Springfield, OR 97477 Owners: Larry Palanuk Kerry Ayres-Palanuk o9/01/21 Establishment of Legal Non -Conformance Use 102 Deadmond Ferry Rd. This is a request to the City of Springfield, Oregon by Larry Pala nuk to establish legal non-conformance use of the property at 102 Deadmond Ferry Springfield, OR 97477. The owners (Larry Pala nuk and Kerry Ayres-Palanuk -Owners) require the documentation of legal non-conformance in order too bta in a building permit to replace the existing main home currently in use on the property. That home is functional, but the Owners would like to replace it, and bring it up to FEMA construction standards that are required in a Floodway. Home History There has been a structure at this home site for well over 100 years. The location served as ferry station for crossing the McKenzie River prior to the existence of any nearby bridge. The Deadmond Ferry was known to operate as late as 1914 (Lane County Historian Fall 1979 Vol XXIV No. 2). The exact location of the building that supported the ferry is not known for sure, but it likely fell within the shadow of the existing home since that elevation relative to the river is the highest in area, and there is evidence of old concrete steps on the bank leading and down to the river directly in front of the house. It is not presently known what the original design or construction date was of the oldest part of the current home, but given the construction style and materials used, it was no later than the 1950's and likely much earlier. There is evidence of a major remodel in 1966 (based on date stamps on construction materials), and another remodel/expansion in 1977 (based on detailed blueprint still in existence on the property). The current design today matches that of the blueprints, so there does not appear to have been any major remodeling or expansion of the main home since'77. There is another legal residence (guest house) on the property. It is not known when it was originally built, but based on newspapers stuffed in walls for insulation, it was before 1977. That structure was rebuilt by the Owners from 7/19/2018 to 12/13/2019 under permit 811-18-001496-DWL. Occupancy and Use Owners purchased the property in October 2014. They immediately rented out the homes while still living in Portland, OR and preparing to retire. They removed the renters from the guest house and started its reconstruction in July 2018 and finished with legal occupancy in Dec 2019, and then immediately moved in. They continued to rent out the main house until recently when they actively started light demolition in preparation for reconstruction. Prior to their ownership, it was owned by a local doctor - Dennis McCafferty and his wife Estelle. They purchased the property in 1976. She died in 2012 and he continued to live there until his death in 2014. Owners purchased the home from Dennis and Estelle's daughters that same year. Zoning Changes to Public Land Open Space (PLO) According to handwritten notes in the city records, the land was converted to PLO zoning designation back in the 1980's because of an informal discussion between Dr. McCafferty and city officials. It appears that he may have intended at that time to donate the property to Willamalane upon his death. A trust agreement dated April 25 1996 on record with the county! ndicated that he did not ultimately intend to follow through with that donation. Proof of Use Since Re -Zoned to Public Land Open Space " May 51h 1986 — (Not Abandoned) Chain of Ownership The McCafferty's purchased the property in 1976 from Hallie and Mary Markham. (See Appendix A - McCafferty Deed R795-24066—Recorded May 191976.) They owned the property until it was purchased by the current Owners. (See Appendix B - Preliminary Title Report Less Than 30 Days). Proof of Use 10/17/14 to Present (Current Owners) - The proof that the current Owners have not abandoned the structure can be shown by providing income/property tax records - See Code 5.8-115 B2. (See Appendix C - Taxes 2015-2021) 07/01/03 to 10/17/14 (McCafferty's)-The proof that the MCafferty's did not abandoned the structure between 07/01/03 and 10/17/14 can be shown by providing income/property tax records - See Code 5.8-115 B2. (See Appendix D - Taxes 2003 — 2014) 05/05/86 to 07/01/03 (McCaffertv'S)— Since tax records are difficult to obtain (microphiche in county records) other means have been gathered to provide sufficient proof of use. Bill Clothier (McCafferty's Son -in -Law) knew the McCafferty's since the mid to late 80's and can vouch for their continued use of the property (based on a phone discussion on 9/1/217:59AM) The Obituary from the Register Guard gave more evidence that the McCafferty's would not have abandoned their home (See Appendix E - Dennis McCafferty Obituary) • "They moved to their beloved home on the McKenzie River in 1974" • Died "March 25, 2014 in the garden that he loved so" • "celebrate Dennis' life with an Irish wake on Saturday, April 5th at Noon at 102 Deadmond Ferry Road in Springfield The County provided one year of property tax records for 1985 that would show use just prior to the zoning conversion (See Appendix F). The was never any indication through all the evidence gathered that the McCafferty's abandoned the home. Discussions with folks familiar with the house spoke of parties and gatherings. The property was even known to be part of a "Tour of Gardens" that would be open to the public one day a year. Subjectively speaking, there seems to be sufficient evidence to conclude that this home/property has not been abandoned under the description of Springfield Development Code 5.8-130 since being re- zoned in 1976. Appendix E Dennis McCafferty Obituary IN 1927-2014 BORN 1927 DIED 2014 RECORDS View more records for McCafferty_on Ancestrv.com(D Sponsored 0 Share _ x Dennis Eugene McCafferty M.D. 1927-2014 Dennis was born in his Grandmother's front bedroom in McCook, Nebraska on January 21, 1927 to parents Merritt Dwight McCafferty and Leona Booth McCafferty. His father worked in retail and his mother was an artist. He loved his younger brother, Jerry. He did well in school, worked from age 10, was his high school class president, played football and became an Eagle Scout. His family moved to Corvallis, Oregon and he joined the Navy near the end of WWII at age 17 with his parent's permission. In Corps School he came down with scarlet fever and almost died. He was a medic in the Long Beach, California Hospital, leaving the Navy as a Pharmacist Mate Third Class. Dennis studied Pre -Med at Oregon State University, then went to University of Oregon Medical School in Portland, interning at the Multnomah County Hospital. He met his wife, Estelle Frances Greer, on a blind double date, and was impressed with her beauty and the fact she drove a convertible and liked jazz. They were married on December 20, 1953. They moved to Denver, Colorado where Dennis had his residency at the VA Hospital and their daughter, Page Estelle, was born there in 1956. He transferred to Oregon City Hospital, and daughter, Leslie Ann, was born there in 1958. The family moved to Eugene in 1959 and he started his Internal Medicine practice in Springfield, retiring in 1991. They moved to their beloved home on the McKenzie River in 1974 and loved their rustic cabin in Camp Sherman on the Metolius River. Dennis was an old -school physician, charging as little as possible for his office calls and making twice a day rounds. He served many years on the board at McKenzie -Willamette Hospital and volunteered his medical services where needed. Although known as an intellectual, stoic, and voracious reader, Dennis was a great joke teller and fun to be with. He was a Secular Humanist and had liberal Democratic views. x remember, he took control of his own destiny with a rational suicide to halt the advance of dementia on March 25, 2014 in the garden that he loved so. He was 87. He will rest at River View in Portland with his wife Estelle, who died in 2012. Dennis is survived by his daughters and sons-in-law: Page and Bill Clothier, and Leslie and Michael Kearsey; grandchildren: Kelty and Wedge Clothier, and Rose and Weston Kearsey; and many friends including medical fellows, his friends at the Oakway Fitness Center, and the Wednesday Night Group. We will celebrate Dennis' life with an Irish wake on Saturday, April 5th at Noon at 102 Deadmond Ferry Road in Springfield - all are welcome.
