Applicant Submits a Tree Felling Permit Application to the Development Services Department The application must conform to the Tree Felling Permit Submittal Requirements Checklist on page 4 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Tree Felling Permit Submittal Requirements Checklist have been submitted. - Applications missing required items will not be accepted for submittal 2. City Staff Conduct Detailed Completeness Check Planning Division staff conducts a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided, • Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision • This is a Type II decision and thus is made after public notice, but without a public hearing, unless appealed. • Mailed notice is provided to property owners and occupants within 300 feet of the property being reviewed and to any applicable neighborhood association. In addition, the applicant must post one sign, provided by the City, on the subject property. • There is a 14 -day public comment period, staring on the date notice is mailed. • Applications are distributed to the Development Review Committee, and their comments are incorporated into a decision that addresses all applicable approval criteria and/or development standards, as well as any written comments from those given notice. Applications may be approved, approved with conditions, or denied. The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. The decision issued is the final decision of the City but may be appealed within 15 calendar days to the Planning Commission or Hearings Official. Narrative explaining the proposal and any additional information that may have a bearing in determining the action to be taken, including findings demonstrating compliance with the Tree Felling Permit Criteria as specified in SDC 5.19-125 (see page 4 of this application). NOTE: Before the Director can issue a Tree Felling Permit, information submitted by the applicant must adequately support the request. All of the Tree Felling Permit Criteria must be addressed by the applicant. Incomplete applications, as well as Insufficient or unclear data, will delay the application review process and may result in denial. In certain circumstances, it is advisable to hire a professional planner or land use attorney to prepare the required findings. The Director or the Public Works Director may require the applicant to provide the services of a professional forester (approved by the City), licensed hydrologist, or licensed landscape architect in order to address the standards in SDC 5.19-125 for undeveloped property greater than 10 acres in size or 150/o slope or above an elevation of 670 feet. Revised 1/1/OB May Markarian 4 of 5 5.19-125 Criteria The Director, in consultation with the Public Works Director and the Fire Chief shall approve, approve with conditions or deny the request based on the following criteria: A. Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger of falling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability; volume of surface runoff and water quality of streams; scenic quality; and geological sites. C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. D. In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria. 1. Wooded areas associated with natural drainageways and water areas shall be retained to preserve riparian habitat and to minimize erosion; 2. Wooded areas that will likely provide attractive on-site views to occupants of future developments shall be retained; 3. Wooded areas along ridge lines and hilltops shall be retained for their scenic and wildlife value; 4. Wooded areas along property lines shall be retained to serve as buffers from adjacent properties; 5. Trees shall be retained in sufficiently large areas and dense stands so as to ensure against windthrow; 6. Large-scale clear -cuts of developable areas shall be avoided to retain the wooded character of future building sites, and so preserve housing and design options forfuture City residents. E. Whether the applicant's proposed replanting of new trees or vegetation is an adequate substitute for the trees to be felled. F. Whether slash left on the property poses significant fire hazard or liability to the City. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. H. Whether transportation of equipment to and equipment and trees from the site can be accomplished without a major disturbance to nearby residents. Revised 1/1/08 Molly Markarian 5 of 5 November 24, 2020 SPRINGFIELD UTILITY BOARD SOUTH HILLS 4TH LEVEL RESERVOIR Tree Felling Permit — Round 2 Map 18-02-03-10, Lot 100 WRITTEN STATEMENT In accordance with Tree Felling Permit submittal requirements, this written statement describes the proposed development and demonstrates that the proposal complies with the standards and criteria contained in SDC 5.19-105 through SDC 5.19-125. The proposal is submitted concurrently with a Site Plan Review application and a Hillside Development Overlay District application. We request that these applications be processed concurrently. LAND USE REQUEST A. Development Objective The applicant's objective is to construct a new water storage reservoir near its existing South Hills Reservoir Site to serve future single-family homes in the MountainGate subdivision and elsewhere. A perimeter fence is proposed around the Reservoir property which will require the removal of additional trees not approved in the previous Tree Felling permit (See City of Springfield Jo. No. 811-20- 000100-TYP2). Subject Property RLIn Maps 2018 B. Land Use Request 1. Development Site The 41h Level Reservoir site is located at South 66s' Place and Jessica Drive in the Thurston Hills of Springfield. Lot 100 was in the MountainGate Master Plan. However, Lot 100 was not included in prior MountainGate subdivisions. Lot 100 was in the MountainGate Master Plan as a future phase. (The MountainGate Master Plan expired in 2004.) Although once planned for single family homesites, lot 100 is now owned by Springfield Utility Board and as documented in this land use application, is now planned to be the location for a new reservoir. The reservoir site is forested and is approximately 11.02 acres in size. Access is by way of South 66'^ Place. Abutting the site to the north and west is unimproved land which is planned and zoned for low density residential development. Abutting the site to south and east is public land owned by Willamalane. 2. Tree Felling Regarding tree felling, there are trees on the tax lot which are included in this Tree Felling Permit. TREE FELLING— STANDARDS, CRITERIA AND RESPONSES This section is presented in the same order of applicable requirements found in Section 5.19-125, Tree Felling Permit Criteria of the Springfield Development Code. Applicable sections of the code are in bold italics, followed by proposed findings in normal text. The location, species, and size of the trees proposed for removal are shown on the enclosed Tree Felling Plan. The removal will be completed by a contractor licensed to do the work using accepted site clearing and tree felling techniques and procedures. Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger of falling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. Response: The requested tree felling is necessary to prevent interference with the proposed 4" Level Reservoir. Trees will be removed to facilitate installation of perimeter fencing that will help minimize unauthorized activities. Trees will be left intact surrounding the reservoir site corridor and in the vicinity of the reservoir site because they are not within the identffied construction footprint for the reservoir or fence, and do not pose an obstruction or potential threat to ongoing operation of the facility. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability; volume of surface runoff and water quality of streams; scenic quality; and geological sites. Response: The proposed felling is consistent with State standards, Metro Plan policies, and City ordinances. Removal of the trees from the subject property should not have a long-term adverse effect on the surrounding physical and visual environment because the applicant is proposing to only remove the trees that are identified as lying within the fence footprint area and where they would interfere with installation. In response to a staff request to confirm from the project geotechnical analysis that the tree felling will have no adverse impact on slope stability or erosion control, Jon Huffman, Senior Geotechnical Engineer at Foundation Engineering, was consulted. He stated: "Given the limited amount of tree felling and site grading proposed for the new fence, I don't have concerns with this work impacting slope stability. In logged hillsides, slides are most common where access road construction (e.g., cuts and embankment fill) significantly alters surface drainage. I don't anticipate this work will require much in terms of cuts and fills for the proposed fence. The loss of tree roots can lead to greater surface instability and erosion. However, this can be mitigated by leaving stumps in place (to the extent practical) and re -seeding so new vegetation is established as the older tree roots decay. I note you have already indicated a plan is in place for surface restoration and re- seeding." See enclosed correspondence from Foundation Engineering. The trees will be felled and the stumps will be ground down to just below the soil level but the remaining stump and root system will stay in place. Disturbed area will be seeded. Thus, the removal of trees will have minimal effect on erosion, soil retention, and stability. C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. Response: It is necessary to remove trees to construct the fencing for the 4rh Level Reservoir site. An accompanying plan set documents tree removal as well as areas of trees to remain. D. In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria. The project site is within a future residential neighborhood, so trees will be retained in areas where they will provide buffering and screening for future residents. E. Whether the applicant's proposed replanting of new trees or vegetation is an adequate substitute for the trees to be felled. Response: The proposed development setback areas should not be disturbed so setback landscaping is satisfied with the existing vegetation. Along the perimeter of the reservoir site, there will be some disturbed areas as the fencing is constructed. The areas outside of the fence path will be planted with approved vegetation including grasses that are drought resistant and do not need irrigation. The non -irrigated grasses and fords will help to stabilize the hillside and prevent erosion and sedimentation issues. F. Whether slash left on the property poses significant fire hazard or liability to the City. Response: All trees and slash will be removed from the site within 72 hours. Removal of the cut trees, woody material and debris from the project area will reduce the fire hazard liability on the site. No burning of the slash piles will occur; debris will instead be recycled at nearby wood processing facilities. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. Response: The proposed tree felling is consistent with the specified guidelines. The Oregon Department of Forestry, through its Community and Urban Forestry program, advocates for selecting appropriate tree species based on site conditions, avoiding invading exotic species, and reforesting the urban environment. The project will accommodate major public utility infrastructure by removing trees that would interfere with the placement of fencing. The affected properties are zoned and designated for residential use and not for public open space or preservation. For these reasons, the proposed tree removal does not rise to the level of a regulated timber harvest or commercial logging operation and the activity is governed by the applicable provisions of the Springfield Development Code. Therefore, the Oregon Department of Forestry objectives have been met by this tree felling proposal. H. Whether transportation of equipment to and equipment and trees from the site can be accomplished without a major disturbance to nearby residents. Response: Construction access to the site will be from South 66th Place and will pass through a residential neighborhood. Public access is close to the local transportation network via Main Street. The proposed access road will also be used to access the project area, which is the only practical point of access from the site due to the topography. Tree felling activities will take place between the hours of 8:00 AM and 5:00 PM, Monday through Friday, and will be of limited duration. Therefore, transportation of equipment and trees from the site will be accomplished without major disturbances to nearby property in compliance with this criterion. III. In logged hillsides, slides are most common where access road construction (e.g., cuts and embankment fill) significantly alters surface drainage. I don't anticipate this work will require much in terms of cuts and fills for the proposed fence. The loss of tree roots can lead to greatersurface instability and erasion. However, this can be mitigated by leaving stumps in place (to the extent practical) and re -seeding so new vegetation is established as the older tree roots decay. I nate you have already indicated a plan is in place for surface restoration and re -seeding. Let me know if you need something more formal than this email. Forthis reason, the Tree Felling exception provisions of SDC 5.19-110.8.1 would not apply to this project. Although security fencing was approved forthe reservoir tank compound on this site, the perimeter fencing proposed in the diagram greatly increases the overall area of project impact. To accommodate the proposed fencing, staff would require a new Tree Felling Permit that identifies the affected trees and includes narrative pertaining to the reason fortree removal outside of an approved development area (SDC 5.19-125.D). The new Tree Felling Permit also would require confirmation from the project geotechnical analysis that the tree felling will have no adverse impact on slope stability or erosion and sediment control. If the extent of the fencing was modified to correspond more closely with the area of project impact along the planned access driveway and tank compound, most of the aforementioned requirements have already been met through the site plan approval process. Additional tree removal, if required, would be addressed through a separate Tree Felling Permit but with a reduced scope (i.e. would not need to address the criteria in 5.19-12S.D that applies to undeveloped areas). Vegetation The overall reservoir site occupies one tax parcel. The proposed reservoir site is located on tax lot 100. In terms of existing vegetation, the site is consistently covered in a mixture of deciduous and evergreen (primarily Douglas Fir) trees. A limited number of trees will be removed in order to construct the perimeter fence. Per the geotechnical engineer, stumps and root systems are to remain in order to minimize erosion potential. Reservoir Site Existing Conditions Google Earth 2018 Re -Vegetation A tree survey for the perimeter area has been conducted. This inventory can be found in the Existing Conditions, Survey Control, and Tree Removal Plan. Only those trees necessary to construct the fence improvements will be removed. As noted in the Tree Felling Permit Written Statement, there are hundreds of existing trees on the subject tax lot that will not be disturbed. Within the 0.63 acres of the site which will be disturbed by the fencing operation, 77 trees will be removed. While trees will be felled, stumps will be ground down to just below soil level with the remaining stump and root system staying in place. Any areas of disturbance will be seeded with a mix of relatively low growing, drought tolerant grasses and forbs — to minimize erosion, minimize stormwater runoff, provide an environment to foster restoration of the forest floor and improve the appearance and natural function of the site.
