HomeMy WebLinkAboutResolution 2021-29 06/28/2021 CITY OF SPRINGFIELD, OREGON RESOLUTION NO. 2021-29 A RESOLUTION AMENDING RESOLUTION 2020-05 TO ADOPT SPECIAL REGULATIONS TO EXTEND DEVELOPMENT TIME LIMITS DURING THE COVID-19 PANDEMIC WHEREAS, ORS 401.305 provides authority for the City of Springfield to act as an emergency management agency, including authority to establish policies and protocols for defining and directing responsibilities during the time of emergency; WHEREAS, the City of Springfield has enacted a local Ordinance (SMC 2.800 et seq.) pursuant to the authority granted by ORS Chapter 401 that provides for executive responsibility in times of emergency; WHEREAS, on March 16, 2020, the Common Council of the City of Springfield adopted Resolution 2020-05 declaring a state of emergency due to the present COVID-19 pandemic and adopting certain special regulations imposed as a result of the state of emergency; WHEREAS, the Common Council adopted Resolution 2020-13 (May 4, 2020) and Resolution 2020-20 (June 15, 2020) extending the state of emergency due to the COVID-19 pandemic and adopting additional special regulations as a result of the state of emergency; WHEREAS, the Springfield Development Code provides certain time limits for development submittals or approvals, described in detail in Exhibit A; WHEREAS, development projects within Springfield have experienced delays attributable to the COVID-19 pandemic, due to a combination of factors including but not limited to the pandemic's effect on supply chains, loss of income related to the pandemic, and business closures or changes necessary to implement COVID-19 physical distancing requirements; and WHEREAS, in the interest of economic recovery from the COVID-19 pandemic and to preserve the public welfare, the City Council has determined that it is necessary to toll the time limits described in Exhibit A for the duration of the COVID-19 state of emergency and for an additional 30 days following the termination of the state of emergency, NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1. In determining the date by which any action described in Exhibit A is required to be completed, the period beginning on March 17, 2020 and ending 30 days following the termination of the state of emergency by order of the Common Council (the"Tolling Period') will be disregarded. Section 2. If any section, subsection, sentence, clause, phrase or portion of this Resolution is, for any reason, held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereof. Section 3. This Resolution will take effect upon adoption by the Council. APPROVED this 28th _ day of June, 2021, by a vote of 6 in favor and 0 against.
