I have received your letter regarding your involvement in the subject property. As you
will recall, our position has been that the entire fire damaged portion of the structure must
be repaired before it will be considered safe to occupy. By "occupy'', we mean any use
permitted by the building codes, including storage. The damaged structure must be
completely repaired or demolished in order to comply with the building safety
requirements of the City of Springfield.
When we met at the customer service counter, my interpretation of the above requirement
was that we needed a permit for repair of the entire damaged portion of the building, not
just for partid repair. After reviewing your letter with the Building Official, it appears
that we can issue a permit for the work your company did. The following conditions for
obtaining the permit will apply:
l. The repair work must be reviewed by a licensed design professional (engineer or
architect) who must determine whether the repair is structurally sound and stable,
and will not contribute to the instability or diminish the structural integrity of the
remainder of the structure, including the remaining damaged areas. Any
corrections required by the design professional or by the City building inspector
must be made before final approval of the construction will be granted.
2. Permits and inspection approval of the partial repair work done by your company
will not constitute, or be construed as, authorization by the City for the owners to
occupy the damaged portion of the building for any purpose.
3. The new owners must provide this office with a statement that they understand
the forgoing requirements and will comply, by either obtaining additional permits
to repair the damaged structure within a reasonable time, and maintain the
separation between the damaged and undamaged portions of the building until
repairs are made, or obtain permits to demolish the damaged structure.
We cannot condone your actions, in attempting to do the repairs without proper permits
or inspection approvals. However, we do not want to deny you a building permit to bring
the work that was done into compliance with the Building Safety Codes. At the same
time we do need to assure the entire building will be safe, and brought into code
compliance.
Please provide us with a verifiable copy of the bill showing the amount you charged for
the work. This will be used to determine the value of constuction for the building permit
and associated investigation fee.

I have been involved in a lawsuit for some time conceming which I have visitect with you oncebriefly. I have been advised by my attomey to approach you once again.

sketch of the issue. The lawsuit actually involves the buyer of thii property iuingine sellers andthe Realty Company involved. My company was thrown in as the iuit kind of toof a shot-gun
approach and hit anyone within range.
I was originally askedto do a Pest & Dryrot lnspection on the property and provide this toMortgage Market. This was done and d-elivered. There is no legitimate excuse for having done the job without proper permits, etc. My motivation
however was not for profit-the job was done as inexpensively as possible. lt was done as a favor
because the people involved really needed a hand'. I never expected to be involved in a suit
over something I had nothing at all to do with. After having paid attomeys fees for months, I am
told that the opposing attomey would allow me to exit this whole thing if I can get the end wall
permitted. What was tom down was the bulk of the fire damage. The new wall was built under
an existing glue-lam beam which was still in good structural condition. The job was paid for out of
the sellefs proceeds. The buyer did not have a single dollar invested to my company.
Can you tell me if there is any way that I can get this accomplished? I am coming under quite a
lot of pressure at this time over this issue. There is no plumbing or electrical involved.
Structurally, there was only the end wall-nothing else.

The above referenced real property was purchased, not knowing that the sanctuary
structure portion had been condemned. We have been unable to procure hazard insurance
on the property. We are attempting to find a way to work with the City of Springfield in
order to meet the necessary requirements to remove the condemned status, either
temporary or permanently, of said property, and convince an insurance company to insure
this property.
Please consider this a request for information pertaining to the above referenced property:
