MOBILEMANUFACTURED HOMES: An inspection is required after the mobile home is connected to an approved sewer or septic
system, prior to covering sewer or water lines, for setback requirements, blocking, tiedowns and plumbing connections.
Footings and piers to comply with State foundation requirements for mobile homes or as recommended by the manufacturer.
Minimum finished floor elevation shall be certified when required by Floodplain Management
Tiedowns, if requted, shall be instdled and ready for inspection within 30 days after occupancy. Tiedowns shall be installed per enclosure.
APPROYAL REQI.IIRED
No work shall be done on any part of the building or structure beyond the point indicated in each successive inspection without first obtaining the
approval of the building official. Such approval shall be given only after an inspection shall have been made of each successive step in the construction
as indicated by each of the irspections required.

SUBSURFACE & ALTERNATIVE SEWAGE DISPOSAL SYSTEMS:
When subsruface construction is complete, the permit holder shall notify the County Land Management Division by submitting the installation record
form. An irspection will be made by a qualified sanitarian. If construction complies with all rules a certificate of completion will be issued to the permit
holder. If construction does not comply with rules, the permit holder will be notified, and all corrections shall be made before a certificate of completion
will be issued. Failure ro meet satisfaciory completion within the allotted time constitutes a violation of ORS 454.605 to 454.745 and this rule.

City Jurisdietion of County Approved Temporary Mobile Homes
The city has honored all valid county land use approvals in the urban transition
area since land use jurisdiction for this area vas transferred from the count)' to
the city in L987. lle have extended this courtesy to property ovners vho hai'e
received county approval for a number of different activities. If the appror:ed
land use is consistent vith our ovn code, no further inl'olvement on our part is
necessary. If the approved use is not permitted by our coder v€ apply our
pre-exisiing non-conforming use standards as they are set forth in Article 5 of
it," Springiield Development Code (SDC). Such uses may continue provided no
change in iize, hours of operation or intensity occurs, and provided that the use
is not abandoned for more than 90 consecutive days.
The temporary mobile home reneval form you faxed to us appears to be an
authorizition for use based on some kind of hardship, although the particular
nature of the hardship is unclear to me. It also appears that this authorization
is subject to periodic reneval to determine if the applicant can demonstrate
continued conformance vith the Lane Code. Our code does aI1ov mobile homes to
be used as temporary quarters for emergency medical hardships, but only upon
confirmation by a Iicensed physician that the applicant requires "1ive-in"
assistance. This provision is further limited to l-2 months unless othervi-se
extended by Council. This provision cannot be invoked for financial hardship.

After discussing this issue vith our 1egaI counselr v€ have determined that the
differences betveen vhat the SDC aLlovs and vhat the Lane Code allovs are
-sufficient enough to consider this use as "pre-existing, non-conforming".
Hovever, because the Lane Code requires periodic confirmation of compliance, the
applicant is not guaranteed a perpetual right to this use. I'Grandfathering"
,ni"r SDC Article 5 could confer a perpetual right to use. To avoid such a
possibility, ve bel-ieve the most equitable arrangement is to require the
applicant to continue to observe all conditions and provisions prescribed by the
Cbunty authorization, including removal vhen the hardship ceases. The City can
assume this responsibility by requiring alL holders of this permit to sign a
compliance agreement vith the City (attached) thereby removing the County from
the 1oop. This vould probably be less enforceable than the present system
because ve cannot vrite citations for property outside the city limits.
