Applicant Submits a Tree Felling Permit Application to the Development Services Department The application must conform to the Tree Felling Permit Submittal Requirements Checklist on page 4 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Tree Felling Permit Submittal Requirements Checklist have been submitted. Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check Planning Division staff conducts a detailed completeness check within 30 days of submittal. The assigned Planner notifies the applicant in writing regarding the completeness of the application. An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision This is a Type II decision and thus is made after public notice, but without a public hearing, unless appealed. Mailed notice is provided to property owners and occupants within 300 feet of the property being reviewed and to any applicable neighborhood association. In addition, the applicant must post one sign, provided by the City, on the subject property. There is a 14 -day public comment period, staring on the date notice is mailed. Applications are distributed to the Development Review Committee, and their comments are incorporated into a decision that addresses all applicable approval criteria and/or development standards, as well as any written comments from those given notice. Applications may be approved, approved with conditions, or denied. The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. The decision issued is the final decision of the City but may be appealed within 15 calendar days to the Planning Commission or Hearings Official. Revised 1/1/08 Molly Markarian 4 of 5 5.19425 Criteria The Director, in consultation with the Public Works Director and the Fire Chief shall approve, approve with conditions or deny the request based on the following criteria: A Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger of falling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability; volume of surface runoff and water quality of streams; scenic quality; and geological sites. C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. D. In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria. 1. Wooded areas associated with natural drainageways and water areas shall be retained to preserve riparian habitat and to minimize erosion; 2. Wooded areas that will likely provide attractive on-site views to occupants of future developments shall be retained; 3. Wooded areas along ridge lines and hilltops shall be retained for their scenic and wildlife value; 4. Wooded areas along property lines shall be retained to serve as buffers from adjacent properties; 5. Trees shall be retained in sufficiently large areas and dense stands so as to ensure against windthrow; 6. Large-scale clear -cuts of developable areas shall be avoided to retain the wooded character of future building sites, and so preserve housing and design options for future City residents. E. Whether the applicant's proposed replanting of new trees or vegetation is an adequate substitute for the trees to be felled. F. Whether slash left on the property poses significant fire hazard or liability to the City. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. The proposal is submitted concurrently with a Site Plan Review application and a Hillside Development Overlay District application. We request that these applications be processed concurrently. I. LAND USE REQUEST A. Development Objective The applicant's objective is to construct a newwater storage reservoir near its existing South Hills Reservoir Site to serve future single-family homes in the MountainGate subdivision and elsewhere. Overall Request In accordance with the results of a Development Issues Meeting the applicant held with the City of Springfield on December 19, 2019 (See City of Springfield Jo. No. 811-19-000285- PRE), 11-19-000285PRE), accomplishing the development objective will require City of Springfield approval of three land use applications: Site Plan Review, Hillside Development Overlay District, and Tree Felling Permit. Although relating to the same project, each of these have been generated as a complete, stand-alone application including application form, city fee, written statement with findings demonstrating compliance with applicable criteria, exhibits and plans. While each of these is to receive its own decision, to ease the overall process, these three applications are being submitted for concurrent processing. It is intended that this will provide an opportunity for cross-referencing and parallel review and assist the city in rendering a decision. Additional details regarding this proposal are provided on the plans, the remainder of this written statement, and other materials enclosed and attached herewith. 2. Tree Felling Regarding tree felling, there are trees on the tax lot which are included in the Tree Felling Permit. Development Site The 4' Level Reservoir site is located at South 65^ Place and Jessica Drive in the Thurston Hills of Springfield. Lot 100 was in the MountainGate Master Plan, however, Lot 100 was not included in prior MountainGate subdivisions. Lot 100 was in the MountainGate Master Plan a future phase. (The MountainGate Master Plan expired in 2004.) Although once planned for single family homesites, lot 100 is now owned by Springfield Utility Board and, as documented in this land use application, is now planned to be the location for a new reservoir. The reservoir site is forested and is approximately 11.02 acres in size. Access is by way of South 66° Place. Abutting the site to south and east is public land owned by Wfllamalane. B. Planning Context 1. Planning and Zoning Local long-range land use is governed by the Eugene -Springfield Metropolitan Area General Plan (Metro Plan), often supplemented with a more specific refinement plan and/or neighborhood plan, followed by site-specific zoning. Further, zoning can sometimes be comprised of base and overlay zoning. For the reservoir site, the Metro Plan designation is Low Density Residential, there is no applicable neighborhood plan, and the base zoning is Low Density Residential. The Tax Lots to the north were included in the 1995 MountainGate Master Plan. Lot 100 was in the MountainGate Master Plan as a future phase. r_. Transportation a. TransPlan. The metro area adopted transportation plan, The Eugene -Springfield Transportation System Plan (TransPlan), adopted in 2001 and amended in 2002, includes one project in the vicinity of the subject property— Project 36, a future collector connecting Straub Parkway to the west to the general vicinity of the south side of MountainGate Master Plan area. b. Springfield 2035 Transportation System Plan. The City of Springfield's Local Street Network diagram shows proposed future streets within Springfield's jurisdiction. The plan is illustrative only and is not parcel specific. Future local streets, their locations and connection points can be adjusted at time of specific development proposals. The Springfield Stormwater Facilities MasterPlan shows the property as being within the Jasper-Natron Basin. The Master Plan identifies no capital improvement projects in the vicinity of the project. Wellhead Protection. The subject property is not within awellhead protection area, nor are there any protection areas near the subject property. Springfield Natural Resources Study. The Springfield Natural Resource Study Report does not identify any resources on or near the site that would be impacted by the proposed development. b. Springfield Wetland Inventory / Water Quality Limited Watercourses (WQLW). Neither the National Wetlands Inventory nor the Local Wetlands Inventory document the presence of jurisdictional wetlands on or adjacent to the subject property. Springfield's Water Quality Limited Watercourses inventory also documents that there are no WQLW features on or adjacent to the subject property. c. Geotechnical Stability. A geotechnical evaluation has been performed forthe 4' Level Reservoir site. The report lists construction, site preparation, and foundation design recommendations. 5. Parks and Open Space a. Wllamalane Park and Recreation Comprehensive Plan. The Wlllamalane Comprehensive Plan includes three projects within the vicinity. Project 3.8. Pursue acquisition and development of natural area parks and trail systems along the Thurston Hills ridgeline south of Potato Hill and towards the Jasper-Natron area. (Completed. See Project 4.10.) Project 3.10. Identified in the MountainGate Master Plan, develop a 90 -acre natural area park and trail system on top of Potato Hill. Project 4.10. Acquisition and development of a ridgeline trail in the south Thurston Hills area. (Property has since been acquired.) TREE FELLING—STANDARDS, CRITERIA AND FINDINGS This section is presented in the same order of applicable requirements found in Section 5.19-125, Tree Felling Permit Criteria ofthe Springfield Development Code. Applicable sections ofthe code are in bolditalics, followed by proposed findings in normal text. The location, species, and size ofthe trees proposed for removal are shown on the enclosed Tree Felling Plan. The removal will be completed by a contractor licensed to do the work using accepted site clearing and tree felling techniques and procedures. Response: The requested tree felling is necessary as the form and function of the 4'h Level Reservoir cannot co -exist with trees when the trees would be within the footprint of the reservoir. Trees will be removed to facilitate installation and operation of the reservoir (including the gravel access road and underground utilities). Trees will be left intact surrounding the reservoir site corridor and in the vicinity of the reservoir site because they are not within the identified construction footprint, and do not pose an obstruction or potential threat to ongoing operation of the facility. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks,, wildlife; erosion, soil retention and stability, volume of surface runoff and water quality of streams; scenic quality; and geological sites. Response: The proposed felling is consistent with State standards, Metro Plan policies, and City ordinances. Removal of the trees from the subject property should not have a long -tens adverse effect on the surrounding physical and visual environment because: a) The applicant will install a gravel access road that meets the requirements of the utility as well as of the city and fire marshal. The road will be the minimum width, and follow hillside contours as beast as possible to minimize impacts. b) The proposed tree felling will retain large, intact stands of trees. Large stands minimize w ridthrow as well as provide the maximum visual buffer between the reservoir site adjacent residential property. c) The area subject to tree removal will be revegetated, thereby providing for soil absorption of rainfall and runoff. d) The applicant is proposing to only remove the trees that are identified as lying within the reservoir footprint area and where they would interfere with the installation of the underground utilities and the gravel access road. Thus, the removal of trees will have minimal effect on erosion, soil retention, and stability. As noted above, some 87% of the entire site will remain as is. C. Whether it is necessary to remove trees in order to construct proposed irrprovements as specMed in an approved development plan, grading permits and construction drawings. Response: It is necessary to remove trees to construct the proposed development. An accompanying Site Plan Review application and plan set document tree removal as well as areas of trees to remain. D. In the event that no Development Plan has been approved by the City, felling of trees will be perrrctted on a limited basis consistent with the preservation of the site's future developmentpotential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria. Response: The proposed tree felling area is not located in an area with natural drainageways and no large-scale clear -cuts will occur on the site. The project site is within a future residential neighborhood, so trees will be retained in areas where they will provide buffering and screening for future residents. Whether the applicant's proposed replanting of new trees or vegetation ism adequate substitute for the trees to be felled. Response: The proposed development setback areas should not be disturbed so setback landscaping is satisfied with the existing vegetation. Interior to the reservoir site, there will be some disturbed areas as the reservoir, on-site access road, and utility infrastructure are constructed. These areas will be planted with approved vegetation with grasses that are drought resistant and don't need irrigation. The non -irrigated grasses and forbs will help to stabilize the hillside and prevent erosion and sedimentation issues. F. Whether slash left on the property poses significant fire hazard or liability to the City. Response: All trees and slash will be removed from the site within 72 hours. Removal of the cut trees, woody material and debris from the project area will reduce the fire hazard liability on the site. No burning of the slash piles will occur; debris will instead be recycled at nearby wood processing facilities. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. Response: The proposed tree felling is consistent with the specified guidelines. The Oregon Department of Forestry, through its Community and Urban Forestry program, advocates for selecting appropriate tree species based on site conditions, avoiding invading exotic species, and reforesting the urban environment. The project is designed and intended to accommodate major public utility infrastructure by removing trees from the subject area. The affected properties are zoned and designated for residential use and not for public open space or preservation. (The site is included in the Public Facilities and Services Plan, so a discretionary use permit is not required, and development is allowed.) For these reasons, the proposed tree removal does not rise to the level of a regulated timber harvest or commercial logging operation and the activity is governed by the applicable provisions of the Springfield Development Code. Therefore, the Oregon Department of Forestry objectives have been met by this tree felling proposal. H. Whether transportation of equipment to and equipment and trees from the site can be accomplished without a major disturbance to nearby residents. Response: Construction access to the site will be from South Se Place and will pass through a residential neighborhood. Public access is close to the local transportation network via Main Street. The proposed access road will also be used to access the project area, which is the only practical point of access from the site due to the topography. Tree felling activities will take place between the hours of 8:00 AM and 5:00 PM, Monday through Friday, and will be of limited duration. Therefore, transportation of equipment and trees from the site will be accomplished without major disturbances to nearby property in compliance with this criterion. IV. IN CONCLUSION Based on the information and findings contained in thiswritten statement and accompanying plans and attachments, the proposed development meets the Tree Felling criteria of approval contained in the Springfield Development Code. Therefore, the applicant requests that the City of Springfield approve the proposal. The applicant and their representatives are available for questions. We look forward toworking with staff to ensure this project meets the goals and objectives ofthe applicant and the City of Springfield. Those two applications, along with a Site Plan Review application, are being submitted for concurrent review and processing in support of the proposed reservoir project. Please refer to those applications, along with theirwritten statements, attachments and plan sets to gather a complete understanding of the proposal. Vegetation The overall reservoir site occupies one tax parcel. The proposed reservoir site is located on tax lot 100. A 15' wide gravel access road will be installed from South 661E Place, southward into Tax Lot 100. The road will continue to the reservoir site area and provide a safe turn around area. In terms of existing vegetation, the site is consistently covered in a mixture of deciduous and evergreen (primarily Douglas Fir) trees. Reservoir Site Existing Conditions Google Earth 2018 Re -Vegetation A tree survey has been conducted. This inventory can be found in the Existing Conditions, Survey Control, and Tree Removal Plan. Only those trees necessary to construct the improvements and to ensure safe and efficient operation of proposed facilities will be removed. As noted in the Tree Felling Permit Written Statement, there are hundreds of existing trees on the subject tax lot. 9.61 acres of the site, (87%)will not be disturbed. Of the 1.41 acres cf the3 site which will be disturbed, 273 trees were surveyed. Of those, 237 trees will be removed. Any areas of disturbance that are not covered by new structures or other surfaces will be seeded with a mix of relatively low growing, drought tolerant grasses and forbs—to minimize erosion, minimize stormwater runoff, provide an environment to foster restoration of the forest floor and improve the appearance and natural function of the site.
