RE: Non-Conforming Status of 375 ll2 N. lTth Street
Dear Ms. Whitaker,
I have considered the letter and phone records submitted as proof that the second residence at 375 l/2 N.
l Tth Street existed prior to the application of a single family residential zone for that area of Springfield.
The letter of Mr. Oddie Maddox and the phone records consistently place the construction of the structure
in the 1940s. The area was first zoned single family residential in 1939. Given the amount of time that has
passed, the number of letters submitted and the close proximity of recollection to the zoning
implementation date, I am inclined to accept the information as reisonable proof that the use existed on or
before 1939. Subsequently, I find sufficient cause to acknowledge the non-conforming use status of the
properfy. The designation of legal nonconforming use status is subject to provisions and limitations of
Springfield Development Code Article 5, consistent with the provisions of the original codes of 1939.
Please refer to the attached Article 5 for future maintenance and improvements. I encourage the owner(s)
of any legal nonconforming use to apply for proper addressing from the City to avoid future confusion.
As a general policy the City does not issue l/2 addresses. A full address can be acquired by requesting a
change of address from the Building Division. Please retum the enclosed application to the attention of
Lisa Hopper. For more address information contact Ms. Hopper at726-3790.
Separate electrical metering for the existing second unit is not considered an expansion of use and is
allowable as maintenance activities in accordance with SDC Article 5. Improvements are subject.to all
other applicable City and State permit procedures and an electrical permit application can be re-submitted
to the Building Division at your convenience.
