The letter sent on April 19, 2004 is detailed in discussion of the requirement for one hour
exterior walls. The building will be completed and occupied in August of 20A4. The new
code will be adopted in October of 2004. The exterior non-bearing walls are allowed to
be non-combustible when the new code is adopted. ln light of these facts, the exterior
walls are only non-compliant for all of three months. The bottom line is that we are
seeking approval for the exterior non bearing walls to be constructed as non-combustible
construction as allowed under the new code. Thank for your consideration and attention

Dear John:
On Friday April 1 ,2OO4l attended a site meeting and noticed that the upper framed
sections iabove the block) of the North and South Walls were not being constructed to
meet one hour construction requirements. After review of the drawings I noticed that the
plans were submitted and approved with these walls indicated to be constructed to meet-
only meet non- combustible requirements rather than one hour construction
r"qrir"r"nts. The drawings atso indicate that these walls will be constructed to meet
two hour construction requirements when the future phases are completed.
Last week I spoke with Mick Nolte from Mortiers'office about the construction
requirements of these walls when the new code is adopted in the fall of this year. Mick
informed me that when the new code is adopted, the construction requirements for
these walls wilffron-combustib]e only, not one hour, as is required by the current code.
ln light of this information, I would like these walls andJhe also the East exterior wall to
be constructed as non-combustible walls rather than one hour walls. ln reviewing this
request please consider the following:

These walls are temporary. The North and South walls will ultimately be removed
and reconstructed to meei 2-hour occupancy separation requirements when the
additional buildings are built. The East watlwill ultimately be torn down when the
front of the building is exPanded.
We would seek to have this first phase of the building re-classified as an A-3
occupancy and have a posted occupant load of 299 people. There are fewer
occupanti using this portion of the building than was originally calculated since the
submitted calculations assumed an occupant load for the Lounge as would be
calculated for the full build-out. The re-classification of the center section of the
buitding for this phase of the work would allow for these temporary walls to be
constructed to meet Type ll-N requirements. When the future phases are
constructed we would have this section classified as Type ll - One hour construction
Other than the proposed changes to the North, South and East exterior walls, all

other construction would remain the same. The occupant limit would be posted by
the Fire Marshal.
3. The new code, when it is adopted in October of this year would allow these non-
bearing exterior walls to be constructed to meet Type ll-N construction. The new
code acknowledges and gives proper credit for sprinkled buildings. lt is logicalto use
the new code interpretation to this building. I have included the new tables for your
review.

reference.
NOW, THEREFORE, City and Development Applicant agree that the System Development
Charge will be paid in accordance with the following terms and conditions:
1. DESCRIPTION OF PROJECT: FIRST PHASE OF BRoADBASE SPORTS
CENTER GOilPLEX: ROLLER HOCKEY RINK, W|TH FOYER' DRESSING
ROOiiS, REST ROOiiS, MECHANTCAL ROOiiS, AN OFFICE, EQUIPiIENT
RecrRls:
WHEREAS, the City of Springfield, pursuant to Oregon Revised Statutes 223.297, et seq.,
,,System Development Charges," has enacted, "System Development Charges," of the Springfield
MunicipalCode; and
WHEREAS, the purpose of the System Development Charge is to impose an equitable
share of the public cost of capital improviments upon the activity of development that creates the
need for or increases the demands on such capital improvements; and
WHEREAS, Section 3.412(1) of the Springfield Municipa! Code provid.es for the payment of
a System Development Charge atine time of the issuance of a building permlt approval of
devllopment appiication for divelopment not requiring the issuance of a building permit, or a
permitio connect to water, sanitary Sewer, or storm sewer systems; and
WHEREAS, Section 3.412(3) of the Springfield Municipal Code provides that the City
Manager or the Manager's designee may require payment in full or that provision for payment
satisfactory to the City has been made; and
WHEREAS, Section 3.412(4) of the Springfield Municipal Code provides that any provision
for payment satisfactory to the City which includes providing an obligation to pay the unpaid
System Development iharge and interest thereon, shall be secured by property, bond, deposits,
letter of credit, deferred payment agreement, or other security acceptable to the City Manager or
the Managefs designee; and
WHEREAS, City through Resolution No. 93-25 has implemented a program providing for
the opportunity for Development Applicant to defer System Development Charges; and
WHEREAS, Development Applicant has requested defenal of the System Development
Charge for the above-referenced development project in the manner hereinafter stated.

. (a) The sum of $ 10,000.00 (TEN THoUSAND AND NO/100 DOLLARS) is tobe paid at the time the city issues the initial buiioing permit.
(b) - The sum of approximatety 9i62,6i8.24 (ONE HUNDRED SIXTY TWOTHOUSAND SIX HUNDRED EIGHTEEN AND 7ry100 OOIURS) is to Oe paiA at the completionof construction as determined by the City. City will notify Development Appiicant that the paymentis due.
(c) ln the event that Develo?ment Applicant fails to make the payment requiredby-subparagraph (1), the City will not issue a Eiuilding Occupancy Permit or other approval asdefined in Section 3.412 of theSpringfield Municipalbode. !n th-e event Devetopment Applicantfails to make the payment required by subparagriph (b), no final occup"*v rpp.vatwillbe
issued.
(d) .Development Applicant shall have the right to prepay the obligations set forthin this contract in whole or in part at any time without penalty.
(e) Notwithstanding anything contained herein to the contrary, Development
Applicant's obligation to pay the System Development Charges specified in paiagraph 2 shall
apply only in the event that construction of the development prolect is substantially completed. !n
the event that the preceding condition is not satisfied, for any reason whatsoever,-Develbpment
Applicant shall have_ no obtigation to pay any System Development Charge to the City of
Springfield and shall be released of any and all obligations under this agrlement and the City of
Springfield shall execute a document evidencing the termination of thisigreement, as described in
Paragraph 5 below.
4. WAIVER: ln consideration for the deferral of System Devetopment Charge set forth
in this agreement, l/we expressly waive any and all errors, inegutarities or defects,lurislictional or
otherwise, regarding the System Development Charge, including specifically but not limited to
erors, inegularities, or defects, if any, in the computation of or underlying methodology of the
charge.
ROOM AND STORAGE. INGLUDES ENITRE PARKING PLAN WITH
LANDSCAPING.2. SYSTEM DEVELOPMENT CHARGE: $172,618.74
3' DEFERRED PAYMENT SCHEDULE: The System Development Charge specifiedin.Paragraph 2 shalt be paid by the Development Applicant in accoroanice with thefollowing schedule:
5. DURATION: This agreement shallcontinue in perpetuity. This agreement is
intended to and does attach to and run with the land affected herein. This agreement is binding on
the undersigned landowner(s), ROY G. GRAY, JR., person(s) claiming under it. lt is the intent-of
ROY C. GRAY, JR.,, land owner(s), to create a continuing obligation and right on the part of
themselves and subsequent owners of the subject land. The fee is a personal obligation of the
owner of the land on which the development is made and the owne/s heirs and assigns, with
payment of part of or all of the obligation by any of them reducing the obligations of the others by
the amount of the payment. Notwithstanding the foregoing, this agreement shall terminate and ihe
restrictions, terms and provisions contained herein shall cease to affect the real property described
in Exhibit'A' hereto in the event that the System Development Charges specified in Paragraph 2
hereof are paid in full. Upon the occurence of the preceding condition, the City of Springfield shall
exectrte a document reasonably requested by Development Applicant evidencing the termination
of the agreement, which document shall be recorded at Development Applicant's expense by the
City of Springfield at Lane County Deeds and Records ffice.
6. ilIODIFICATION: Neither the owners nor their successors in interest may modify,
withdraw from or dissolve this agreement without the written approval of the City of Springfield.
7. LIEN: Development Applicant agrees that in the event that Development Applicant
fails to pay the System Development Charge as required by the terps and conditions of this
agreement, City, in addition to the other remedies specified herein, may place a lien in the amount
of the System Development Charge not paid in conformance with the deferred payment schedule
set forth in Paragraph No. 3, as specified in this agreement, upon the real property upon which the
project is constructed, and that such lien may be foreclosed by the City of Springfield in
accordance with the procedures set forth in Oregon Revised Statutes 223.505 et. Seq. and City of
Springfield lien foreclosure procedures as set forth in the Springfield Municipal Code.
8. The real property on which Development Applicant will construct the project is more
particularly described and set forth in Exhibit "A", which is a legal description of the subject
property and is attached to and part of this agreement.

g. ATTORNEYS' FEES: lf there is any legal action or proceeding between the parties
hereto arising from or based on this agreement, the unsuccessful party to such action or
proceeding shall pay to the prevailing party all reasonable costs and expenses, including
ieasonable attorneys'fees and disbursements, incurred by such prevailing party in such action or
proceeding and in iny appea! in connection herewith. lf such prevailing party recovers a judgment
in any such action, proceeding, or appeal, such costs, expenses, and attorneys'fees and
disbursements shall be included in and as a part of such judgment.
