HomeMy WebLinkAboutResolution 2020-18 06/15/2020 CITY OF SPRINGFIELD, OREGON RESOLUTION NO. ___________ \[FY21 STATE SHARED REVENUE\] A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD CERTIFYING ELIGIBILITY FOR STATE-SHARED REVENUES FROM CIGARETTE, MARIJUANA, GAS AND LIQUOR TAXES, APPROVING REVENUE SHARING PROGRAM REVENUES PURSUANT TO OREGON REVISED STATUTES 221.760 AND 221.770. WHEREAS, ORS 221.760 in summary provides as follows: Section 1. The officer responsible for disbursing funds to cities under ORS 323.455, 366.785 to 366.820 and 471.805 shall, in the case of a city located within a county having more than 100,000 inhabitants according to the most recent federal census, disburse such funds only if the city provides four or more of the following services: 1.Police protection 2.Fire protection 3.Street construction, maintenance and lighting 4.Sanitary sewers 5.Storm Sewers 6.Planning, zoning and subdivision control 7.One or more utility services WHEREAS, City of Springfield officials recognize the desirability of assisting the State office responsible for determining the eligibility of cities to receive such funds in accordance with ORS 221.760, now, therefore, Be it resolved, that the City of Springfield hereby certifies that it provides the following six out of seven municipal services enumerated in Section 1, ORS 221.760: 1.Police protection 2.Fire protection 3.Street construction, maintenance and lighting 4.Sanitary sewers 5.Storm Sewers 6.Planning, zoning and subdivision control WHEREAS, ORS 221.770 requires the City of Springfield to elect to receive state revenues receive state revenues under ORS 221.770; and WHEREAS, as required by ORS 221.770(1)(b), a public hearing before the Budget Committee was advertised in a prominent location beginning on April 22, 2020 and advertised in a newspaper of general circulation on April 29, 2020; and WHEREAS, as required by ORS 221.770(1)(b), on May 5, 2020, the Budget Committee held a public hearing giving citizens an opportunity to comment upon the proposed uses of State Revenue Sharing funds; and WHEREAS, as required by ORS 221.770(1)(c), a public hearing before the Common Council of the City of Springfield was advertised in a newspaper of general circulation on June 10, 2020; and WHEREAS, as required by ORS 221.770(1)(c), on June 15, 2020, the Common Council of the City of Springfield held a public hearing on the proposed uses of State Revenue Sharing funds; and WHEREAS, as required by ORS 221.770(1)(d), the City of Springfield levied a property tax for the year preceding the year in which the revenue sharing is due; NOW, THEREFORE, BASED ON THE FINDINGS SET FORTH IN THE FOREGOING RECITALS, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1. The City of Springfield hereby certifies its eligibility to participate in state shared revenues disbursed pursuant to ORS 221.760 and compliance with provisions of ORS 221.770(1)(c). Section 2. Approval is given for the City of Springfield to participate in the State Revenue Sharing program for the 2020/21 fiscal year, beginning July 1, 2020, and ending June 30, 2021. Section 3. The City of Springfield hereby elects to receive state revenues distributed pursuant to ORS 221.770 for the 2020/21 fiscal year, beginning July 1, 2020, and ending June 30, 2021. Section 4. The City Manager is directed to file a certified copy of this resolution with the State of Oregon, Department of Administrative Services Operations, prior to July 31, 2020. Section 5.
