ITEM TITLE: FIRE CODE ORDINANCE
ACTION
REQUESTED:
A Public Hearing and First Reading to adopt the proposed amended Fire Code is
scheduled for June 7th, 2021. Eugene Springfield Fire requests that City Council
review and provide feedback to the proposed amended Fire Code prior to the Public
Hearing.
ISSUE
STATEMENT:
The Fire Code adopted by the City of Springfield must be consistent with State Fire
Protection Statutes and equal to or more stringent than the Fire Code promulgated
by the Oregon State Fire Marshal (OSFM). The OSFM recently adopted a new
2019 Oregon Fire Code (based on the 2018 International Fire Code) with an
effective date of November 15, 2019. The currently enforced Springfield Fire Code
is the 2012 International Fire Code with Oregon and Springfield amendments and is
no longer compliant.

DISCUSSION/
FINANCIAL
IMPACT:
Adoption of the 2018 Edition of the International Fire Code with Amendments will
enable Eugene Springfield Fire to provide a high level of fire safety protection
within the City. Examples of additions to the 2019 Fire Code includes new
language addressing plant extraction systems, laboratories in higher education,
mobile food preparation vehicles, capacitor energy systems and large assembly
gatherings.
This Ordinance shall take effect July 1, 2021 upon its adoption by the Council and
approval by the Mayor so that the City of Springfield Fire Code is compliant with
the State of Oregon 2019 Fire Code Amendments which became effective
November 15, 2019.
Replacement of International Fire Code books have totaled approximately $1,500
spent out of the FY19-20 budget.

AN ORDINANCE ADOPTING THE SPRINGFIELD 2019 FIRE CODE BY ADOPTING, AMENDING,
ADDING, AND DELETING SECTIONS OF THE STATE OF OREGON 2019 FIRE CODE; PROVIDING
FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; AND REPEALING
ORDINANCE NO. 6320 ADOPTED JUNE 16, 2014.
WHEREAS, the City of Springfield is designated by the Oregon Fire Marshal as an exempt
jurisdiction; therefore, the Eugene-Springfield Fire Department is responsible for administering
fire regulations within the jurisdictional boundaries of the City of Springfield;
WHEREAS, the State of Oregon has adopted the State of Oregon 2019 Fire Code for the
purpose of regulating and governing the safeguarding of life and property from fire and
explosion hazards arising from the storage, handling and use of hazardous substances, material
and devices, and from conditions hazardous to life or property in the occupancy of buildings
and premises; and
WHEREAS, the Eugene-Springfield Fire Marshal believes that adoption of the State of Oregon
2019 Fire Code provides adequate regulation and is in the best interest of the City of Springfield
to adopt regulations that are largely uniform through the State of Oregon, with certain
exceptions noticed in Exhibit A attached hereto,
NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD ORDAINS AS
FOLLOWS:
Section 1. The Springfield 2019 Fire Code, based on the State of Oregon 2019 Fire
Code, as set forth in Exhibit A attached hereto and incorporated by this reference, is hereby
adopted as the Fire Code of the City of Springfield.
Section 2. Copies of the Springfield 2019 Fire Code Amendments and State of
Oregon Fire Code 2019 Edition will be placed on file in the office of the City of Springfield
Department of Fire and Life Safety, the City Recorder's office of the City of Springfield, and the
City of Springfield Public Library.
Section 3. Ordinance 6320 adopted June 16, 2014 is hereby repealed, except
however, that Ordinance 6320 shall remain in force to authorize a punishment, penalty or
forfeiture incurred, or a suit, prosecution or proceeding pending when this Ordinance takes
effect, for an offense or violation committed under Ordinance 6320 prior to the effective date of
this Ordinance.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent provision and such holding
shall-not affect the validity of the remaining portions thereof.

CHAPTER 1
SCOPE AND ADMINISTRATION
SECTION 101
SCOPE AND GENERAL REQUIREMENTS
101.1 Title. These regulations shall be known as the Springfield Fire Code, hereinafter referred
to as "this code". Amended
101.2.1 Appendices. Provisions in the appendices shall not apply unless specifically adopted.
The provisions of the following appendices are adopted as part of this code: B, C, D, H, K, L, M,
N, Q, R, S and T. Amended
SECTION 102
APPLICABILITY
102.3.1 Change of use or occupancy - notification. The responsible person shall forward a
notification of the change in occupancy to the Eugene Springfield Fire Marshal's Office in order
to update fire department records within 30 days of the change. This requirement does not apply
to Group R and U occupancies. Added
102.9 Matters not provided for. Requirements that are essential for the public safety of an
existing or proposed activity, building or structure, or for the safety of the occupants thereof, that
are not specifically provided for by this code, shall be determined by the fire code official. See
Section 105.6.51. Amended

PERMITS
105.6 Required Operational Permits. In addition to any permits required by law or
administrative regulation from the State of Oregon Fire Marshal, permits shall be obtained from
the Eugene Springfield Fire Marshal's Office prior to engaging in the following activities and
operations as set forth in Sections 105.6A through 105.6.52. Amended
105.6.2 Amusement Buildings. An operational permit is required to operate special amusement
buildings, such as haunted houses and similar temporary installations. See Appendix Q

105.6.37 Places of Temporary Assembly. For purposes of this section, temporary assembly is
defined as the occasional and temporary gathering of 50 or more persons for such purposes as
deliberation, education, instruction, worship, entertainment, amusement, drinking or dining in a
space not normally used as an assembly space. An operational permit is required for a temporary
assembly when the space utilized has not been previously classified as and approved for
assembly use by the Building Official. A temporary assembly operational permit is not intended
to substitute for compliance with code requirements for an Assembly occupancy when a space is
intended to be used regularly for events, gatherings, and other similar such uses. Issuance of a
Temporary Assembly Permit is at the sole discretion of the Fire Code Official, and may include
additional safeguards required for the temporary assembly. Amended

105.6.47 Temporary Membrane Structures and Tents. An operational permit issued by the
Eugene Springfield Fire Marshal's Office is required to operate an air- supported temporary
membrane structure, a tent having an area in excess of 1,500 square feet or an occupant load of
50 or more, or multiple tents with an aggregate area in excess of 1,00 square feet.

SECTION 106
FEES
106.2 Schedule of Permit Fees. A fee for each permit shall be paid as required, in accordance
with the schedule established by the City of Springfield as the "Master Fees and Charges
Schedule." Amended

MAINTENANCE
108.1.1 Access to Safeguards. Any device, equipment, system, condition, arrangement, level of
protection, or any other feature required for compliance with the provisions of this code, or
otherwise installed, shall be accessible and unobstructed. Added

BOARD OF APPEALS
109.1.1 Appeals. The responsible person may file a written appeal, of a violation of this code to
a Hearings Official designated by the Springfield City Manager. Appeals shall be pursued and
appeal determinations shall be in accordance with the procedures and rules establish by ORS
Chapter 183 (Administrative Procedures Act). Amended
109.2 Limitations of authority. Deleted

SECTION 110
VIOLATIONS
110.3.1 Service. A notice of violation issued pursuant to this code shall be served on the owner,
the owner’s authorized agent, operator, occupant, or other person responsible for the condition or
violation, either by personal service, by electronic mail with written consent, by mail or by
delivering the same to, and leaving it with, some person of responsibility on the premises. For
unattended or abandoned locations, a copy of such notice of violation shall be posted on the
premises in a conspicuous place at or near the entrance to such premises and the notice of
violation shall be mailed by certified mail with return receipt requested or a certificate of
mailing, to the last known address of the owner, the owner’s authorized agent, or occupant.

110.4.1 Violations Penalties. Any person who violates a provision of this code, fails to comply
with any of the requirements of this code, or erects, installs, alters, repairs or does work in
violation of the approved construction documents, a directive of the fire code official, or a permit
or certificate issued under provisions of this code commits a civil infraction as defined in
Springfield Municipal Code section 5.602. Any person responsible for a civil infraction may be
cited under the procedures provided for Civil Enforcement of Code Infraction in Springfield
Municipal Code sections 5.600 through 5.626. Where provisions of this code conflict with

provisions of the Springfield Municipal Code sections 5.600 through 5.626, this code will
prevail. In addition, any person who commits a violation as described in this section may be
subject to an injunction or temporary restraining order and fines, including the recovery of
expenses through Circuit Court, and/or shall be assessed a fine as provided in ORS 476.990.
Exception: Where other penalties for specific violations are provided for by law, they
shall prevail; see ORS 476.990 and ORS 480.990. Amended
110.4.3 Reinspection fee – Any responsible person who fails to abate or correct an identified
violation or hazard by the reinspection date may be subject to a reinspection fee. The fee for
reinspecting an uncorrected or unabated violation or hazard shall be assessed as provided in the
City of Springfield Master Fees and Charges Schedule. Added
CHAPTER 2
DEFINITIONS
SECTION 202
GENERAL DEFINITIONS
CARNIVAL. A mobile enterprise principally devoted to offering amusement or entertainment to
the public in, upon or by means of portable amusement rides or devices or temporary structures
in any number or combination, whether or not associated with other structures or forms of public
attraction. Added
EXHIBITS AND TRADE SHOWS. An event in which products, goods, services or
information is displayed. Added
FAIR. An enterprise principally devoted to the exhibition of agriculture or industry in
connection with the operation of amusement rides or devices, or concession booths. Added
FIRE CODE OFFICIAL. The Eugene Springfield Fire Marshal, or duly authorized
representative, is designated as the approved authority for exercising functions relating to fire
prevention, fire safety measures and the administration and enforcement of the code. Amended
INERTING. The act of reducing the concentration of oxygen to a level insufficient to support
combustion. For the purposes of flammable liquid tanks and containers, oxygen concentration
below 10% is considered inert when using an oxygen meter to measure oxygen concentrations
or, if a combustible gas indicator is used to measure the reduction in the concentration of
flammable vapors, less than 20% of the Lower Flammable Limit of the product will be
considered adequate. Added
OPEN BURNING. The burning of materials wherein products of combustion are emitted
directly into the ambient air without passing through a stack or chimney from an enclosed
chamber or as regulated by Lane Regional Pollution Authority. Open burning does not include
road flares, smudge pots and similar devices associated with safety or occupational uses typically
considered open flames or recreational fires. For the purpose of this definition, a chamber shall
be regarded as enclosed when, during the time combustion occurs, only apertures, ducts, stacks,

flues or chimneys necessary to provide combustion air and permit the escape of exhaust gas are
open. Amended
PERFORMANCES WITH FIRE. Any act in a public or private place other than inside a
private residence, that utilizes fire for entertainment purposes, outside of a protective housing or
in ways in which it travels through the air (by one person or between multiple persons),
including but not limited to fire juggling and fire eating, but not including pyrotechnics. Added
PERSON RESPONSIBLE/RESPONSIBLE PERSON. An agent, occupant, lessee, tenant,
contract purchaser, owner, permit holder, facility owner, person in charge of the building or
property, the person who caused the violation to come into existence, the contractor or employer
of the person who caused the violation, or other person in possession or control of the facility or
hazardous materials, or of a facility at which hazardous materials are located. Added
PRE-INCIDENT PLAN. A document developed by gathering general and detailed data to be
used by responding personnel in effectively managing emergencies for the protection of
occupants, participants, responding personnel, property, and the environment. Added
PROTECTED PROPERTY. Any structure, place or thing customarily occupied by people
including "public buildings" as defined by ORS 479.168 and forestland as defined by ORS
477.001. See ORS 164.305. Added
QUALIFIED PERSON OR COMPANY. A competent and capable person or company that
has met the requirements of the Fire Code Official, which may include written tests, field testing
or acceptable formal training for a given field, such as but not limited to water based fire
protection systems, commercial kitchen hood suppression systems, fire alarm and detection and
hazardous materials protection and detection systems. Added
RECREATIONAL FIRE. A small fire no larger than 3 feet in diameter and 2 feet in height,
limited to cooking fires, campfires, and fires lit in Chimineas, patio fireplaces, fire pits, or other
similar devices using charcoal, natural gas, propane, manufactured firelogs, or clean dry natural
firewood as fuel, and which occurs in designated areas on public lands or on private property,
and not used as a disposal fire for waste materials, including woody yard trimmings, leaves, and
grass clippings. Amended
RED FLAG WARNING. A forecast warning issued by the United States National Weather
Service to inform area firefighting and land management agencies that conditions are ideal for
wildland fire ignition, and rapid propagation. After drought conditions, and when humidity is
very low, and especially when high or erratic winds which may include lightning are a factor.

3. Use or operation of torches and other devices, machines or processes liable to start or
cause fire in or on wildfire risk areas.

EMERGENCY PLANNING AND PREPAREDNESS
SECTION 403
Emergency Preparedness Requirements
403.11.6 Buildings containing active or passive smoke control. An approved fire safety and
evacuation plan in accordance with Section 404 shall be prepared and maintained for any
building containing an active or passive smoke control system. Added

403.11.7 Structures with explosion venting or prevention systems. An approved fire safety
and evacuation plan in accordance with Section 404 shall be prepared and maintained for any
structure required to have explosion (deflagration) venting or explosion (deflagration) prevention

Pre-Incident Plans (Added)
408.1 General. Where required by the fire code official, a pre-incident plan shall be submitted in
accordance with Section 408.2 Added
408.2 Fire Department pre incident plans. Pre-incident plan submittals shall comply with the
following:
1. Where required by the Fire Marshal, an electronic file of the occupancy, structure,
development or facility shall be submitted to the fire department for pre incident
planning purposes. The electronic file must conform to the specifications as
described by the fire department. The electronic submittal must be received and
approved by the Fire Department as a condition of the Fire Department
recommendation that the Building Official approve occupancy. Added

FIRE SERVICE FEATURES
Section 507
FIRE PROTECTION WATER SUPPLIES
507.5.7 Fire Hydrant Specifications. Fire Hydrants shall be approved by the fire code official
and meet the following specifications: Fire hydrants shall be compression type in conformance
with Al/I/WA C502. Hydrants shall have two 2 ½ -inch hose nozzles with National Standard
threading (7 1/2 threads per inch) and a 5 inch integral Storz pumper port. The hydrant main
valve opening shall be 5 ¼ inches. Inlet connections shall be 6 inches. Hydrants shall have a 1 ½
-inch pentagonal operating nut, which opens the hydrant when turned counterclockwise. Seals
shall be O-ring throughout. Hydrants shall be designed as traffic models with a safety breakaway
flange. Depth of bury shall be as noted on the Plans. The center of a hose outlet shall be not less
than 18 inches (457 mm) above final grade or, where located in a hose house, 12 inches (305
mm) above finished floor. Acceptable fire hydrants include any of the following models:

507.5.7.1 Fire Hydrant Extensions. Extension assemblies for fire hydrants shall be supplied by
the manufacturer of the hydrant for which the extension is required. Added

Section 510
Emergency Responder Radio Coverage
510.1 Emergency responder radio coverage in new buildings. All new buildings, as described
in Section 510.1.1, shall have approved radio coverage for emergency responders within the
building based on the existing coverage levels of the public safety communication systems
utilized by the jurisdiction, measured at the exterior of the building. This section shall not require
improvement of the existing public safety communication systems. Approval of a wired
communication system must be documented on OSSC Form 918 in accordance with Section 918
OSSC.
Exceptions:
1. Where permitted by the fire code official and approved by the building official, a
wired communication system in accordance with Section 907.2.12.2 shall be
permitted to be installed or maintained instead of an approved radio coverage
system.
2. Where it is determined by the fire code official that the radio coverage system is
not needed.
3. In facilities where emergency responder radio coverage is required and such
systems, components or equipment required could have a negative impact on the
normal operations of that facility, the fire code official shall have the authority to
accept an automatically activated emergency responder radio coverage system.
4. Where the facility is approved by the fire code official for participation in the
City’s mobile emergency responder radio coverage (MERRC) program.

CHAPTER 9
FIRE PROTECTION SYSTEMS
SECTION 901
GENERAL
901.5 Installation acceptance testing. Fire detection and alarm systems, emergency alarm
systems, gas detection systems, fire extinguishing systems, fire hydrant systems, fire standpipe
systems, fire pump systems, private fire service mains, smoke and heat ventilators, smoke-
removal systems, hazardous materials protection and detection systems, and all other fire
protection systems and appurtenances thereto shall be subject to tests as contained in the
installation standards and as approved by the fire code official. The fire code official shall be
notified before any required acceptance testing. Amended
901.5.2 System Plans and Specifications. Fire detection and alarm systems, fire extinguishing
systems, fire hydrant systems, fire standpipe systems, fire pump systems, private fire service
mains and all other fire protection system plans and specifications shall be readily available on
the premises. Notation of the precise location of the plans and specifications shall be affixed to
the device control panel or major component. Plans and specifications shall consist of the
complete construction submittal that was approved by the code official of the jurisdiction of the

installation except that any drawings will be as-built drawings delineating actual installation
details that are present at system acceptance. Added
901.6 Inspection, testing and maintenance. Fire detection and alarm systems, emergency alarm
systems, gas detection systems, fire extinguishing systems, fire hydrant systems, fire standpipe
systems, fire pump systems, private fire service mains, smoke and heat ventilators, smoke-
removal systems, hazardous materials protection and detection systems, and all other fire
protection systems and appurtenances thereto shall be maintained in an operative condition at all
times, and shall be replaced or repaired where defective. Maintenance and repairs shall be done
by a qualified person. Non-required fire protection systems and equipment shall be inspected,
tested and maintained or removed. The responsible party bears the burden of proof to show that
an installed system is non-required and may be removed. Single- and multiple-station smoke
alarms and carbon monoxide alarms installed in Group R-1 and R-2 occupancies shall also be in
accordance with NFPA 72, ORS 90.325 and ORS 479.295. Amended
901.6.3 Records. Records of all system inspections, tests, and maintenance required by the
referenced standards shall be maintained on the premises for a minimum of 3 years and service
contractors shall send reports of inspections and tests to the Eugene Springfield Fire Marshal's
Office section within 30 days of performing the inspection and test. Amended
901.6.4 Excessive False Automatic Fire Alarm Activation. Activations of a fire alarm system
that result in the fire department arriving at the occupancy of alarm in excess of three (3) false
alarms in a one year period may be cited under the provisions of 110 of this code. Added.

ENERGY SYSTEMS
SECTION 1203
EMERGENCY AND STANDBY POWER SYSTEMS
1203.4.3 Records. Records of the inspection, testing and maintenance of emergency and standby

3103.2 Approval required and compliance. Tents and membrane structures having an area in
excess of 1500 square feet or an occupant load of 50 or more, or multiple tents with an aggregate
area in excess of 1500 square feet shall not be erected, operated or maintained for any purpose
without first obtaining a permit and approval from the fire code official and must comply with
the provisions of this chapter. Tents and membrane structures having an area of 400 square feet
to 1500 square feet do not require a permit prior to erection, operation or maintenance, but must

5001.5.2 Hazardous Materials Inventory Statement (HMIS). Where required by the fire code
official, an application for a permit shall include an HMIS, such as Superfund Amendments and
Reauthorization Act of 1986 (SARA) Title III, Tier II Report, or other approved statement. The
HMIS shall include the following information:
1. Product name.
2. Component.
3. CAS - Chemical Abstract Service Number.
4. Location where stored or used.
5. Container size.
6. Hazard classification.
7. Amount in storage.
8. Amount in use - closed systems.
9. Amount in use - open systems.
10. NFPA 704 classification.

GENERAL REQUIREMENTS
5003.2.6 Maintenance. In addition to the requirements of Section 5003.2.3, equipment,
machinery and required detection and alarm systems associated with hazardous materials shall be
maintained in an operable condition. All safety control systems at a facility shall be maintained
in good working condition and tested not less frequently than annually. Maintenance and testing
shall be performed by persons qualified to perform the maintenance and tests. Maintenance
records and certifications shall comply with 901.5 and 901.6.3. Defective containers, cylinders
and tanks shall be removed from service, repaired or disposed of in an approved manner.
Defective equipment or machinery shall be removed from service and repaired or replaced.
Required detection and alarm systems shall be replaced or repaired where defective. Amended

5704.2.14.1 Removal. Removal of above-ground and underground tanks shall be in accordance
with all of the following:
1. Flammable and combustible liquids shall be removed from the tank and
connected piping.
2. Piping at tank openings that is not to be used further shall be disconnected.
3. Piping shall be removed from the ground.
Exception: Piping is allowed to be abandoned in place where the fire code official
determines that removal is not practical. Abandoned piping shall be capped and
safeguarded as required by the fire code official.
4. Tank openings shall be capped or plugged, leaving a 1/8-inch to 1/4-inch-
diameter (3.2 mm to 6.4 mm) opening for pressure equalization.
5. Tanks shall be purged of vapor and inerted prior to removal. The inerted tank
environment shall be monitored by an explosive meter during the removal of the
tank.
6. All exterior above-grade fill and vent piping shall be permanently removed.

Appendix C, Footnote b to Table C105.1 of the OFC is amended to provide:
b. Where streets are provided with median dividers which cannot be crossed by firefighters
pulling hose lines, or where arterial streets are provided with four or more traffic lanes and have
a traffic count of more than 20,000 vehicles per day, hydrant spacing shall average 500 feet on
each side of the street and be arranged on an alternating basis up to a fire-flow requirement of
7,000 gallons per minute and 400 feet for higher fire-flow requirements.
