EXPLANATION OF THE NATURE OF THE APPLICAT]ON
The applicant is requesting a Modifications of Provisions change the rear yard setbacl< from
10 f eet to 9 feet for the rear property line located to the south of the lot.
LOCATION OF THE PROPERTY
The property is located at 866 Water Street (Assessor's Map number 17-03-35-22,Taxlot
11400). The parcel is located within the City limits.
DECISION
A Modification of Provisions for a reduction in the required setback is found to be consistent
with the criteria of Section 11.030(1) of the Springfield Development Code and is appro.ved
with conditions, as of the date of this letter.

BACKGROUND/ SITE INFORMATION
The parcel is zoned Low Density Residential and is designated for Low Density Residential Use
in the Metro Plan. The parcel recently had a single family residence moved onto the lot. The
foundation for this house was poured at a distance of 9 feet from the property line. The
required setback is 10 feet from the rear lot line. The lot is approximately 6,300 feet and has
over 50 feet of frontage on Water Street and 130 feet of frontage on "H" Street. The lot
meets all other required lot standards for setbacks, frontage and lot coverage.

CRITERIA OF APPROVAL
(1) Section 1 1.030 of the Springfield Development Code states: The Director may adjust any
quantitative standard of this Code involving up to a 20 percent reduction or increase provided
that:
(a) Locational or dimensiona! problems have been identified; and
The applicant is requesting a 1Oo/o reduction of the standard f or a rear yard setback due to the
cost of relocating the house that has been moved onto this site. The lot is an irregular shape.
(b) The proposed adjustment is the minimum/ maximum necessary to alleviate the
identified dimensional or locational problem; and
A 1Oo/o reduction in the setback standard is the minimum standard required to alleviate the
locational problem associated with the placement of this house on this lot. lt is costprohibitive for the owner to move the house over 1 foot to meet the rear yard setback.
(c) There are no adverse effects on the neighboring property.
The neighboring property will not be affected by this 10% reduction in the rear yard setback.
The distance between the house located at 866 Water Street and the neighboring house
located at 856 Water Street is 17 feet. Setback requirements for this lot and ine adjacent lot
would require a minimum difference of 15 feet from the distance of each residence. The
current distance of 17 feet between buildings meets the minimum standards established for
lot depth to provide solar access for the site to the south.
(dl Public Safety will not be compromised.
The setback affects private property only and does not impact public safety or public property
CONDIT]ONS OF APPROVAL
The Director has determined that the Modifications of Provisions Application satisfies the
requirements of the Springfield Development Code and that the conditions are necessary to
satisfy the intent of this Code.
(a) Re-address the property to conform to the city standards that require a property
to be assigned an address that corresponds to the street frontage that contains theprimary entrance to the residence.
