Plan oration: �ucl,7 Date: 912-0/20 Plot Plan Preparer Signature Revised 5/21/13 KL 2 of 6 Minimum Development Standards Application Process As stated in SDC 5.15-100, the minimum development standards (MDS) process is intended to support economic development by minimizing City review for minor additions, expansions, or changes in use as specified in SDC 5.15-100. MDS ensures that such development, however, complies with specific appearance, transportation, safety and efficiency, and stormwater management standards specified in the SDC and otherwise protects the public health, safety and welfare. 1. Applicant Submits a Minimum Development Standards Application to the Development & Public Works Department The application must conform to the Minimum Development Standards Submittal Requirements Checklist on pages 4-5 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Minimum Development Standards Submittal Requirements Checklist have been submitted. Applications missing required items will not be accepted for submittal 2. City Staff Conduct Detailed Completeness Check • Planning Division staff conducts a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. • An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. • Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision • This is a Type I decision and thus is made without public notice and without a public hearing since there are clear and objective approval criteria and/or development standards that do not require the use of discretion. • Decisions address all the applicable approval criteria and/or development standards. • Applications may be approved, approved with conditions, or denied. • The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. • The decision issued is the final decision of the City and may not be appealed. A copy of the fee schedule is available at the Development & Public Works Department. Any applicable application, technology, and postage fees are collected at the pre -submittal and submittal stages. ❑ Minimum Development Standards Minor Application Form ❑ Copy of the Deed ❑ State or Federal Permits Required - The applicant must demonstrate that an application has been submitted for any required federal or state permit and provide a copy of the application upon request. ❑ Narrative explaining the purpose of the proposed development, the existing use of the property, and any additional information that may have a bearing in determining the action to be taken. The narrative should also explain justification for any proposed MDS exceptions and should also include other activities proposed on the property such as tree removal, grading, fill or excavation. The proposed is for a simple processing facility located at 136 42nd St. Springfield, OR 97478. The state permit for this business has already been approved and is included. Many and actually almost all of the requirements for this MDS were already in place at the property. Everything on the list is now included. The property has the 5 -foot wide landscape planter strip. This is maintained monthly to ensure a tidy look is maintained for citizens passing by. We want to do our part to be a business that adds to the community rather than subtracts. There is an enclosure for the trash and outdoor storage areas to ensure compliance with this application and the City of Springfield. Bicycle spaces are clearly found on the property to comply with this ordinance. This business is not actually a retail business that members of our community can walk into. It is a manufacturing business that is closed from the public. The employees will be able to use the bike spaces if they so wish. There are clearly labeled parking spaces including a handicapped parking space. Including every member of our community in a safe way is important to us. There is adequate access to the public right-of-way and compliant concrete sidewalks. Streetlights are listed. There will be little change to public utilities. The location, size, and connection points of the utilities are all the same as the previous business and inspection. This building has been around for several decades. There will be no need to do any tree removal, grading, fill, or excavation. This property as mentioned above already had the vast majority of this checklist in place before perusing the application as it has been housing dozens of different businesses for decades. We simply wish to comply with the City of Springfield as fully as possible and make sure the property is safe for our employees and the community as a whole. As stated before, there should really be no surprises at all here based on how long this building has already been around. The current business residing in the facility does not wish to impose any changes on the property regarding this application and wishes to comply with any and all rules and requirements of the city as to remain in good standing. All fees for this application should be found enclosed. The owners of this building have owned it for many years which is why any ordinance about it can elicit a heightened response. The business residing in the building, Green Goat Labs LLC, wishes to follow any and all rules and requirements to remain in good standing with the City of Springfield. The previous LUCS applicant and recipient James Lake has made many false claims about the company Green Goat Labs LLC and the owners of the property Furlong Family LLC. He has attempted to attack both businesses with false claims. He has attempted to hurt them when no wrong had been done to him and is harming their lives. He was tasked to complete a valid MDS and DWP which he never completed with ample time allowed. This is documented and has been at least or about a full calendar year. We would like to request that the city revoke his validity to his LUCS for the City of Springfield for the property for failure to comply with the necessary demands. Or he henceforth should be fined, whatever is the necessary and just adjustment. The Green Goat Labs LLC business was put under pressure to complete these forms when Lake was already supposed to complete them, and Lake is trying to harm their businesses. The applying parties have no problem nor complaint about completing these forms, and are simply requesting some sort of action and justice be taken towards Lake regarding this important and urgent matter.
