WRITTEN STATEMENT
In accordance with Property Line Adjustment submittal requirements, this written statement describes the
proposed development and demonstrates that the proposal complies with the requirements and criteria
contained in SDC 5.16-105 through 5.16-125.
LAND USE REQUEST
A. Development Objective
The applicant's development objective is to
develop the Weyerhaeuser WTL (Western
Timber Lands) Regional Office.
Accomplishing this objective will require City
of Springfield approval of a Property Line
Adjustment.
The regional office facility will occur on Tax
Lot 500 and a portion of Tax Lot 700 (both
owned by Wildish Industrial Development
Corp.) and a portion of Tax lot 1200 (currently
owned by the City of Springfield). Upon
completion of the Property Line Adjustment
process, the application will shift:
The southerly boundary of Tax Lot 500 to
encompass a portion of Tax Lot 700;
The easterly boundary and a portion of
the northerly boundary of Tax Lot 500 to
encompass part of Tax Lot 1200;
The westerly boundary of Tax Lot 500 to
provide a connection for Tax Lot 700 to
Newman Street; and
The easterly boundary of Tax Lot 700 to
encompass part of Tax Lot 1200.

II. THE SITE AND EXISTING CONDITIONS
A. Development Site
Comprised of the three referenced tax lots, the development site is located at the southwest
comer of McVay Highway (a minor arterial) and Nugget Way (a Lane County local access road).
Tax Lots 500 and 700 are owned by the Wildish Industrial Development Corp. Tax Lot 1200 is
owned by the City of Springfield. The development project itself will utilize all of the existing TL
500 and a portion of the existing TLs 700 and 1200. Once this serial property line adjustment is
complete the development will be solely on an adjusted TL 500, with the remaining adjusted TL
700 to the south and the remaining adjusted TL 1200 to the east. Ownership of the portion of TL
1200 adjusted into TL 500 and 700 will be transferred to Wildish while the City will retain
ownership of the remaining portion of TL 1200. The enclosed plan set illustrates this serial
property line adjustment situation.
III. PROPERTY LINE ADJUSTMENT - REQUIREMENTS, CRITERIA AND RESPONSES
This section is presented in the same order of applicable requirements found in Section 5.16-105
through 5.16-125, Property Line Adjustments, of the Springfield Development Code. Applicable
sections of the Code are in bold italics, followed by applicant responses in normal text.
5.16-105 Purpose and Applicability
A. These regulations are intended for the review of Property Line Adjustments and are
separate from Lane County Deeds and Records lot/parcel consolidation policies. A
Property Line Adjustment is the relocation of a common boundary between 2 abutting
properties. A Serial Property Line Adjustment is the relocation of more than 1 common
property line involving 2 or more abutting properties. Serial Property Line Adjustments
can be reviewed individually or combined in a single application as specified in Section
5.16-115.
Response: The requested property line adjustment is a serial property line adjustment to relocate
the common property lines of Tax Lot 500, 700, and 1200. As noted above, the application will
shift:

• The southerly boundary of Tax Lot 500 to encompass a portion of Tax Lot 700;
• The easterly boundary and a portion of the northerly boundary of Tax Lot 500 to encompass
part of Tax Lot 1200;
• The westerly boundary of Tax Lot 500 to provide a connection for Tax Lot 700 to Newman
Street; and
• The easterly boundary of Tax Lot 700 to encompass part of Tax Lot 1200.
The applicant requests that the serial property line adjustments be processed as a single
application per SDC 5.16-115. Therefore, this standard is met.
B. Property Line Adjustments may occur within a recorded Subdivision or Partition, as
specified in this Section, as long as the adjustment is not a reconfiguration of or an
increase or decrease of the number of lots in a Subdivision. In this case, the Replat review
process specified in Section 5.12-165 applies.
Response: This property line adjustment request is not within a recorded Subdivision or Partition
and is not a reconfiguration of or an increase or decrease in the number of lots. Therefore, this
standard is not applicable.
5.16-110 Special Situations
A. Where the elimination of a lot/parcel line is desired within the boundary of a recorded
Subdivision or Partition, the following options are available:
1. A Rapist shalt be processed as specified in Section 5.12-165; or
2. A Plat Vacation shall be processed as specified in Section 5.20-100.
Response: This proposal is not within a recorded Subdivision or Partition. Therefore, this
standard is not applicable.
B. Where a property owner desires to construct a building over a common property line, and
there are no easements abutting the property line, ora primary structure is proposed on 1
lot/parcel and a secondary structure is proposed on the other, the Director may require a
deed restriction during the building permit and/or Site Plan Review process that allows the
construction of these structures. The lots/ parcels under the deed restriction shall be sold
as 1 unit of land, unless the structures are removed.
Response: This proposal does not include the construction of a building over a common property
line. Therefore, this standard is not applicable.
C. The allocation of vacated public right-of-way to abutting properties as specified in ORS
271.140 and processed as specified in Section 5.20-100 or a sale or grant of public right-of-
way by the City as specified in ORS 92.010(7)(e) shall not be considered to be a Property
Line Adjustment and thus shall not be subject to the provisions of this Section.
Response: This proposal does not involve the allocation of vacated right-of-way. Therefore, this
standard is not applicable.
D. A Property Line Adjustment will not remove, relocate or replace any public easements on
the lots/parcels.
Response: This specific application does not remove, relocate or replace any public utility
easements. The enclosed plan set does show some PU Es to be vacated and some to be
dedicated, but these vacations and dedications will be processed as specified in Section 5.20-100
at a later date. Therefore, this standard is met.

5.16-115 Review
A. Single Property Line Adjustments are reviewed under Type I procedure.
Response: This application is for serial property line adjustments. Therefore, this standard is not
applicable.
B. Serial Property Line Adjustments may be combined into a single application. If the latter
occurs, serial Property Line Adjustments are reviewed under Type II procedure.
Response: The requested property line adjustment is a serial property line adjustment to relocate
the common property lines of Tax Lot 500, 700 and 1200 and will be reviewed under the Type II
procedure. Therefore, this standard is met.
5.16-120 Submittal Requirements
A. A Preliminary Survey shall be prepared, stamped and signed by an Oregon registered
Land Surveyor. The format of the Preliminary Survey and the data to be shown shall be as
follows:
1. The Preliminary Survey shall be drawn in compliance with ORS 92.
2. The scale shall be appropriate to the area involved and the amount of detail and data,
normally 1'= 20', 1" = 50' or 1" = 100'.
3. A north arrow, date of preparation and the title which shall include the following
language: "Proposed Property Line Adjustment Survey."
4. The name and address of the property owners, and the applicant, if different.
5. A drawing of the boundaries of the lots/parcehiltrects of land involved, to include
dimensions and square footage calculations.
6. The zoning and plan designation of the lots/parcels.
T The existing property line and proposed property line, clearly differentiated by line
type.
B. The location and outline to scale of all existing structures to include their required
setbacks from the current property lines and those from the proposed property line.
9. The locations, widths and names of all existing streets, alleys, or other rights-of-way
within or adjacent to the lots/parcels and the location and width of driveways.
10. The location of all public and private easements and utility lines within or crossing the
lots/parcels. For properties outside the city limits but within the City's urban service
area, septic and drain fields shall be shown.
11. Reference to the recorded Subdivision or Partition by name or reference number and
blocks, lotparcel numbers, where applicable.
Response: The Tentative PLA plans have been prepared, stamped, and signed by an
Oregon registered land surveyor. The plans include all of the above requirements. See
attached plan set. Therefore, this standard is met.
B. The following additional information shall be submitted with the Preliminary Survey:
1. A brief narrative explaining reason for the proposed Property Line Adjustment and the
existing use of the lotslparce/s.
2. A copy of the current deeds for the lots/parcels.
3. If the applicant is not the property owner, written permission from all property owners
is required.
4. For serial Property Line Adjustments reviewed under Type lI procedure, the following
shall also be submitted.,
a. A written explanation of the sequencing of adjustments; and
b. A diagram identifying each adjustment, in sequence.

Serial Property Line Adjustment
Response: This narrative explains the reason for the Property Line Adjustment and current
deeds for the tax lots are attached to this application. The applicant is the property owner of
Tax Lots 500 and 700, but flat Tax Lot 1200. Both property owners (Wildish and the City of
Springfield) have signed the Property Line Adjustment Application acknowledging their
approval of this application. As noted above, the requested property line adjustment is also a
serial property line adjustment to relocate the common property lines of three tax lots; a
diagram of each adjustment is attached. Therefore, this standard is met.
5.16-125 Criteria
The Director shall approve, approve with conditions, or deny the Property Line Adjustment
application. Approval or approval with conditions shall be based on compliance with the
following criteria. The Property line Adjustment shall not.,
A. Create a new IoUparcel;
Response: This property line adjustment request does not create a new lot or parcel. The
number of lots that will exist after the property line adjustment will equal the number of lots that
existed before the property line adjustment. Therefore, this standard is met.
B. Create a landlocked IoUparcel;
Response: This property line adjustment does not create a landlocked lot or parcel. Tax Lots
500, 700, and 1200 currently have frontage on and direct access to an existing public right-of-way
(McVay Highway and/or Nugget Way) and will continue to have frontage fallowing the property
line adjustments. Therefore, this standard is met.
C. Reduce an existing lot/parcel below the minimum size standard or reduce setbacks below
the minimum established by the applicable zoning districts in this Code;
Response: The tax lots included in this development proposal have a base zone of Glenwood
Employment Mixed Use (GEMU). There is no minimum lot/parcel size in the GEMU district;
however, there is a minimum development area of 5 acres. The three tax lots, 500, 700, and
1200 are currently 2.20 acres, 1.96 acres, and 3.26 acres, respectively. Following the property
line adjustment, they will be 2.68 acres, 1.67 acres, and 3.07 acres, respectively. The two
Widish -owned tax lots (500 and 700) total 4.16 acres currently and will total 4.35 acres following
the adjustments. Per 3.4-265(1)(a), a developer can request an exception to the minimum
development area when there are smaller properties that cannot meet the 5 -acre standard for
properties on the west side of McVay Highway. The subject property is on the west side of McVay
Highway and, similar to several properties in the vicinity, cannot meet the minimum development
area of 5 -acres. Therefore, the applicant is requesting an exception to the minimum development
area requirement.
Setback requirements are 10 feet from the build -to -line. Per SDC 3.4-275.H.2.a.i, in Subarea D,
south of the Union Pacific railroad trestle and outside of the nodal development area, a building
may be set back more than 10 feet from the build -to -line to accommodate on-site vehicle
maneuvering and/or visitor parking. The Weyerhaeuser WTL (Western Timber Lands) Regional
Office was granted an exception to this criterion by providing visitor parking between the build -to -
line and the building which is permitted via SDC 3.4-270.G.5.b.i. (See Site Plan Development
Agreement executed on August 21, 2020 (Case 4811-20-000093-TYP2).

D. Violate any previous conditions the Approval Authority may have imposed on the
lots/parcels involved in the application;
Response: A Site Plan Review application was approved for the Weyerhaeuser WTL (Western
Timber Lands) Regional Office (See Case Number 811-20-000093-TYP2). To ensure that the
applicant met all of the terms and conditions of the Site Plan Review, a Development Agreement
was signed August 21, 2020 by Wildish and the City of Springfield. This property line adjustment
does not violate any of the terms or conditions therein. Therefore, this standard is met.
E. Detrimentally alter the availability of existing public and/or private utilities to each
lotlparcel in the application or to abutting lots/parcels; or
Response: Approval of this property line adjustment would not detrimentally alter the availability
of existing public and/or private utilities to each of the subject lots, nor to any abutting lots or
parcels. The following utilities are available to the subject properties:
Stormwater.
• Public stormwater infrastructure is not available to the subject properties. Thus, an on-site
stormwater detention, treatment and infiltration facility will be installed concurrent with
development on Tax Lot 500. Stormwater for Tax Lots 700 and 1200 can be determined at
time of development.
Sanitary
Sanitary infrastructure is adjacent to the site in Nugget Way and McVay Highway.
Water and Electric
• Existing water and electric infrastructure are on and adjacent to the subject sites. There is an
existing 10" waterline in Nugget Way and an existing 8" waterline in McVay Highway.
Fire Protection
• There are two existing fire hydrants near the subject properties. Due to the planned size of
the new building, fire flow needs and distance from the existing hydrants to the new building
on Tax Lot 500, two new fire hydrants are being installed.
Therefore, this standard is met.
F. Increase the degree of non -conformity of each lot, parcel or structure that is
nonconforming at the time of application.
Response: The only non -conforming condition is that the proposed building is a tall one-story
structure (the proposed building will be 22 feet to the top roofline). SDC 3.4-275. D. requires a

minimum building height of 2 stories above grade with a minimum height of 20 feet.); therefore,
the applicant requested an exception to the height requirements for the upper story and an
exception was granted during the Site Plan Review process. Approval of this property line
adjustment does not increase that non -conformity, nor does it create any new non -conforming
conditions. Therefore, this standard is met.

LEGAL LOT LINE ADJUSTMENT DEED (DECLARATION)

This Legal Lot Line Adjustment Deed and Declaration is made between Wildish
Industrial Dev. Corp., owner of the real property described in Exhibit D of that
Declaration of Property Line Adjustment recorded on March 7, 2001 as Reception
Number 2001-012395 in the Lane County Oregon Official Records, herein referred to as
Tax Lot 500, and Wildish Industrial Dev. Corp., owner of the real property described in
Exhibit C of that Declaration of Property Line Adjustment recorded on March 7, 2001 as
Reception Number 2001-012395 in the Lane County Oregon Official Records, herein
referred to as Tax Lot 700.
The purpose of this Deed is to adjust the property boundary line between two legal lots
owned by WildishTndustrial Dev. Corp. and to agree on a revised line separating the
legal lots to comply with the City of Springfield Land Use Regulations and approved on
, 2020 as Journal Number , and the provisions of
Oregon Revised Statutes 92.190(4) as acknowledged hereon. No additional legal lots,
parcels, lots or tracts will be created from this Legal Lot Line Adjustment. This Deed
does not extinguish, combine or vacate any "lawfully established unit of land" as
defined in ORS 92.017.
The legal description of Tax Lot 500 prior to this adjustment is contained in Exhibit A,
attached hereto and made a part hereof.
The legal description of Tax Lot 700 prior to this adjustment is contained in Exhibit B,
attached hereto and made a part hereof.
Whereas: the line being adjusted herein is the entire southerly boundary of said Tax Lot
Soo.
Whereas: Wildish Dev. Corp. does hereby, grant, convey and execute a transfer of
property through means of an approved Property Line Adjustment and this deed the
area between the existing common boundary line and the newly adjusted boundary line.
The true consideration for this conveyance has been previously agreed upon between
the two entities, the receipt of which is hereby acknowledged.
