Planning Approvals Required for Borden Chemical Tank Repairs
Assessor Map 17-03 -35-32, Tax Lot 5400
Dear Mr. Gillespie,
The City of Springfield Planning Supervisor and Deputy Fire Marshall have reviewed
your plans to replace the failed clay liner under the phenol tanks located on Tax Lot
5400. Tax Lot 5400 is zoned Light Medium Industrial. Two tanks have been removed
by Borden. The remaining two tanks are for storage of refined flammable liquids, a use
not permitted in the Light Medium Industrial District. Therefore the tanks are a non-
conforming use in the zone.
Article 5 of the Springfield Development Code NON-CONFORMING USES regulates
the continuance of non-conforming uses. Section 5.030(1) specifies that maintenance
and repairs may be performed on non-conforming uses where the cost of repair does not
exceed 50% of the replacement value of the use. Section 5.030(2) specifies that a non-
conforming use may be brought into compliance with Building Safety Codes. Based on
the plans that you have submitted to me, it appears that your proposal to replace a
substandard clay liner with a new concrete liner of essentially the same dimensions, and
the addition of safety monitoring equipment, is consistent with Section 5.030.
Tax Lot 5400 is also within the Willamette Greenway. Development in the Greenway
requires review by the Planning Commission when there is an intensification of use or
construction that has a visual impact. The facts that two tanks have been removed and
the replacement liner will be essentially identical in dimensions to the clay liner indicate
that there will not be an intensification of use that will result in greater visual impact than
already exists. In fact, the visual impact has been greatly reduced by the removal of two
tanks. In addition, you have agreed to intensify the landscaping along the Willamette
River abutting the tanks to further reduce the visual impact and ensure the stability of the
bank.
Therefore, no planning review or permits for your maintenance and repair work on this
project is required by the City of Springfield Planning Division.
