Applicant Submits a Non -Conforming Use - Expansion/Modification Application to the Development & Public Works Department The application must conform to the Non -Conforming Use - Expansion/Modification Submittal Requirements Checklist on page 4 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Non -Conforming Use - Expansion/Modification Submittal Requirements Checklist have been submitted. Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check Planning Division staff conducts a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. • An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. • Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision A Type II decision, made after public notice, but without a public hearing, unless appealed, is issued within 120 days of submittal of a complete application. Mailed notice is provided to property owners and occupants within 300 feet of the property being reviewed and to any applicable neighborhood association. In addition, the applicant must post one sign, provided by the City, on the subject property. • There is a 14 -day public comment period, starting on the date notice is mailed. • Applications are distributed to the Development Review Committee, and their comments are incorporated into a decision that addresses all applicable approval criteria and/or development standards, as well as any written comments from those given notice. • Applications may be approved, approved with conditions, or denied. The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. • The decision issued is the final decision of the City but may be appealed within 15 calendar days to the Planning Commission or Hearings Official. Spe ' as those circumstances and conditions under which a non - conform situation may be permitted to continue and/or expand. B. Approval of a Variance sped in Section 5.21-100 shall not be considered to make a use, building or cture, or lot of record non -conforming. A. A non -conforming use is an activity involving land, buildings, and/or structures for purposes which were legally established prior to the May 5, 1986, but which do not fully comply with the current development regulations, or subsequent amendments to this Code. These activities would not be permitted by this Code as a new use in the zone in which it is currently located. The Director shall make a determination regarding the legal status of a non -conforming use using the following approval criteria. The burden of proof is upon the property owner. A. The applicant shall submit any of the following items as proof that the use was permitted by this Code at the time it was adopted or amended: 1. Copies of building and/or land use permits issued at the time the use was established; and/or Copies of zoning code provisions and/or zoning maps. B. The applicant shall submit any of the following as proof that the use has been in operation over time and has not been abandoned as specified in Section 5.8- 130: 1. Utility bills; 2 -- @@4. To Whom It May Concern: July 21, 2021 Re: Non -Conforming Use We me applying for an expansion and modification to the property for a larger stick built home and one that will appreciate in value vice depreciate in value. My husband and I have lived here for the past 9 years and during that time he has developed Parkinson's and has had a stroke, paralyzing his right side. Plus having all of these medical issues, we had a fire 6 years ago and lost our furnace and south end of this modular home. The house still smells like smoke and continues to hinder our health. My husband is in a wheel chair for mobility and makes it much more of a challenge getting around in a small home. We need much more sf than a 1200sf home. He runs into everything and cannot manipulate mobility in fight spaces. Everything has to be handicap friendly! My daughter has had to move in with us to help with caring for us. For expansion/modification of this property there will not be an impact upon adjacent properties as there will not be changes in our driveway parking or lighting, as we will have the same motion and street lighting. Everything remains the same except the sf of the house and the placement of the house will be relatively the same as the one on it but adding garage. The proposed home is a ranch style of 2232sf compared to the existing home is 1200sf.
