Applicant Submits a Final Site Plan Review Application to the Development Services Department The application must conform to the Final Site Plan Review Submittal Requirements Checklist on page 4 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Final Site Plan Review Submittal Requirements Checklist have been submitted. Applications missing required items will not be accepted for submittal 2. City Staff Conduct Detailed Completeness Check Planning Division staff conducts a detailed completeness check within 30 days of submittal. The assigned Planner notifies the applicant in writing regarding the completeness of the application. • An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. The complete submittal consists of a Final Site Plan Review application, the application fee, this set of responses and associated exhibits, and the Final Plans. We believe we meet all conditions of the decision. Conditions of Approval Therewere 22 Conditions of Approval for the Site Plan Review decision. The Conditions are in italics. The applicant's responses are in plain text. Condition of Approval #1: The Final Site Plan shall provide for screening landscaping around the above -ground water system enclosures on the eastern edge of the site. Applicant Response: The Site Plan has been revised to include screening landscaping around the above -ground water system enclosures on the eastern edge of the site. The above -ground water system apparatus will be placed outside of pedestrian walkway areas and internal to the subject site; it will also be green in color to blend in with the landscaping. Condition of Approval #2: The Final Site Plan shall provide for a 10 -foot wide utility easement satisfactory to SUB Electric forthe electrical service to the site. The easement shall be centered on the electrical service line and extend from the northeast property boundary to the transformer pad. Applicant Response: The Site Plan and Civil Plan have been updated to include a 10 -foot wide utility easement centered on the electrical service line and extend from the northeast property boundary to the transformer pad. Condition of Approval #3: The Final Site Plan shall provide for a suitable underground conduit satisfactory to SUB Electric from the transformer pad southward to the adjusted southern boundary of the site. A 10 -foot wide utility easement centered on the conduit shall be provided from the transformer pad to the adjusted southern boundary of the site. Applicant Response: The transformer is for the exclusive use of TL 500 and will not serve any other tax lots or properties. Therefore extending conduit and providing an easement is not necessary. Condition of Approval #4: The Final Site Plan shall provide for a suitable floor drain and sanitary sewer lateral for the trash enclosure serving the development site. Applicant Response: Acknowledged and agreed. Stormwater runoff from the site will be fully captured and infiltrated on-site. An executed Maintenance Agreement is included with this submittal. Condition of Approval #6: Prior to approval of the Final Site Plan, the applicant shall provide an operations and maintenance plan satisfactory to the City to ensure viable, long-term maintenance and operation of the stormwater infiltration rein gardens. The operations and maintenance plan shall designate the responsible party for operating and maintaining the system and shall be distributed to all property owners and tenants of the site. A record of this plan shall be filed against the property deed with Lane County Deeds and Records. Applicant Response: An executed and recorded Notice of Operations & Maintenance Agreement and Operations & Maintenance Plan and Inspection Log is included with this submittal. Condition of Approval #7: To ensure a fully functioning water quality system and meet o4ectives of Springfield's MS4 permit, the Springfield Development Code and the EDSPM, the infiltration rein gardens shall be fully vegetated with all vegetation species established prior to issuance of final occupancy and commencemeht of operations. Aitematively, if this condition cannot be met, the applicant shall provide and maintain additional interim erosion controVwater quality measures acceptable to the Development & Public Works Department that will suffice until such time as the rein garden vegetation becomes fully established. The interim erosion control measures shall be in addition to the required plantings for the site. Applicant Response: Agreed. A note to this effect has been added to the planting plan. Condition of Approval #8: Prior to initiating any construction or excavation within the Nugget Way or Newman Street rights-of-way, the applicant shall obtain a Lane County facility permit or written concurrence and provide evidence thereof to the City. All Lane County local access roads serving the subject site shall meet the requirements of Lane Code 15.045 for surface improvements, emergency access and road geometry. Applicant Response: See attached Email from Lane County Public Works. The email states that "Nugget Way and Newman Street are Local Access roads (LAR). The County does not issue facility permits on LAR's nor does staff work on LAR's unless directed... nothing is needed for County review of the accesses off or work in the right of way of Nugget Way" A copy of an email from Brad Lemhouse from Lane County Public Works is included in this submittal. Condition of Approval #9: Prior to approval of the Final Site Plan, the applicant and the City shall enter into a transfer agreement or a#emative mechanism satisfactory to the City for the portion of Tax Lot 1200 to be incorporated into the site development area. Applicant Response: A transfer agreement or alternative mechanism satisfactory to the City is being generated between the property owner and the City. Condition of Approval #10: The Final Site Plan civil drawings shall provide for installation of a street light on the existing powerpole at the main driveway approach onto Nugget Way, and two street lights for the McVay Highway frontage, including a street light to be installed on the existing power pole approximately 225 feet south of the intersection with Nugget Way and a second on the existing power pole locatedjust south of the new shared driveway entrance onto McVay Highway. Applicant Response: The Civil Plan has been revised to include streetlights on the existing power pole at the main driveway approach onto Nugget Way and the two streetlights for the McVay Highway frontage. The construction plans forthe project shall include rates specifying that a Lane County Facility Permit or County written concurrence is required for all work within the Newman Street and Nugget Way rights-of-way, and a City of Springfield Encroachment Permit is required for all work within the McVay Highway right-of-way. Applicant Response: As noted above, no a facility permit is needed from Lane County for Nugget or Newman. The applicant will procure a City of Springfield Encroachment Permit for work within the McVay Highway right-of-way and include that with the project's construction plans. Condition of Approval #12. The Final Site Plan shall provide for future installation of pedestrian amenities along the Nugget Way and McVay Highway frontages of the site. The pedestrian amenities shall be consistent with the requirements of SDC 3.4 -270.1.2.a -c. Alternatively, the applicant shall prepare and submit design and construction plans satisfactory to the City for the Nugget Way and McVay Highway frontages, including provision for required pedestrian amenities, in conjunction with a future construction project for the McVay Highway and Nugget Way roundabout intersection. Applicant Response: The applicant acknowledges this cited code standard. Because the design of the Nugget Way and McVay Highway has not yet occurred, and such design is at least a few years in the future, and would most likely be a city- or some other party -initiated public improvement project, it is not practical to speculate on such a design at this time. The applicant does agree to participate to the degree determined in an in -process street improvement agreement (see below) in the provision of required pedestrian amenities. Condition ofApproval #13. Prior to approval ofthe Final Site Plan, the applicant shall enter into street improvement agreement(s) with the City for future construction of Nugget Way and McVay Highway frontage improvements concurrently with the McVay Highway and Nugget Way intersection project. The street improvement agreements shall be binding upon the applicant to complete the required improvements and include provision for financial surety as may be required by the City. Applicant Response: A street improvement agreement with the City is being generated between the property owner and the City. Condition of Approval #14. The Final Site Plan shall provide fora Knox keyed gate switch and "click to erter' gate opening system for all electrically operated vehicle gates within the site. Applicant Response: Acknowledged and agreed. The Site Plan has been updated to include a note stating that "A Knox Box and click -to -enter gate opening system will be provided." Condition ofApproval #15. At least three (3) feet ofclearspace shall be maintained around the circumference of all fire hydrants. Working space around fire department connections shall be maintained 3 feet in width on both sides of the connection point, 3 feet in depth in front of the connection, and 78 inches in height above the connection. Applicant Response: Acknowledged and agreed. The Planting Plan has been updated and includes a note stating that a 3 -foot clear zone will be provided around all fire hydrants. Condition of Approval #16. Prior to approval of the Final Site Plan, the applicant shall obtain vacation or release of the 3 -foot wide EWEB electrical easemert that runs east -west within Tax Lot 500 and provide evidence thereof to the City. Alternatively, the Final Site Plan shall be revised to show the 8 - foot high perimeter fence running along the eastern and southern boundaries of the easement area, or the applicant shall provide written concurrence from CenturyLink agreeing to the installation of an obstruction (8 -foot high fence) within the delineated easement area. Applicant Response: The existing US West Communications easement (now Century Link) is in the process of being vacated. Condition ofAppnoval #18. Sheet L3.1 of the Final Site Plan shall provide for future dedication of a 7 - foot wide PUE along the adjusted northern and eastern boundaries (i.e. modified Nugget Way and McVay Highway frontages) of the development site. Applicant Response: Sheet L3.1 has been updated to call out the 7 -foot wide PUE along the adjusted northern and eastern boundaries of the development site. Condition ofAppnoval #19. The Final Site Plan shall provide forplacemen t of monument signage that does not conflict with existing and proposed underground utilities. Applicant Response: The monument signage has been removed from the Site Plan. Condition o(Approval #20. The Final Site Plan shall provide forparking of medium duty company trucks in the double now of parking spaces internal to the fleet parking lot or along the parking spaces facing the west side of the building in accordance with SDC Table 3.4-1, footnote (2.b). Applicant Response: The Site Plan has been modified to call out the parking location for medium -duty trucks in the fleet parking lot. Condition ofAppnoval #21. The Final Site Plan (Sheet L3.0) shall accommodate the existing LTD transit stop along the McVay Highway frontage of the site. Applicant Response: The Site Plan has been updated to call out the location of the LTD transit stop along McVay Highway. Condition ofAppnoval #22. The property owner or their designee shall be responsible for ongoing and perpetual maintenance of the private stormwater facilities on the site to ensure they function as designed and intended, and to ensure protection of groundwater resources. Annual maintenance records shall be kept by the property owner or their designee and provided to the City for review upon reasonable request - normally within five business days. Applicant Response: Acknowledged and agreed. The property owner will maintain the private stormwater facilities on site. Annual maintenance records will be kept and provided to the City upon request. Said facilities shall be operated and maintained in accordance with the Operations and Maintenance Agreement (O&M Agreement) on file with the City of Springfield, Development and Public Works Department. Lane Code 15.010(35)(e)(v) requires certain conditions be met before spending County moneys on LAR's. As such, we do not issue facility permits on LAR's nor does staff work on LAR's unless directed. To answer your question, nothing is needed for County review of the accesses off or work in the right of way of Nugget Way. Regarding the street lights, no County review, may need the utility's review / permission for using their pole and someone will need to own, maintain, and operate the lights. That being said, you are in the UGB of the City of Springfield and Nugget Way is a Public road so you will need to follow City street design requirements and guidelines for driveway locations, design, construction as well as any sidewalk work or road work within the right of way, etc. you'll also need to follow industry standards for utilities located in a Public right of wayfor any utility work. As a Public road when working in the right of way the Contractor will need to follow MUTCD guidelines fortraffic control. I hope this helps, feel free to call if you have any additional questions. Record resolution activities: Appendix 3A-3 Page 1 of 1 EDSP Adopted December 03, 2012 Rain Gardens Operations and Maintenance Plan A vegetated Infiltration Basin or rain garden is a vegetated depression created by excavation, berms, or small dams to provide for short-term ponding of surface water until it percolates into the soil. The basin shall infiltrate stormovater within 24 hours. All facility components and vegetation shall be inspected for proper operations and stmchual stability, at a minimum, quarterly for the first 2 years from the date of installation, 2 times per year thereafter, and within 49 hours after each maj or storm event. The facility owner must keep a log, recording all inspection dates, observations, and maintenance activities. The following items shall be inspected and maintained as stated: Basin Inlet shall assure umestiicted stormwater flow to the vegetated basin. • Sources of erosion shall be identified and controlled when native soil is exposed or erosion channels are present. • Inlet shall be cleared when conveyance capacity is plugged. • Rocks lash pads shall be replenished to prevent erosion. Embankment, Dikes, Berms and Side Slopes retain water in the infiltration basin. • Structural deficiencies shall be corrected upon discovery: o Slopes shall be stabilized using appropriate erosion control measures when soil is exposed/ flow charnels are forming. o Sources of erosion damage shall be identified and controlled. Overflow or Emergency Spillway conveys flow exceeding reservoir capacity to an approved stormwater receiving system. • Overflow shall be cleared when 25% of the conveyance capacity is plugged. • Sources of erosion damage shall be identified and controlled when soil is exposed. • Rocks or other armament shall be replaced when only one layer of rock exists. Filter Media shall allow stormwater to percolate uniformly through the infiltration basin. If water remains 36-49 hours after storm, sources of possible clogging shall be identified and corrected. • Basin shall be raked and, if necessary, soil shall be excavated, and cleaned or replaced. • Infiltration area shall be protected from compaction during construction. Sediment/ Basin Debris Management shall prevent loss of infiltration basin volume caused by sedimentation. Gauges located at the opposite ends of the basin shall be maintained to monitor sedimentation. • Sediment and debris exceeding 3 inch in depth shall be removed every 2-5 years or sooner if performance is affected. Debris and Litter shall be removed to ensure stormovater infiltration and to prevent clogging of overflow drains and interference with plant growth. • Restricted sources of sediment and debris, such as discarded lawn clippings, shall be identified and prevented. Vegetation shall be healthy and dense enough to provide filtering while protecting underlying soils from erosion. • Mulch shall be replenished as needed to ensure healthy plant growth • Vegetation, large shrubs or trees that limit access or interfere with basin operation shall be pruned or removed. • Grass shall be mowed to 4"-9" high and grass clippings shall be removed no less than 2 times per year. • Fallen leaves and debris from deciduous plant foliage shall be raked and removed if build up is damaging vegetation. • Nuisance or prohibited vegetation (such as blackberries or English Ivy) shall be removed when discovered. Invasive vegetation contributing up to 25% of vegetation of all species shall be removed. • Dead vegetation shall be removed to maintain less than 10% of area coverage or when infiltration Appendix 3A-4 Page 15 of 31 EDSP Adopted December 03, 2012 basin function is impaired. Vegetation shall be replaced within 3 months, or immediately if required to control erosion. Spill Prevention measures shall be exercised when handling substances that contaminate stormwater. Releases of pollutants shall be corrected as soon as identified. Training and/or written guidance information for operating and maintaining vegetated infiltration basins shall be provided to all property owners and tenants. A copy of the O&M Plan shall be provided to all property owners and tenants. Access to the infiltration basin shall be safe and efficient. Egress and ingress routes shall be maintained to design standards. Roadways shall be maintained to accommodate size and weight of vehicles, if applicable. • Obstacles preventing maintenance personnel and/or equipment access to the infiltration basin shall be removed. • Gravel or ground cover shall be added if erosion occurs, e.g., due to vehicular or pedestrian traffic. Insects and Rodents shall not be harbored in the infiltration basin. Pest control measures shall be taken when insects/roderts are found to be present. • If a complaint is received or an inspection reveals that a stormwater facility is significantly infested with mosquitoes or other vectors, the property owner/owners or their designee may be required to eliminate the infestation at the City inspector's discretion. Control of the infestation shall be attempted by using first non -chemical methods and secondly, only those chemical methods specifically approved by the City's inspector. Acceptable methods include but are not limited to the following: i. Installation of predacious bird or bat nesting boxes. ii. Alterations of pond water levels approximately every four days in order to disrupt mosquito larval development cycles. iii. Stocking ponds and other permanent water facilities with fish or other predatory species. iv. If non -chemical methods have proved unsuccessful, contact the City inspector prior to use of chemical methods such as the mosquito larvicides Bacillus thurengensis var. israchensis or other approved larvicides. These materials may only be used with City inspector approval if evidence can be provided that these materials will not migrate off-site or enter the public stormwater system. Chemical larvicides shall be applied by a licensed individual or contractor. • Holes in the ground located in and around the infiltration basin shall be filled. If used at this site, the following will be applicable: Fences shall be maintained to preserve their functionality and appearance. • Collapsed fences shall be restored to an upright position. • Jagged edges and damaged fences shall be repaired or replaced.
