IN REVIEWING THE DESCRIPTION OF TAX LOT #1900, THE DESCRIPTIONS OF TAX LOTS EAST AND WEST OF TAX LOT #1900, DESCRIPTIONS OF TAX LOT #2700,#2800, x�((3000 AND #3100 ALL SOUTH OF TAX LOT #1900, AND PERFORMING r�IELD WORK TO ESTABLISH THE EASTERLY AND SOUTHERLY LINES OF DONATION LAND CLAIM #59 AND THE SOUTHERLY RIGHT-OF-WAY LINE OF FAIRVIEW DRIVE, I FOUND AN APPROXIMATE 2 FOOT OVERLAP IN THE DESCRIPTIONS OF THE NORTHERLY PROPERTIES AND SOUTHERLY PROPERTIES. WHEN PREPARING LAND PARTITION .PLAT NO. 96-PO878, RICHARD HANKINS ALSO DISCOVERED THIS OVERLAP IN DESCRIPTIONS. A BOUNDARY LINE AGREEMENT WAS PREPARED DURING THIS PARTITIONING PROCESS TO RESOLVE THE OVERLAP ISSUE, IN MY OPINION, JUNIOR / SENIOR RIGHTS WOULD HAVE DETERMINED THE OWNERSHIP OF THE OVERLAP. IN THE FIELD, THERE EXISTS A VARIETY OF FENCE TYPES ALONG THE NORTHERLY BOUNDARY OF THE SOUTHERLY TAX LOTS. THIS APPEARS TO BE THE SITUATION FURTHER EAST AND WEST OF THE SUBJECT PROPERTIES.
