LETTER ADDRESSING
CONDITIONS OF APPROVAL
1. Prior to Final Plat approval, the applicant shall install the new sewer laterals to serve Lots 1-3 within
the subdivision. Plumbing Permit #811 -20 -001310 -PLM has been issued. An Encroachment Permit is
being processed. The work will be completed prior to final plat approval.
2. Prior to Final Plat approval, the applicant shall add a note that an encroachment permit is required
to install the sewer service in "D" Street as shown on the plans. The applicant shall apply and obtain
the encroachment permit from the City of Springfield prior to any construction activity in "D" Street.
Per conversation with the City staff, the sewer lines will be installed prior to Final Plat approval, thereby
eliminating the need to add a note to the Final Plat.
3. Prior to Final Plat approval, the applicant shall provide an Operations and Maintenance plan to the
City for review to ensure the long-term maintenance and operation of the proposed infiltration strip,
consistent with maintenance criteria required by EDSPM 3.03.1. The plan should designate
maintenance responsibility for operating and maintaining the system, and should be distributed to all
property owners and tenants of the site. In the case the applicant would like to use permeable pavers
in the driveway as an alternative, the applicant shall provide the permeable paver manufacturer's
details to City staff prior to installation.
This infiltration strip applies to Parcels 2, 3, and 4. Parcel 1 has no use of this driveway. Other than this,
this item is acknowledged without further comment.
4. To ensure a fully functioning water quality system and meet objectives of Springfield's MS4 permit,
the Springfield Development Code and the EDSPM, the proposed infiltration strip shall be fully
vegetated with all vegetation species established prior to approval of the final site inspection.
Alternatively, if this condition cannot be met, the applicant shall provide and maintain additional
interim erosion control/water quality measures acceptable to the Public Works Department that will
suffice until such time as the vegetation becomes fully established.
Applicant will install the infiltration strip, cutting it into the driveway to the size and dimensions
proposed on the map, and location, and fully vegetate it or install permeable pavers. If permeable
pavers are installed, the applicant will provide the permeable paver manufacturer installation details to
City staff prior to installation.
S. The proposed soakage trenches are stormwater reduction and pretreatment methods approved in
accordance with SDC 4.3-110 and shall be submitted with calculations on building permit submittals
for each lot within the subdivision.

6. Prior to Final Plat approval, the applicant shall show the location of proposed SUB utility
connections and facilities as required by SDC 4.3-120; and
The Proof of Buildability Plan will be updated to show.
7. Prior to Final Plat approval, the applicant shall show the location of proposed mailbox locations on
a revised street utility plan as required by SDC 5.12-120.D.4.
The Proof of Buildability Plan attached hereto will be updated to show the mailbox locations. These are
the current sites, but with two mailboxes added on W for Parcels 1 and 2, and one mailbox added on D
Street for Parcel 3.
8. Prior to final approval, the Plat shall dedicate 7 -foot wide public utility easements (PLIES) along all
street frontages.
The 7' wide public utility easement already exists along D Street. One will be added along 51" Street as
shown on the submitted Plat.
9. Planted setbacks required by this code shall be in place prior to Final Occupancy of individual
residences in accordance with SDC 3.2-215 and 4.4-105.

30. Prior to issuance of any Building Permits for lots within the subdivision area, the applicant shall
demonstrate compliance with the height limit of SDC 3.2-215 and the solar setback requirements of
SDC 3.2-225.

applicant shall obtain a Tree Felling Permitfor the removal of more than five trees greater than 5 -

AND UTILITY EASEMENT AND MAINTENANCE AGREEMENT
RECITALS:
Whereas: Monkey Hero LLC (DECLARANT) is the owner of a certain tract of real property
located in the Northwest 1/4 of Section 33 in Township 17 South, Range 2 West of the
Willamette Meridian and being more particularly described as follows:.
Lot 1, Block 4 Simmons Addition as platted and recorded in Book 12, Page 26
Lane County Oregon Plat Records, all in Lane County Oregon.
Except: that portion conveyed to the City of Springfield by a Bargain and Sale
Deed recorded July 11, 1997 Recep. No. 97-046479 Lane County Oregon Deeds
and Records.
Whereas: The DECLARANT is replatting the above described property into four(4) lots as
approved by the City of Springfield Planning Department under Case No. 811-20-000098-TYP2.
Said plat to be known as Monkey Hero LLC Subdivision, as platted and recorded
Reception No. 2020 -
County Oregon Deeds and Records.

Whereas: The DECLARANT wishes to establish the rights and responsibilities for the shared
use of a common driveway located on portions of Lot 2 and Lot 4, for access to and from Lot 2,
Lot 3 and Lot 4 to 51st Street, a public road.
Therefore: By and through this instrument the DECLARANT does hereby declare and establish,
a perpetual nonexclusive joint access easement for ingress and egress over a strip of land, 20.0
feet in width, for the mutual benefit of Lot 2, Lot 3 and Lot 4 of the above mentioned Monkey
Hero LLC Subdivision, said strip being more particularly described as follows:
Beginning at the southeast corner of Lot 1, Block 4 of Simmons Addition as platted

This Declaration of Easement is made on the following terms:
2.1 RECITALS. The above Recitals are deemed true and correct and are incorporated
herein by reference.
2.2 PURPOSE. The easement is created to provide for pedestrian and vehicular ingress
and egress from Lot 2, Lot 3 and Lot 4 to the public road. The easement area is also intended to
provide emergency vehicle access to the benefitted lots.
2.3 USE OF THE BURDENED PROPERTY. The owners of the Lots burdened by this
casement, or their heirs, administrators, executors, successors and assigns shall at all times and
without reservation have the right to use the access drive and the area described as the Easement
Area for any lawful purpose, not inconsistent with the benefitting properties full enjoyment of
the rights herein granted.
2.4 PRIVATE GRANT. the casement created by this instrument does not constitute a
dedication or grant for public use.
2.5 MAINTENANCE AND REPAIRS. The Owners of Lot 2, Lot 3 and Lot 4 shall
share equally in the cost of maintenance of the existing shared access drive roadway. However,
any damages caused solely by the negligence or misuse of the easement area by the owner or
their invitees of a specific Lot, shall be the sole responsibility of the negligent party. The
Declarant does hereby incorporate the provisions of ORS 105.175 and ORS 105.180 into this
easement document. All maintenance and repair work is to be performed by a licensed, bonded
contractor and the access drive shall be restored to a condition equal to or better than the original
improved condition of the access drive once the maintenance or repair bas been completed. In
the event one owner does not pay its share of the maintenance and or repair as required above,
the other owners have the right to pay for the required maintenance or repair, and any moneys
advanced in the foregoing situation shall bear interest at three points above the prime rate for a
typical 30 year single family residential loan at the time the maintenance or repair occurred.
Interest shall commence as of the date the money is expended. The owner that has paid for the
maintenance or repair shall submit a billing request for the cost of work done and paid for. If the
other owner has not paid within 30 days of the date of billing, then the amount due shall become
a lien on the appropriate property and interest shall accrue until the balance is paid in full. The
owner holding the lien shall have the right to record such lien on that property.
2.6 TAXES. The Owner of Lot 2 and Lot 4 shall be responsible for the real property
taxes associated with that portion of the easement area located on their individual lots.

2.7 INDEMNITY . Each user of the access and utility easement shall assume all risks
arising out of its use of the Easement Area. The owners of Lot 2, Lot 3 and Lot 4 agree to save
and hold the other harmless from any third -party claim, cost, damage; or expense of any kind or
nature arising out of or related to any negligent or wronghd act or omission occurring doming the
course of exercising the rights granted herein by anindividual owner or its successors, assignees,
or invitees.
2. 8 BINDING EFFECT. The terms and conditions of this Joint Access Easement and
Maintenance Agreement shall run with the land and shall extend to and be binding upon and
inure to the benefit of the respective heirs, successors and assigns of the parties identified herein.
2.9 WAIVER. The possible invalidity of any portion of this easement shall not prevent
the remaining terms or conditions of this agreement from being required or carried out.
2.10 AGREEMENT. This agreement contains the entire agreement of the Parties with
respect to this easement. There shall be no modifications or alterations to this agreement, unless
in writing and signed by all the parties named herein.
2.11 ARBITRATION. In the event that there is controversy over this easement or the
terms of this agreement, the Grantor and Grantee agree to settle the dispute by arbitration in
Eugene, Oregon in accordance with the provisions of O.R.S. 36.300 to 36.365. Anyjudgment on
the arbitration award may be entered in any count having jurisdiction over the subject matter of
the controversy. In the event that arbitration is not accomplished and a suit or action is taken to
enforce any of the terms of this grant of easement and maintenance agreement, the prevailing
party in such suit or action shall be entitled to the costs and disbursements allowed by law, as
well as such sums the court shall deem reasonable as attorney's fees; and in the event there is an
appeal of the decision of the trial court, such further sum as may be fixed by the court as
reasonable attorney's fees. Any and all litigation arising under the terms of this agreement shall
be commenced mid tried in the Circuit Court of the State of Oregon for Lane County and the law
of the State of Oregon shall be the law used in determining the rights of the parties under the
terms of this agreement.
All provisions of this instrument, including the benefits and burdens, are binding on and inure to
the heirs, successors, assigns, transferees, and personal representatives of all parties who own
any of the properties as described herein.
