shall be removed no less than 2 times per year. • Infiltrating Rain Gardens shall be excavated and cleaned, and gravel or soil shall be replaced to correct low infiltration rates. • Inlets shall be cleared when conveyance capacity is plugged to ensure unrestricted stormwater flow to the rain garden. • Mulch shall be replenished as needed to ensure healthy plant growth. • Nuisance and Prohibited Vegetation from the Eugene Plant List (such as blackberries and English Ivy) shall be removed when discovered. Invasive vegetation contributing up to 25% of vegetation of all species shall be removed and replaced. • Outlets shall be cleared when 50% of the conveyance capacity is plugged. • Overflows shall be cleared when 25% of the conveyance capacity is plugged. Stormwater Management Manual 4-19 Eugene 2014 • Rocks or Other Armoring shall be replaced when only one layer of rock exists above native soil. • Sedimentation build-up near or exceeding 2" in depth shall be hand -removed with minimum damage to vegetation using proper erosion control measures. Sediment shall be removed if it is more than 4 inches thick or so thick as to damage or kill vegetation. • Slopes shall be stabilized using appropriate measures when native soil is exposed. • Vegetation shall be healthy and dense enough to provide filtering while protecting underlying soils from erosion. Dead vegetation shall be removed to maintain less than 10% of area coverage or when vegetative filter function is impaired. Vegetation shall be replaced immediately to control erosion where soils are exposed and within 3 months to maintain cover density. Spill Prevention Measures shall be exercised on site when handling substances that contaminate stormwater. Releases of pollutants shall be corrected as soon as identified. Non -Chemical Pest Control measures shall be taken to prevent development of insects, mosquitoes, and rodents. Maintenance of the line may require the line to be lowered and there can't be any structural impediment to the work. Engineering will allow lighting in the corridor provided any lighting requires a 20 foot horizontal setback from any overhead wire. If your team can provide an updated site plan that rearranges the lighting out of this area, I will resend to engineering to review. Learn to spot a phishing message Thanks for the update Richard, I was talking with our lighting folks a few days ago, and there is some flexibility in the light pole locations. If we were able to move the light poles some distance away from the existing lines, would that ease the concerns that the operations folks have with the proposed design? If so, what minimum clearance would be recommended? Also, are there any concerns with the proposed trees within the easement? Per discussion with the Landscape Architect, Ash and Redbud are on the City of Springfield's approved street tree list for use under powerlines and Cascara is proposed within the stormwater treatment facilities. These are the proposed tree species for this project and all are listed at a maximum potential height of 30'. We'll discuss your note about the required agreement language with the Owner and get back to you We appreciate your efforts to advance this as quickly as possible. I will check in with the engineering group to see if they can spare some time to review the work. Approving these type of requests can be difficult, especially since any agreement I would draft would need to reserve the right to reconstruct our line which could including removing portions of the parking area, without compensation to the landowner, in the future. Pacific Power cannot guarantee we won't need to place structures or equipment within the easement area going forward. The design is still in progress, and the attached plans have been submitted to the City for preliminary site plan review. There may be slight modifications to pole locations, landscaping, parking layout, and utility routing, but the core concept is established at this point. To let you know we consider a light pole to be a structure and are generally not permitted in an easement corridor area. Since the work involves placing new facilities, structures and utilities within the corridor I will need to have the following application filled out and I will need greater detail of everything being planned in the corridor than what the site plan has provided. I will need technical data for the planned pole(s) and exact locations so our engineering group can determine if there is any conflict. I think the site plan has one on the map but need to verify this. The easement has a height limit of 20 feet and the right to clear the property of any structures that create conflict with the line. If the plan is approved by Pacific Powers engineering, planning and operations than an agreement will be drafted by my department for the landowner/leaseholder to consider. Also will need details of any new underground/overhead utility lines that are planned to be within the corridor. This site plan isn't really telling exactly me where this is. I can't tell where the easement corridor is in relation to the overall property since it has no legal description and the plan isn't showing me any useable reference point. I will also need to know where this is in relation to Pacific Powers nearest structure. I've highlighted the 100' easement and the location of the transmission lineswithin the easement. No structures are proposed with this project, but landscaping trees and light poles are proposed. Utilitywork within the easement will be limited to stormwater management piping, irrigation, and lighting circuits. We are needing to find out what limitations there are forwhere light poles and landscape trees can be located within the easement, and what their maximum heights can be. We also need to confirm if a formal review or permit process is needed to construct this work. The easement restricts any structures built within the easement right of way. So please send me and Zach an e-mail letting us know what work needs to occur. Generally if nothing is being built in the corridor it can generally be allowed after review and approval from the line patrolman and the operations manager for the area. If it is a complex job and there are proposed structures / utilities being put in the area the attached application for proposed use needs to be filled out since it will need review by several internal groups and an agreement to be drafted.
