Dear Mr. Bork:
Thank you for the photographs showing the problem area of your lot. I discussed the
matter with Bob Barnhart, the building inspector for the neighboring property to the
south. He has already informed the developer that they will be required to install a
"French" drain along the fence line between their property and yours. This shorrld
prevent any water from migrating onto your property in the future. It will drain instead to
the street gutter through the new drain. It is my understanding that the developed
preperty will not be given occupancy approval until this matter is resolved to the building
inspector' s satisfaction.

regarding this matter.

PASSED IF PERHAPS, T}IE GRADE WAS INCORRECT TO ALLOW PROPER
DRAINAGE? I DO NOT FEEL THAT HAYDEN GARDENS PLACING 2 X 6'5
ALONG TTM BOUNDRY CONSTITUTES A PRACTICAL IUETHOD OF WATER
DIRECTION. IT IS ONLY SUMMER AND WITH ruST A SPRINKLER SYSTEM IN
PLACE I HAVE STANDING WATER POOLING ALONG THE FENCE AND RUN.

I AM GREATLY CONCERNED ABOUT THIS SITUATION AND WOULD LIKE
TO SEE IT RESOLVED QLUCKLY. I AM NOT AWARE , OF COURSE, OF ALL
THE CODES AND RULES REGARDING DRAINAGE AND RELATED ISSUES,
BUT I HARDLY FEEL IT IS THE RESPONSIBILITY OF THE HOMEBUYER TO
PROVIDE PROPER RTIN.OFF MEASURES. I WOULD THINK TFM CONTRACTOR
HAS THAT RESPONSIBILITY.
